On June 29, 2021, Capstone Commercial Properties, Inc as Manager for Rock Ridge Apartments in Oro Valley AZ, entered into a contract with Bates Paving & Sealing, Inc. to "replace" the full drive areas of the property in the amount of $242,579. Forgoing disclosure of the frustration and many concerns brought to Bates attention during the removal and installation, the resulting workmanship and final product are beyond sub-par and not what we contracted for. Several conversations have occurred between Bates personnel and Mr. Bates and Capstone to find a resolution to this contractual breach of work quality. To date we have not received any action to resolve or negotiate cure options. The seam work, the major issue, is now allowing water intrusion into the "new" lot that will both create erosion and separation of the already obvious separation in the most crucial area of any parking lot, the center/water way. Capstone is looking to receive what we paid for in full, A NEW PARKING LOT with no patches or overlay corrections required by poor workmanship and a finished parking lot that is truly new. The contract has a 2-year warranty spelled out on all workmanship and materials. Being we have been trying to reach a resolution from time of installation, we must act on our behalf to action cure so workmanship done at installation is not surpassed by position of time and wear.
