Nashunya ***** ************************************************************************** ********************* ************ May ******* Better Business Bureau Subject: Complaint Against Evolve Construction Dear Better Business Bureau,I am writing to formally file a complaint against Evolve Construction regarding their failure to fulfill their obligations in a contractual agreement related to repairs on my ******* April 2024, I was contacted by Evolve Construction to assist with a claim on my homeowner's insurance for roof repairs. After their initial outreach, Evolve Construction came to my home, removed several interior items, and stored my furniture. Unfortunately, as of now, over a year later, they have not completed the necessary repairs or returned my items, causing significant disruption to my living ************ the time since, I have made multiple attempts to reach out to Evolve Construction for updates on the status of my claim and the repairs. Each time, I have been reassured that they are working on my case; however, no tangible progress has been made. I am currently living in an apartment inside my home, which is in a state of disrepair, leading to issues with rodents, bugs, and falling debris.I have documented all communications and attempted resolutions with Evolve Construction, including [mention any specific dates, emails, or calls if applicable].Given this experience, I am seeking your assistance in resolving this matter. I believe that Evolve Constructions lack of response and failure to complete the work is unacceptable, and I would like to bring this issue to your attention to prevent further occurrences.Thank you for your time and assistance. Business Response

      Date: 06/09/2025

      Dear Better Business Bureau,

We appreciate the opportunity to respond to the complaint filed by Ms. ******** *****, and we take her concerns seriously. However, we must respectfully clarify several factual inaccuracies and misunderstandings in her submission.

      1. Evolve Constructions Scope of Work

Evolve Construction was initially engaged to assist Ms. ***** with her homeowners insurance claim related to roof damage. Our role was limited to:

Providing a roofing estimate for the insurance carrier Coordinating with her insurance to determine scope and coverage. The carrier state farm has not approved this claim. At no time did Evolve Construction remove furniture, store belongings, or perform interior demolition or packout services. These services were independently contracted to Calmaster Restoration, a third-party vendor that was not retained, directed, or controlled by Evolve Construction. The complaint appears to conflate our roofing involvement with services rendered by another entity.

      2. Outstanding Balance & Storage Issues

We have now reviewed the attached debt collection letter issued to Ms. ***** by Calmaster Restoration. This is a private billing dispute between Ms. ***** and Calmaster, relating to unpaid charges for packout and storage services which were explicitly outlined in her agreement with them. Evolve Construction is not a party to that billing dispute, and has no control over the storage or return of her personal items.

      3. Communications and Status Updates

Ms. ***** made multiple inquiries over time, and our team did respond to her concerns as promptly as possible. However, as repairs could not move forward due to unresolved third-party charges and access limitations, our scope remained on hold until further coordination could occur between the insurer, the homeowner, and the storage provider.

      Final Remarks

While we understand Ms. ****** frustration, her complaint should be directed to the third-party vendor referenced in the attached demand letter, Calmaster Restoration, for resolution of the packout dispute. Evolve Construction remains committed to resolving our portion of the contract but cannot be held liable for services we did not provide.

On September 28, 2024, we signed a contract with Evolve Construction and Restoration and made a down payment of $30,800 to cover supplies. The company was supposed to replace the roof on our home and outbuilding. We were informed that other items on our insurance claim were outside their scope. However, they are now claiming they deserve 20% of the *** for these additional items because they are acting as our general contractor, despite our contract explicitly excluding the fence and gazebo, and their statement that they dont handle interior work. After months of trying to get a date for the roof replacement, the company only responded when we threatened to report them to DOPL, DCP, BBB, and the police. They then told us they could start the job once we got the *** ******, on the call. Why didnt they start right after the contract was signed? We have requested a refund of our down payment and even offered to pay $5,000 to be released from the contract, but they refused. Instead, they demanded 35% of the *** or insisted on doing our roof, while also claiming 20% of the *** for items outside their ******** biggest issue is their lack of communication. They swore at me, using the F-word on the phone. I have recordings of these conversations, and I informed them I was recording. I remained calm and did not yell at them. I do not want someone with such poor communication skills and an agitated demeanor handling my project.Their website states, "No Middlemen" however, subcontractors are the roofers they use. I was also informed by the subcontractor they sent out that my price would be higher due to a price increase on materials after my contract was signed. This is not how business should be conducted.

