Wanted to cancel the order when I purchased the bike, they said I couldnt unless I wanted to be charged half the price for the bike so I unfortunately had to keep my order. I received my bike and it came in awful condition. It came scratched up, came with only one front brake pad instead of 2, the seat came with a tear in it, the chain came in broken, etc. I contacted them and nothing since, and now their company is shut down.Initial Complaint

Subject: Opening New Dispute ONYX Motor Bikes Dear Better Business Bureau,I am writing to open a new dispute concerning an unresolved charge for an electric moped and helmet I purchased on December 18, 2023. Critical issues regarding the delivery of the moped remain unaddressed.- **Purchase Date:** December 18, 2023 - Electric moped and helmet - Only the helmet.-Electric moped, which has not been delivered as of today, May 26 2024.I have made multiple attempts to contact the vendor directly all of which have gone unanswered except for a vague text on March 5 stating they faced challenges but would ship the moped. There has been no follow-up or delivery since that communication.Here is the history 1. **Page 1:** Initial order confirmation.2. **Page 2:** Record of the charges and the courtesy credit issued for the returned helmet.3. **Page 3:** Charge details as they appear on my account.4. **Pages 4-9:** ******** communications with the vendor requesting updates on my order.5. **Page 10:** Evidence that the vendors website became non-operational in April ******. **Page 11:** Recent articles indicating that the vendor may have ceased operations.**Concerns about Vendor's Tracking Information:**The vendor provided tracking information, suggesting fulfillment of the order. This is impossible as I have not received the moped. The tracking information likely pertains only to the helmet, not the moped. I urge my credit card company to verify the tracking details, specifically the weight of the shipped item, to confirm that it could not possibly include the moped.Given the evidence and the vendors recent closure, it is clear that the item will not be delivered. I bought a bike from ****. I knew ahead of time , that they build the bike per order and it takes a couple months before they ship it. I did all my research and looked at all the reviews online. Theyre legit. I paid for the bike in full. I purchased the bike on October 11, 2023. The bike still hasnt shipped yet, and I havent gotten any response. Their website doesnt even show up anymore. I even messaged them on Instagram about my order and still no response. Their phone numbers dont work. Ive been patient But 6 months and still no communication on shipping is ridiculous! November 28th 2023 I purchased an Onyx motorbike for around $5000 using affirm to make payments. I never received the bike and I'm trying to dispute it with ******. They want me to reach out to Onyx but their website is down, their phone number don't work, etc...I heard that the owner died in December and as of now they are out of business. Fraudulent Misrepresentation with Intent to Defraud. I placed an order and paid-in-full $4,649 on August 1, 2023 for an Onyx RCR bike. Before ordering, I asked about availability and delivery date. **** stated in writingETA is about 3-4 weeks currently most likely much sooner.. Well, that turned out to be a recklessly false statement, intentionally meant to induce me into making a purchase, which they knew they could not deliver on. One month later, I inquired about my bike delivery. ****, the same employee who stated "3-4 weeks", comes up with another lie. The verbatim text: on average builds right now can take 30 - 60 days. right now we're shipping out bikes to people that ordered early June. I'd estimate your bike will probably be ready sometime in Sept. Well, September came and went...and so did October. On Friday, November 17, 2023, I was sent an actual email stating the following, verbatim: "Hey, its **** from ONYX Motorbikes. RCR shipments are going out in waves, with the current estimated shipping dates below: July / August orders - start shipping in late Dec. / early Jan. **** a minute...I ordered on Aug 1st, you told me 3-4 weeks, and now you are telling me that the 3-4 WEEKS has turned into 5-6 MONTHS. I told them to cancel my order, and a "manager" named ***************** and told me that if I cancel, I have to pay a penalty fee of $2,500. Unacceptable. You cannot lie to a consumer, take their money, and expect to stay in business. Legal premise of "False Promise" negates the cancellation policy of ONYX Motorbikes. Why? 1) They intentionally made a promise which I reasonably relied upon to make the purchase. 2) Their promise was material to the sale. 3) They never intended to deliver the bike to me in 3-4 weeks. 4) They did not perform on their promise, harming the consumer. A company cannot generate operating revenue based on misrepresentation. Clearly, this scenario is their modus operandi, based on other ****** Reviews I am now reading.Initial Complaint

18th October 2023 amount $3188.99 I bought this ebike that they promise to ship on friday.They kept saying that the ebike was shipped and i waited 5 days until i call ***** monday the 23th and they told me that they never picked up any packages.After that the agent or owner for onyx motorbikes admitted that ***** never pick up the ebike and that i i have to open a dispute with *****. They use deceitful tactics. I was assured a ship time within a few weeks when I placed the order months ago. They still havent delivered and every time I reach out asking for an update they keep pushing out ETA by several weeks. I have the texts to prove it. I don't have all the exact dates on me at the moment. But I purchased and RCR electric motorbike from them. The issue was that since I recieved it, the battery would cut off when riding. Making the motorbike unsafe to use. I been contacting them about this issue, we did their routine diagnosis on the phone, which didn't help. I was even told the battery is fine, when in fact it's not. I'm so frustrated with this company because they aren't taking responsibility for this issue and actually coming up with a solution. It has caused a lot of stress especially when they are just running me around to do the same thing again. What makes it worse was that they told me the battery was fine and to test it out. I did that and the power would cut off in the middle of traffic almost causing and accident due to their neglect and defective product. I just want either an exchange or a repair. I paid for shipping so in my opinion due to this being their fault I want them to be responsible for the return and exchange process. This is unacceptable even other customers are experiencing this issue, yet they are still selling these motorbikes and using marketing to cover up this very issue. Please contact me asap, I want a solution to this soon. Thanks
