************************* from CJM Association force charged $10k restoration fee onto my account which should have been covered by the association's insurance, thinking that young ***** female immigrant would be soft-spoken and an easy target for this financial exploitation.In March 2023, there was water damage from behind my bathroom wall that leaked to the neighboring unit downstairs. My insurance would not cover it since there was no damage in my unit and it was not a result of any human errors or negligence of tenants inside our unit. The HOAs insurance, which covers wall-in, should be able to cover this case since the water leak was from behind the wall. However, instead of opening an insurance claim and starting the investigation, HOA supervisor ************************* sent me a hearing invitation through mail while I was abroad. She held the hearing in my absence and decided to charge the $10k invoice onto my account. Knowing I was abroad, she sent me the hearing invitation (including a Zoom link) and the decision letter through physical mail, which I only discovered after I returned to the U.S. three months later, in September. After I pointed out that the HOAs insurance does cover wall-in and tried to open a claim with the HOAs insurance broker, ************************* forcefully withdrew the claim with the insurance broker and insisted that I pay the $10k fee. This is not just negligence; it's a clear case of targeted discrimination and abuse of power. She might see me a young ***** female immigrant as an easy target for this blatant financial exploitation. Her actions are not just deeply unjust; they are discriminatory. Im filing this complaint against both CJM HOA for their failure in handling this situation and especially against ************************* for her blatant discriminatory behavior and unprofessional conduct.Business response

I am rejecting this response because: the respondent is not trying to resolve the issue at all. I've already requested another hearing multiple times and ************************* rejected it all. I will escalate the issue to state senators and state HOA supervision agencies.

CJMASI was busy sitting on almost 4000$ of my funds which I paid by mistake over the years (I had duplicated the HoA payments by mistake). When I asked them to investigate, the reply was not germane to my ask. Instead "Let me know if I can help you with anything else". I let that slide by.It is 3 weeks now, since they sent me a refund. They are not providing me with status updates. Their arrogance is unbelievable. They do not check their emails on Fridays and weekends. How difficult is it to deal with urgent issues (which takes few seconds to resolve) by checking their email on their phone?The HoA BOD member was supposed to sign off on the reimbursement request. Something which should take 5 seconds. CJM can't even influence the HoA BOD member to do this simple ask. I am spending hours just following up with these indifferent folks. I threatened them with a lawsuit. Still they don't care and are not respondingBusiness response

Hello,
The owner, *********************************, mistakenly set up duplicate payments for his monthly assessment. Our ***************** cancelled the one auto pay that they were able to and the owner requested that he be reimbursed by the Association for the amount he had paid twice. Our ***************** issued a reimbursement check to *****, but only one of two board members approved it. CJM ASI does not have authority to sign checks or issue payments. Two board members must review and approve all payments. We reached out to a second authorized board member in writing and by phone, asking that they approve the reimbursement, but they did not respond or authorize the payment. Prior to this matter, CJM ASI had terminated our contract with the Association, therefore after August 31st, we no longer oversaw their payments and directed the owner to the new management company. In addition, we sent any and all documentation pertaining to this reimbursement to the new management company.
Our management agreement specifically outlines that we have no check signing authority, therefore, we could not expedite this payment. The Association is run by five board members and they are the only ones with check signing authority. We did bring this to their attention, but unfortunately, they did not take action to approve it.
Please note that our office is open Monday-Friday from 9:00 am to 5:00 pm. Our on-call manager is available for maintenance emergencies that threaten life or property when we are closed. We do not respond to calls or emails over the weekend. On the Friday mentioned, we let our staff leave early for Staff Appreciation Day, which is an annual CJM event.Initial Complaint

My HOA (Home Owner Association) without my knowledge or permission came on my property and removed a tree and surrounding shrubbery. When I asked to replace the tree and shrubbery they replaced with a very cheap tree and no shrubbery. This left my landscape looking empty for almost a year- Spring 2021. I have called and sent several emails with no response. Now landscapers have come on my property and sprayed a chemical on my grass turning it *****. I believe this was done in retaliation for my complaints about the landscape issues.Business response

The Association maintains the common area in which the landscaping was altered. It is not the property of the homeowner, but shared common area maintained by the Association. CJM ASI is the managing agent and we take direction from the Association's ***** of ********* who authorized the landscaping work in the common area. The formal complaint from the owner will be brought before the ***** of ********* by CJM ASI. The ***** will discuss and determine if further landscaping alterations must be made.Customer response

I am rejecting this response because:To destroy my grass and bushes and then say it is at the discretion of the *** to fix it or not is unacceptable. My property has been maintained util now. Destroying it and leaving that way because you feel like it or because you do not want to spend the necessary resources to fix what you destroyed is unacceptable. Secondly I am African American, I feel this may be a race issue. No one in this complex had their property destroyed like mine. I have looked at each house in this complex. No property other than mine has been *************.

I am rejecting this response because:The Landscaping and missing shrubbery has been in this condition for close to a year if not longer. This issue is not resolved. If my front yard is not my responsibility but the attorney acknowledges that it looks like a chemical has been sprayed on my grass then those who maintain my yard is responsible for it. I saw the landscapers/gardeners spray using a container that look like insecticide container on my grass immediately after I complained about the landscape. There is no other logical reason other than retaliation. I have no idea how this will affect my health being that I am a Leukemia patient.
This issue is not resolved until a plan is developed and implemented concerning this issue.

I make my checks out to CMJ Associates every month. It's a bit weird that they are trying to separate themselves from this issue.
Just to be clear. Once I complained about the landscaping, I physically saw the landscapers spraying a chemical of some sort from an industrial looking container on my yard and my yard has turned ***** because of it. As I stated in my response, I am a CML (Chronic Myloid Leukemia) patient. I take Chemotherapy every day to stay alive. I have absolutely no idea what affect this chemical they have sprayed on my yard has done or will do to my health now or in the future.
My ask is simple, replace the shrubbery (and possibly grass) you took out. Thats it. I'm not asking anything that is unreasonable. Now, cats, squirrels, and possums make this their resting place because of this gaping hole.
I ask that you keep this complaint open until they resolve this issue with a fix or a no fix. Either way they must make a decision.Business response

The ****************** Homeowners Association ***** of ********* is the decision-making body that has the authority to make decisions related to front yard landscaping within the development. CJM Association Services, Inc. does not make such decisions. **************** monthly assessment check is made payable to ****************** HOA it is sent to CJM Association Services, Inc. as the managing agent for the Association, but is made payable to the Association.Customer response

I am rejecting this response because:My landscaping situation has been in this condition well over a year. The association has met several times and has not replaced the missing shrubbery. Now my grass has large dirt patches in it since my complaint. This need to be resolved from the managing party to persuade the local board to do the right thing. Replace the shrubbery and grass.