      Hello,

      1. Pursuant to customer agreement you attached under term 5 of the contract if you decide to cancel the agreement Evolve Construction will be entitled for 35% liquidates damages of the *** amount.

      2. We would like to fulfill our contractual obligation on your job as per the contract. We strive for 100% satisfaction and would be happy to discuss this further with you.

      3. Please go ahead and provide any recordings where anyone from our company was cursing so we can address that immediately. *************************************************************************************************

      4. Our crews are in house crews, we only use subs on speciality trades that we dont have crews for.

      5. As a general contractor, if we do sub out the work on a speciality trade, then yes we would be entitled to 10% overhead and 10% profit.

      6. Our contract is for the *** which means we are going to follow the insurance scope and replacement cost value of that scope. You are only paying your deductible. Nothing less or more unless you specifically request an upgrade or for us to build something outside of the insurance *** scope.

      thank you.

I am rejecting this response because: the *** on the contract does not match what was excluded from the contract. I do not trust the company to actually do this job. I want to know why my job was not done in a timely manner? 6 months is not timely.

I sent the recordings to the email given.

****** our production manager who I had never heard from until March 27, 2025, 1 day shy of 6 months from our contract sign date, does not even know what type of metal to use for part of our job. This is highly concerning to me.

I received a phone call to have my roof assessed for damage, met with sales person, they told me that I needed roof completely replaced. Sales person set up time with my insurance adjuster to assess cost and coverage. My insurance policy requires $5,000 deductible. I needed time to collect this money, was told that if I gave them referrals I would get $500 off my deductible for each referral. I did get a referral, and was also told if I allowed an Evolve sign in front yard I'd get another $500 off deductible. I paid $1,000 in month of June, and then another $3,000 in December. Each time sales person came to house to pick up check, I was not allowed to use debit card or send to an address. My neighbor was the referral I gave them, work was done, however not done well and to this day still has not been completed. I have been trying to contact the sales manager, he will not return my calls. I have contacted owner, we have spoken 3 times, always says I will get a call back that day, however I have NEVER received a call back. I told them that I just want my deposit back and have no desire to have them do my roofing job. I have been trying to contact someone other than customer service, who also tells me I will be contacted for over one month. Please help me.

We were contacted by ***** ******** in mid-July who said he was a Field *** for Evolve. He came to the house and helped us set up an evaluation for a new roof (storm damage) with our insurance company. He returned to accompany the adjuster on 7-29, and we signed an electronic contract on our iPad at that time. He returned on 8-8 to pick up a paper check from us for $7,087.34 which was for materials and part of the labor. A few weeks later some roofing materials were dropped next to our garage without our knowledge and with no paperwork or markings to indicate where they were from. We called *** ********, who was unaware that materials were delivered and had no date for the work to be done. He stopped answering our calls after that, and the national number ************ took many calls from us over the next two months saying someone would call us back. They didn't return any calls. We learned that *** ******** had been arrested (he had a record) and placed into rehab. I contacted the police, and they were able to get me a number that would answer *** *** ************. He said the company was trying to get a permit for the roof and had me call the city to see if I could get an owner's permit. I learned from the city that owners could not get permits for companies, I also learned that Evolve doesn't have Iowa workmen's comp or the ability to work in ****. *** *** then said that the contract we signed says that we can't cancel once materials are delivered and that they have 2 years to complete the work. He said that we would have to sue the company. Four of the six houses on our block have gotten new roofs while our materials are still sitting in our shared driveway. We feel that we were the victims of elder fraud. We want either a full refund of the money or someone to take responsibility for the materials and refund the labor portion. We can't hire a local contractor because we're under contract to a company that can't even work in this state months later.

Evolve Construction came to your house stating you needed a new roof, started the process with the insurance company. *********************** Claim Advocates has been involved also and they are the ones that recvd the money. They have been contacted as well and continue to get the run around. The check was addressed to ***** and NICA and they signed the check without *****'s signature. Thank you for your email and for bringing this issue to our attention.

