    Burtech Pipeline was hired by the city of ********* to complete a project outside of my home at *******************. I had just closed on the home on 2/28/25 and moved in on 4/1/25. The project began on or before 4/1/25. On 4/12/25, two inches of sewer water had flooded my bathroom. I had an inspection done prior to the closing of my home as well as a pipe check and was told there were no issues that needed attention for another few years. After speaking with the city, the city has sent them a Letter of Tender (Liability) and they are refusing to respond or accept responsibility. I have attached an email from the city's Risk Management representative, ***** ******, stating that the city has concluded that it is Burtech Pipelines responsibility to accept fault and come to an agreement with me. I have also attached emails I have shared with Burtech and call dates in an attempt to make contact with them. I am not at a loss of rental income, mortgage payments, out of pocket expenses to fix the bathroom, and personal item damages. Additionally, Burtech has littered on my property, illegally parked their vehicles in my driveway, blocked my driveway, left their vehicles long term parked around my home, and turned off my water without notice.

    Burtech Plumbing and Burtech Pipeline are two separate companies. Burtech Plumbing handles residential and commercial plumbing services, while Burtech Pipeline manages city and municipal projects. We do not have any involvement in city work, and we do not have an employee named **** affiliated with Burtech Plumbing.
    For issues related to city projects or if your concern involves Burtech Pipeline, we kindly recommend contacting them directly.

    To Whom It May Concern,
    Burtech Pipeline was contracted by the City of ********* to perform utility work in the public right-of-way near ********************** residence at *************************** We acknowledge receipt of her claim and understand she has also contacted our insurance carrier.
    After reviewing the scope of our work, we can confirm that Burtech performed no excavation, repair, or alteration to the private sewer lateral serving this address. We did not access or interfere with the structure or function of the lateral. Based on this, and the nature of our operations, we are confident Burtech is not responsible for the sewer backup Ms. ******** reported.
    Regarding the additional concerns:
    Driveway access and water service: Any temporary impacts would have been performed under City-issued permits and approved traffic control plans.
    Littering and improper vehicle use: We dispute these claims. Our crews worked exclusively within the public right-of-way and maintained orderly, compliant work zones. We have no record or documentation supporting these allegations.
    Burtech Pipeline remains committed to cooperating in good faith with the City, our insurance provider, and the property owner. However, based on the facts, we do not believe Burtech bears liability for the damages claimed.

    In response to Mr ********** I have attached examples of the littering, illegal parking, unpermitted and illegal parking signs, and letter of liability from the city. His excuse is that Burtech was not performing any work on the day of the incident on 4/12. However, as I have explained to him several times, I was on a work trip and left on 4/8. On the morning of 4/8, two men from his team came onto my property and did something, what exactly, I do not know. So when I returned home on 4/12, the blockage had already occurred but could not cause any issues till I was home again and using the water. I had just closed on the home 2/28/25, and moved in 4/1/25. The inspection that was done during the escrow process proved there were no issues with my pipes and I even paid an additional fee to have a camera run through my lines to confirm this.
    The city has told me that they have had several issues with this company, and proved on their end that this was an issue caused by Burtech. They have a history of causing damages to other peoples homes and will refuse liability. They do things on our streets without permits or fair notice, litter, and trespass. Burtech is essentially playing fast and loose with people's personal property and then throw their hands up when told they are liable.
    I have attached photos of some of these items. Unfortunately, I was only recently able to move back into my home due to the destroyed bathroom, and don't have photos of specific instances like the contractor parking in our driveway and blocking it.

    Burtech Pipeline maintains a strong and professional relationship with the City of *********. In fact, at the direction of the City, we were instructed to cease direct communication with you as they informed us they were handling your concerns directly.
    Your statement that the City has "had several issues with this company" and "proved on their end that this was an issue caused by Burtech" appears to be a mischaracterization. The City has not shared any such findings with our team. To the contrary, the City engineers assigned to this project have continued to work closely with us and have not indicated that we were at fault in the manner you described.
    We remain committed to working cooperatively with the City and following their guidance on all matters, including communications related to this project.
