On April 14, 2023, Nexway, Victor Lezuitov and Casey Potenzone entered into permanent injunction for a complaint brought against them by the Department of Justice on behalf of the Federal Trade Commission. Case No. 1:23-cv-900.

According to the complaint, from around August 2016 the defendants facilitated merchant accounts to telemarketers who made misrepresentations to consumers about the performance and security of their computers. The Justice Department also alleged the defendants abated the sale of false technical support services and laundered credit card charges through their merchant’s account violating the FTC Act and the Telemarketing Sales Rule.

The Federal Trade Commission and The Justice Department will collect $650,000 in consumer compensation from corporate defendants Nexway and individual defendants Victor Lezuitov and Casey Potenzone. The payment of $650,000 will result in the suspension of the total monetary judgment of $49.5 million granted by the court.

On February 8th, 2024, the Federal Trade Commission announced they will be issuing consumers payments for more than $610,000 in refunds.
