    I am writing to file a formal complaint against RW Selby ******************* regarding a series of issues that have significantly impacted my living situation and safety. Despite repeated attempts to address these concerns with the company, they have been unresponsive, vague, and unhelpful, leaving me with no other option than to escalate this matter to your office. RW Selby ******************* is responsible for the maintenance and safety of the building in which I reside. The building has failed two city inspections, which I was unaware of until recently. As a result, I have been informed that I am now being forced to temporarily relocate for a week so that a critical safety issue, specifically related to a bathtub, can be repaired before a third city inspection on November 14, 2024. Can a property management company legally charge full rent under these circumstances, especially when the property is not in full compliance with city safety codes? Aside from this, these are other issues that have occurred:Summary of Complaints:Failure to pass two city inspections without informing tenants.Forced relocation for repairs with very little notice or clear information.Unfair rent charges despite the buildings failure to meet safety standards.Numerous break-ins due to inadequate security measures, including a broken garage door that remained unfixed for two months.Failure to address tenant safety concerns or provide adequate support during security *********** full time management in property I request that the BBB investigate these issues and hold RW Selby ******************* accountable for their lack of transparency, failure to maintain a safe living environment, and the undue burden they have placed on tenants. I am seeking a formal resolution, including appropriate compensation for the inconvenience, potential rent reduction for the time the building has been out of compliance, and a commitment to improving tenant safety and communication moving forward.

    Date of transaction is 9/15/24 Security Deposit $995.00. R.W. Shelby kept $564.60 claiming the apartment was left dirty and carpet needed to be replaced as well as being charged for the final bill of utilities. We had hired a cleaning lady to clean the apartment and the carpet had dirt stains all which we can provide pictures of both the apartment as well as the carpet. We tried emailing the leasing manager ******* ******* and was told by ****** from the main office in *********** that there has been a change of management and that could be the reason she hasnt contacted me. On October 10, 2024 we tried sending a certified letter with no success. And on October 22, 2024, the date I spoke with ****** from the main office in *********** she took all the information and we still have not received any response. In addition, we were being charged the final utility bill up to and until I sent the final invoice which shows they took the money for the bill.

    In July 2023 I signed a lease for a 1 bedroom and 1 bath apartment. I documented all of the damages and repairs that needed to be made. After a couple of months, I resubmitted work orders because they were never fixed. They would just close the work orders fraudulently and leave our apartment to rot. The main work order was to fix a swollen wall in the bathroom due to moisture and mold. The came in to just replace the dry wall and did not fix the mold after a complaint to the city forced them to act. They still just fixed the dry wall instead of taking care of the source of the mold problem. With them being in violation of providing a safe place of living and making the unit uninhabitable, I and my girlfriend (added to the lease in September), requested to leave without a lease break fee. They threatened us into paying a lease break fee even though we had every legal right to leave after four months of them refusing to fix the mold problem. After threatening legal action, the regional manager, *****, called to tell us that our lease break fee, moving costs, and security deposit would be refunded in full. He lied thinking we would give up if he made us wait a month for money he was never going to send. Since then we have been ignored by the company and have yet to receive our lease break fee or deposit (nor did they send a bill) since moving out November 15th. Our lawyer has attempted to mediate yet they ignore them as well.

    I applied for an apartment at ********** Apartments. In order to submit the application I was required to pay $309 for "pet deposit" in addition to the $150 charge for 3 applicants.3 days after submission I viewed the apartment and chose to not rent. They never stated whether I had been approved and was never asked to sign anything. Since October 1st 2023 I have been emailing and calling both ********** and its property manager R.W. Selby in order to request the refund for the pet deposit that legally needs to be returned within 21 days. I would like to have my $309 back. This apartment complex has no right to keep my money and apparently R.W. Selby was sued by the federal government for fraudulent activities using tenants deposits, cleaning fees etc. I do not know how to get my money returned, but I would never rent from an R. W. Selby company ever.

    This business practices illegal operations by not abiding by a lease contract. I am on a month to month lease agreement where they are refusing to acknowledge my 30 day notice. They are attempting to impose a roommate release that is not within the lease agreement nor relative to a month to month lease. I also believe this is harassment against my age and gender by attempting to impose a clause that is not legal.

    I paid two deposits in Rochester Ave, apt 214, one transaction was 300, the other one was ****. The total deposit was ****. But when I moved out, it only made the refund of *******.

    Attempted to pay the company multiple times for back rent and communicate accordingly under West ** Renter's Relief City Ordinance; however, neither corporate nor on-site management spoke efficiently nor effectively to help adhere and accommodate. Instead, they began the eviction process illegally over one month's back rent and had me incur enormous legal fees to have a judge and settle. During this time of immense stress, I incurred multiple health issues due to the building's poor maintenance and plumbing. I had to go in on out-of-pocket expenses to bring in my own maintenance people and items in order to help mitigate their poor management and upkeep during COVID. They have violated a magnitude of tenant-landlord rights over the 3 years I have lived there.
