    Restcon took a sample of our kitchen linoleum and had it tested in a laboratory. The linoleum and adhesive came out negative for asbestos. We proceeded to remove the kitchen flooring as if it didn’t have asbestos and found another layer of old linoleum underneath the top linoleum in the kitchen. Restcon stated that they removed the sample down to the concrete in the kitchen so we proceeded to remove both layers of the kitchen linoleum. However after looking at the old linoleum closer (after removal took place) it didn’t match the description of the kitchen linoleum tested. I asked them to take samples of the old linoleum and the did free of charge, and the old linoleum came back positive for asbestos. They sent the original technician out the same day as the positive results to take pictures and he apologized for the mistake of not taking a kitchen floor sample down to the concrete as he said he did. I’m waiting for the next steps to keep my family and myself safe in a house where floor grinding took place on asbestos containing floor. I just hope we’re safe. My husband, elderly mother, and baby were home during the floor grinding. They moved to the other end of the house but who knows how far the fibers traveled.

    I have gathered details regarding the complaint.   We performed an asbestos survey in October in which we sampled some flooring.  The technician only detected one layer of flooring in the areas sampled.  The report indicated only one layer was found.  The homeowner hired someone to come remove the flooring and install new ceramic tiles in the middle of December.  During the demolition, the person/company (HO wouldn’t give this information) removing the flooring discovered a 2nd layer of flooring and mastic that wasn’t previously sampled.  We received a call from homeowner that there was a second layer, but it had all been removed already that day and was now sitting in the driveaway and that she was concerned.  The person / company removing the floor had grinded the concrete slab to remove the mastic.  We sent a technician to sample the flooring and mastic of the 2nd layer, and both were positive for asbestos.  Even with the positive results, the homeowner continued with the project to get the flooring done for the holidays due to guests in her house.

     I am rejecting this response because:  Restcon supervised their technician removing the old kitchen floor and said to me that the technician tests floors down to the concrete.  Restcon texted me a photo their technician removing the floor in the kitchen which is attached.  This is how I know that they tested in the same location where the two layers of floors were located.  That is why I'm asking Restcon to pay for the Procedure 5 that is recommended due to the floors being removed incorrectly due to false negative asbestos results.  After the floor was removed, I was able to get a better look at floors and had a gut feeling it wasn't tested and positive for asbestos.  I asked Restcon to come back for the peace of mind that they actually did test down to the concrete, which they clearly didn't.  I just want to take care of what needs to be done for my family's safety, but cannot afford the large estimate the asbestos abatement company sent me for a Procedure 5, which was a company that Restcon called and sent to our home to repair the damage that was done because of their mistake.