Evolve Construction & Restoration apologizes for the delays and the ongoing frustration. It is clear that there have been significant issues with communication and handling of the project. We will investigate the situation with NICA and the status of the materials at *****'s home immediately.

We will verify the status of the check. However, rest assured that once the check is received, it will be placed into a trust fund as per your acquired public adjuster NICA.

I also discovered that the project is currently in the permitting stage, which may vary depending on local building regulations.

Please rest assured that we are taking this matter seriously and will work to resolve it as quickly as possible. We will update you with detailed information and the next steps once we have more clarity.

Thank you for your patience as we work through this.

I gave Evolve full payment of $52,650 on February 6, 2024 for a complete tear off and new tile roof. The sales rep ******** told us that he would place the tile order right away and let us know the order number and estimated delivery date by the end of the week. I NEVER heard from ******** again despite multiple phone calls and texts to him. I then tried to contact the manager *** multiple times through email, phone, and texts to which he never responded. After 3 months of no communication about the job, I wrote a poor ****** review of the company and filed a complaint with the BBB on May 3. *** then called me irate on May 4 threatening to *** me for slander. He agreed to push the project along and assign a new sales rep ****** if I would take down the review and resolve the BBB complaint, which I did. I then got an email from the national production manager *************** on May 7 saying that the tiles have been ordered. I replied to that email 3 times requesting more information and got no response. I have tried contacting *** again numerous times with no response. I have never heard from the new sales rep ***** It has now been 5.5 months since they took my money and I have NOTHING to show for it other than "the tiles have been ordered." I am rejecting this response because: This was the same response I was given 3 months ago when I filed my first complaint. There was one day of communication, as a result. A text message from the project manager ************* and an email from the production manager ***************. So although I appreciate your response, I have no reason to believe that sufficient action will be taken based on the previous history. We had a contractor from Evolve Construction & Restoration solicit us at our residence to inspect our home for hail damage. We allowed him to look at our roof and he stated that he did find hail damage and suggested that we file an insurance claim. We did so while he was there. He asked us to sign a document in good faith stating that we would use Evolve for the repairs. Several days later, I received a call from my insurance company's adjuster to schedule a ********** to come perform the inspection. Upon his arrival, he performed the inspection and informed me that the insurance company would be working directly with the Public adjusting firm. When I questioned him on this he explained to me that I signed a Residential Public Adjusting Contract and that the insurance company had to work directly with them. I reached out to Evolve, but nobody answers. The insurance company provided me with a copy of the document that I signed that had more information filled in. A company called ****************** Claims Advocates was listed as the adjusting firm on it. We then called them , but they just stated that we signed a contract and had 3 days to get out of it. They will no longer answer or return our phone calls. I did some research on both Evolve Construction & Restoration as well as ****************** Claims Advocates. The signature of the Licensed Adjuster is someone by the name of ***************************** who is based out of **********. He, along with Evolve Construction & Restoration, is currently in litigation in the state of ******** for receiving payment from the plaintiff's insurance company for repairs to their roof, but the work was never performed. The Rep that solicited us from Evolve misrepresented himself to us as a contractor and the Public Adjusting firm was never part of the conversation. It now seems that I am locked into a contract with a Public Adjusting firm that I never wanted to begin with, and from my personal research, appears to be a scam.

I was contacted by ******************************* ************ on or about 3Aug2013 about checking my roof to see it needed repair or replacement after a hailstorm we had previously had. ******************************* said it needed replacement where upon he submitted a claim (with my knowledge) to my insurance: Farmers policy ***********, claim number 7006401907-1. ******* told me that Evolve would take care of everything all I needed to do was sign the contract, choose the color of the shingles, and co-sign checks along with Evolve (checks could only be cashed if we both endorsed). ******* went on to say that Evolve had a (pa) public adjuster that would be sure that anything that needed to be done would be done. He also said that Evolve had an OMBUDSMAN paid by them, but, worked for the customer and he would look after my interests . It is almost February **** and the shingles and other supplies are sitting on my driveway. It has come to my attention that Evolve cashed two checks from Farmers without my signature . I would like for Evolve to do the right thing and contact me to set up a date to finish the roof.
