I work for the U.S. ********** of ************ and I recieved a promotion and government orders I'm required to move from **********, ********** to *********, ************** to maintain my employment with DoD. However, I've sent Chamberlain Property Property Manager ****** my government orders and my Notice to Vacate and I can't get out of my lease based on my employment requirement to move. I've sent emails to the property manager and I've gotten slow response to none. In addition, I went to the office on this past week and nobody was in the office, however a lady was walking up to the door and I explained to her my situation then ****** from Chamberlain Property called and still said you're still contract obligated for the remaining of your lease for ******** and was very condescending and bushed me. It's a requirement of the U.S. ********** to ************ that I have to move in order to maintain my employment I can't stay in **********. I can't reach the manager of the business when I call and I'm recieving unfair treatment when I've provided her with official government orders stating I have to move.

************** leased the property in question for a year commencing 01/01/23 through 12/31/23. Subsequently, he decided to accept a promotion that required him to relocate. He is not active duty military with orders which would have required the owner to release him from his obligation.

When he gave his notice to vacate he continuously demanded to know how much the lease break would cost.  We explained to him what he was responsible for as a lease break and a final number couldn't be determined until we had a signed lease for a new occupancy as the cost would be determined by the date the lease for the new occupant took possession.  He refused to accept that answer so we told him if he must have a number to file his travel claim, the only number we could give is what the remaining term of the lease was. We suggested he provided them with that number and give them my contact information if they had any questions.

Subsequently, the property was re-let with a start date of 10/13/23. ************* has a balance owing of $3,073.99 after we applied his security deposit.

The property owner, as well as our firm, acted in accordance with the law.

I did have orders to move because I work for the ** ** ********** of ******** Also, I provided government documents that stated I'm  required to gainfully employed. I was given three different amounts for the cost to break the lease and I've had to seek legal counsel concerning this issue because the business owner doesn't understand perjury and I have to have accurate information to report it back to **** ********** of ******* concerning my permanent change of station (PCS).

The Servicemembers Civil Relief Act (SCRA) of 2003, 50 USC App 535, allows service members to terminate residential or business leases without penalty if they meet certain conditions:
The lease was signed before the service member entered active duty
The service member received orders for a permanent change of station (PCS) or deployment of at least 90 days while on active duty
The service member is an activated reservist or National Guardsman serving in federal active duty or under certain circumstances in state active duty
************** does not fall under the Servicemembers Civil Relief Act, since he is not active duty military, activated National Guards or reservist. If there is some other relief he is entitled to, please let me know what that statute is.
