    Consumers who are considering renting a property through Airbnb, and individuals who are signing up to rent their living space as a host through AirBnB, should be aware that there are laws that need to be followed and the laws vary by state.

    If you are renting a space, check with the host to ensure they are meeting applicable laws and guidelines. If you are a host your duties include ensuring you review the following, per Airbnb's website:

    "Contracts:
    Check your HOA or Co-Op Board regulations to make sure there is no prohibition against subletting--or any other restriction against hosting. Read your lease agreement and check with your landlord if applicable. You may consider adding a rider to your contract that addresses the concerns of these parties and outlines the responsibilities and liabilities of all parties.

    Taxes:
    Ensure you look up any local taxes or business license requirements that may apply. This may include things like hotel/transient occupancy tax, sales, and other turnover taxes such as Value Added Tax (VAT) or Goods and Services Tax (GST), or income tax.

    Permits or Registrations:
    Ensure you look up any permitting, zoning, safety, and health regulations that may apply. The governing authorities that regulate the use and development of property in your area may have useful information on such regulations.

    If you're an Airbnb host, you must make sure of the following:
    You have all necessary permissions to offer your accommodations, including ensuring that your hosting activity (i) will not breach any agreements you have entered into with any third parties (such as any agreements or rules with a landlord or HOA) and (ii) will (a) be in compliance with all applicable laws, Tax requirements, and rules and regulations that may apply to your Accommodations, including, but not limited to, zoning laws and laws governing rentals of residential and other properties and (b) will not conflict with the rights of third parties"

      My mother made a reservation for me for a month at an airbnb in **. From April 4, 2024-May 4, 2024.On April 21, 2024 the host had a Passover party (so I am empathetic) without advising me the person staying in the suite she is renting out. The suite is attached to the kitchen and her laundry room. There are kids running and making noises at the door. They are playing the piano etc no heads up was given. I called to ask if they could please not have the children run next to my door. I have a disability that falls under the *** guidelines. I called and let Airbnb know this. I told the Airbnb agent that I could give him all of my mothers information everything about the booking except that I dont have the reservation code. This meanwhile in pain being inflicted by the host to my disability. Triggering my symptoms. The agent refused to give me his Supervisors name. I asked that under the *** I be reasonably accommodated by being put on the phone with a supervisor. They refused. If I end up hospitalized due to Airbnb this is a big problem. I needed help now.       Our unfortunate experience with Airbnb and hosts ******** and ***** in ******, *******, led to a deeply frustrating and disappointing outcome, particularly as it spoiled a special event planned for my daughters 16th birthday.Booking and Initial Issue:We booked a stay for March 23, 2024, and even bought extra insurance for unforeseen events. However, we had to reschedule when my oldest daughter unexpectedly went into labor just before our trip.Rescheduling Ordeal:Airbnb assured us that rescheduling would be straightforward and instructed us to coordinate with the hosts. ******** and ***** initially agreed to reschedule to April 20, 2024. Yet, as the date **** near, I discovered that the booking change hadnt been officially processed. Airbnb blamed the hosts for not submitting the required Authorization for Date Change form. Upon contacting them again, they informed us that the new date was no longer available.Result: No Fault of Ours, No Stay, No Refund:Despite numerous efforts to resolve this with Airbnb and the hosts, and after spending over $415, we didnt stay at the property nor received a refund. ******** and ***** offered no further help, and Airbnb closed my support ticket. To worsen matters, Airbnbs records mistakenly showed we had stayed on the original date, making our insurance invalid unless amended.Host and Their Attitude:The hosts were dismissive when asked for assistance, implying that dealing with such issues was not their responsibility. This lack of empathy and their failure to handle the paperwork exacerbated the situation.Conclusion:This ordeal has inflicted significant financial and emotional strain on our family. Instead of celebrating my daughters birthday, we experienced unprofessionalism and disregard from our hosts and Airbnb.I seek advice on effectively resolving this issue. I also caution anyone considering booking with ******** and ***** to be wary of their indifference to guest needs and poor customer service.
