    I was informed my condo leases to me by ********** was going to be placed on the market for sale and we agreed to end my lease 2 months early leaving me displaced and with unexpected unaffordable moving expenses as well as having to urgently find a new place to live. In good faith I also agreed to host viewings of the property by potential buyers and their agents which I did. The condo sold almost immediately and I take credit for providing well decorated welcoming home environment my own personal salesmanship and showing the condo and my overall cooperation with the entire situation. Upon move in I took photos and completed a move in inspection sheet. All issues were noted and the condo keys were returned with the condo in better condition than initially turned over to me. I fully expected my security deposit to be refunded in full. Upon receiving my refund I was disappointed and angered to see that nearly $200 was deducted for items that were either invalid or already noted on the move in inspection sheet. I notified ********** of my concerns and requested the balance of my deposit be refunded but instead of refunding me or communicating with me they have simply failed to communicate whatsoever. I very clearly visited each item individually in my communication. I still am adement that the balance of my deposit should be refunded and I will not stop making attempts to have that happen until the issue is remedied. That is my money and it is as good as stolen by a crooked and unprofessional business. I ask again that ********** refund the remaining balance of my security deposit which was withheld for property located at ***********************************************************************. Supporting documents available upon request. All are in possession of **********.

    I am a tenant at **************************************************** since 02/01/22. A property managed by Real Property Management. On 12/31/22 I logged into my tenant portal, submitted my rent payment, received my confimation ********** account ledger showed zero balance. On 01/05/23 I noticed my bank statement showed the money had not yet pulled from my account. I logged back into the tenant portal & my account ledger now showed rent as NSF & had an additional $375 in fees attached. I immediately contacted my **************** the mistake. My issue with Real Property Mngmt. is that I was never contacted & made aware that my payment didnt go thru? Instead they let my account rack up outrages fees. They removed my ability to submit the payment online & theyre office remained closed from ********************** charges mounted daily. When the office finally opened on 01/09/23, I made the 45min drive to theyre office & when I asked why I had not been contacted regarding the failed payment, I was told by the accounting department manager that she is the only person working in accounts & doesnt have the staff to contact tenants. Not a phone call. Not an email. Nothing. Needless to say I was left no choice but to pay what they care charging or move so I paid it. I have no problem paying an NSF charge but the late fees are simply not fair when your not made aware there is a problem & most definitely should not be allowed to continue to accrue on days the office is closed, no one is made available for the purpose of taking **************** are no other options for making payments.

    Unfortunately the tenant did have their payment be returned ***. Due to fair housing we can not waive fees for one tenant unless they are waived for all tenants. It was not a banking error or system error that caused the *** but rather the tenant not having funds in their account to cover the payment they initiated. Therefor the penalties that are outlined in the lease are still valid and will stand since rent was not received until the 9th. There is a $75 charge for the returned payment, $75 for the legal notice that was issued on 1/6 when payment was returned and a legal notice was generated in order to ensure compliance. Per the lease a late fee of 10% is assessed on the 5th and then $10 a day there after until payment is made in full which was made on 1/9 so there was $189.70 for late fees from 1/5-1/9. Total currently outstanding on the ledger is $264.70. 

     

    Had the payment not been returned *** then none of those fees would have posted however we have to comply with the terms of the lease which outline the penalties should payment be returned.
