      I was purchasing a Tri Pointe home and was encouraged to use their lender to receive builder incentives. During the process, I negotiated $20K of builder credits to go toward closing costs, rate buy-downs and a washer and/or a washer and dryer. After discussions with the lender, I had approximately $3800 in builder credit remaining after closing costs were resolved. The lender said I could use those funds to buy-down the interest rate or it could be given to me as an agent credit. I checked with my agent (******) and she said that such a credit wouldn't be possible. I then told the lender to use the funds to buy-down points or speak to the agent to see if I misunderstood something. The lender spoke to ****** and assured me that I could receive those funds back as an agent ********* should be noted that ****** and I had an agreement that if I buy and sell with them I will get 0.5% for selling and 0.25% for buying. These funds are separate from anything I was working with Tri Pointe Connect. After multiple conversations with the lender, I was told I would get the funds back after closing so I had no reason to question it before signing closing documents. I asked about the money multiple times, and each time I was assured by the lender I would get the money "left on the table" back after closing. It was only later when I asked about these funds that I was told I wasn't going to be receiving them. Tri Pointe Connect blatantly mislead me, lied and profited off of my misunderstanding of real estate.
