      I bought a a carport from the auction and it was missing 3 parts. I had to get online to order the parts to make the carport even useable. Then the next week I bought a fan that doesnt work. I contacted the seller and they said they dont warrantee items under a certain dollar amount. I told them so I bought a fan that didnt work. They basically said yes. I asked for a refund and they refused.

      I had bought some items through this business Bakersfield Public Auction and everything I had bought was new, still in their boxes. So I decided to continue shopping and opted for a water dispenser, which by the way in the photo seemed to be new (false advertising) and even in the information it said that the price was $260 in the store, so I assumed that it must be new and I was the winner in the bidding 5/20/23. When I arrived to pick it up, it wasn't in the box and it was battered and dirty. I spoke to the person in charge and he told me that there was nothing they could do, that I had to take it like this. I took it home and it didn't work, I took it to the place where I had picked it up and they told me that they were going to test it for a few days and that they would call me later to let me know what was happening, so far I have not received a response and that was since June 2023. Since then I have tried to call the office and they never answer

      This is exactly what is wrong with people. Public Auction Bakersfield is an AUCTION house, we are not a retail store. We state that we sell used and new items. Customers have the ability to come in person to preview items prior to bidding so they know exactly what they are bidding on and if they cant make it in person we ask for them to email us a and we can inspect any item and send as many pictures to them as they would like of any item. This customer stated that all of their previous purchases were Brand new and in the original boxes which sounds great for an auction house and they only paid a fraction of the retail price. Then they bid on an item and won it for 50% of the **** and complained that it isn't brand new. They complained immediately to us and our staff inspected and tested the item for them and it functioned and worked how it is supposed to. We do not accept returns like a retail store becuase we are an auction. IF the item is in working conditon we will absolutely not return it. Its unfortunate that this customer feels like they were wronged by us but they have to understand the rules of the auction. They agreed to our terms and conditoons every week they placed a bid. We will not be refunding this customer's invoice. We have thousands of regular customers that understand and follow our rules that love us.

      To Whom It May Concern,

      On 3/17/2023 I went to Bakersfield Auction Bakersfield **** ******** *** to return an item that I had bid for at their auction. The item a car jack was missing the handle. No where on the description did it say that the arm was missing. I expected to get my credit card refunded but the employing said I would get a store credit. I have return items before that where either broken or missing parts and I have been refunded back to my credit card. I asked to speak with a Manager so I spoke with ***** ******* and when I had explain to him what the issue was and that he can check his customer system so he can see that I have return either broken or missing part items and received a refund he said he did not have to do anything. All I want is my refund back to my credit card. Bakersfield Auction took the item back and I can not find anywhere where it says that you will get store credit. Why say return the item if there is an issue but not refund your money. They should at least give you a copy of the pick up invoice to have for your records.

      We are an Auction not a retail store. I pulled this straight from our bidding site where ********* ***** registered and agreed to our terms. We clearly state in our description and terms & conditions:

      -PUBLIC AUCTION BAKERSFIELD sells both USED and NEW items. Bidders can Preview items @ *****.com or email us at *******@************************.com to get a better feel for the quality of the items prior to bidding. There will be an in person preview on   Friday, 11am-4pm.
      -PUBLIC AUCTION BAKERSFIELD is NOT responsible for dents, scratches, blemishes, discoloration, missing parts, missing hardware & accessories.
      -ALL Items that are over $25 that plug into the wall are guaranteed.
      -We do our best to put known issues in the title of the item, but it is ultimately the responsibility of the bidder to use preview times prior to the auction/bidding. While the items we sell are high quality, some may have wear and tear. There will be an in person preview on Friday, 11am-4pm.
      -* By placing a bid, bidder signifies that they have examined the items to their satisfaction, or that they have chosen not to personally examine them.

      Even though this item is an "As Is" item we still took the item back and gave her a store credit for the full amount that she paid for this item. Which our employee tried explaining to *********. We only guarantee items that are over $25 that plug into the wall. All other items are as is and cannot be returned. At times we will allow a customer to return an item that is "As Is" for a store credit, which is exactly what we did for this customer. This customer has received a store credit in the past as well and there wasn't an issue. Store credits never expire and can be used on any future invoices. Our terms are clearly stated, and they have to agree to them for every auction they register and bid in. We have thousands of people bid in our auctions every weekend that understand and follow our rules. We feel we respectfully dealt with this customer in a professional manner. You can get great deals on all sorts of items at our auction, and we even let you preview items prior to bidding in person and if you can't make it in, we ask customers to email us with any questions they may have on any of our items up for auction so that they know exactly what they are bidding on. It is unfortunate that she does not feel this way. She has participated in 41 of our auctions and we feel that we have always treated her respectfully.
