  • Pending Government Action:
Government Action: BBB reports on known government actions involving business’ marketplace conduct:
Attorney General of State of New Jersey v Discord

The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government’s allegations, which have not yet been proven.

On April 17, 2025, The Attorney General of New Jersey filed a lawsuit against Discord Inc. for violating the New Jersey Consumer Fraud Act (CFA), therefore leaving children vulnerable to online predators.

According to the complaint, the lawsuit stems from allegations that Discord misled users into thinking that the Safe Direct Messaging feature that was included in the “user setting” between March 2017 to April 2023, and the software that replaced it would automatically scan and delete all private messages with explicit content. It is alleged that even when the Safe Direct Messaging filters were turned on, children were still exposed to sexual and violent content. The complaint also alleges that although users must be at least thirteen years old to use the app, all that was required to set up an account was to enter a birthdate.

The Attorney General is seeking an injunction to stop Discord from violating the CFA, to pay civil penalties, and the disgorgement of any profits generated due to their behavior.

    The case is still pending.
