      6/22/2022 Date of Tow 6/22/2023 Date of Demand Letter My ******** work for a junk removal service which involves removing large recreational vehicles abandoned on recently purchased properties. Prior to leaving we parked my box truck, my wife's **** my tractor, & several other vehicles on ************** in an area that doesnt disturb the residents. A friend checked on it daily. I was informed the box truck had been towed. I reached out to the ********* PD. Both denied the Tow. I suspected there is only 2 companies capable of towing a box truck. I drove up to College Oak Towing, Spotted my box truck noticed their gate was open. I seized the opportunity to snap a photo of the windshield, where log #s for inventory are put. Called & they denied the tow. I provided plate #, VIN, still denied any involvement. Finally, I referenced the # from pic, they replied WHO GAVE YOU THAT NUMBER?" It was evident, something deceitful was happening, especially considering the valuable asset in my box truck: my cherished 1967 Pontiac Firebird Ive had since age 24, Restored can sell for $80K to $100K, I was targeted due to the valuable car inside. I was denied access to retrieve my personal belongings from inside, which would include my Firebird. I showed tired of being ignored & requested access to my personal belongings, they told me that they had smashed the box truck, including all that was inside. This was only 15 days after the original tow. CA VC *****, requires tow companies to allow vehicle owners to remove personal property. CA VC ******* states they provide invoice of ****************** of tow. Violation of CA VC 487, which defines grand theft as the unlawful taking of another person's property valued at $950 or more. violation of CA Civil Code 1803, which stipulates that a person who intentionally damages the property of another is liable for damages and is in violation of CA BPC ******, which prohibits towing companies from using fraudulent or deceitful practices

      My wife and i have AAA roadside assistance. My son got into an accident and totaled my 2004 ***** Civic. The officer on scene let us use our AAA roadside assistance. My wife called and ,as i was on route to accident site. My wife was on phone with AAA roadside assistance. AAA had dispatched College Oak towing to tow our vehicle. My wife directed the driver to site. I was there when they got there. They hooked up my car to tow. Then proceeded to talk me into storing vehicle at there lot. I asked if they were going to charge me to store there. He told me no they wouldn't since we have AAA and essentially they are AAA. I explained i have actually coverage for this vehicle with ***************** That we only have AAA roadside for towing . He still said no they wont charge you. He also said this to my wife on phone when she directed him to cars location. There was also a man that the Tow driver was training that heard this conversation. Well when i came to get vehicle they informed me that i would have to pay the storage fees before i could take car. This was the first time i heard of this. Since I'd been calling Lot to see when best time to take pictures and have vehicle towed to dismantler . They never told me i was being charged daily or anything. They made no effort to inform me this was happening. When i spoke to manager at ******* College Oak Yard. He claimed it came in as a rotational call. I told him that was not the case. Told him about his driver telling me they weren't going charge any storage or fees since we were AAA. He took my cell number and said he was going to talk to his driver and he would call me back. He never did and i called him eight times that he was busy they took number again and he never did. College Oak claimed that i got certified letter about this. I never got this letter. If it was certified i would have had to sign to receive it. They have no signature. There driver made a mistake not knowing the difference between AAAroadside/full AAA.

      On 10/24/22, I contacted AAA to have my car towed. AAA contracts with 3rd party vendors. Therefore, College Oak Towing came to tow my vehicle. Upon drop off of my vehicle at the tow destination (*****************) the tow truck driver damaged my vehicle by scrapping the roof of my vehicle (scratching the roof, damaging the roof racks and the panaromic sun roof) on the service light of ***************** service stall. The tow truck driver was apologetic and stated he would report to his boss next day. On 10/24/22, I contacted AAA immediately to report the damage done to my vehicle by the tow company. AAA advised I have to try to resolve the issue in my own since it was a 3rd party. A couple days later *** from college oak towing contacted me and advised he was aware of the incident (employee told him about damage) and that I needed to get an estimate for the damage. Also, *** stated that they are a large company and basically they would not file an insurance claim through their Carrier however would pay out of pocket for the damage. So I got an estimate from a AAA backed company and emailed *** the estimate. *** responded advising that *********************, would be handling the issue and would work on processing the payment. Early Nov I began following up about payment and went to their business location 11/22 to get payment, I spoke to **** directly and he said he would process payment. I called and left msg and emailed checking status of payment through early Dec. **** manager and owner of College Oak Towing stopped returning phone calls/emails. The company is negligent and the fact that the employee told the company about the damage and the company paid ***************** immediately for the damage done to their service light. Therefore, its completely dishonest that the company knows they were responsible for the damage to my vehicle and basically refuses to do what is right. By apologizing for the damage and paying for the damage done to my vehicle using their service.
