    On 9/5/24 I entered into an agreement to sell my house with **** from this company. The agreement was that I would receive $640,000 cash offer for the sale of my home. Turns out they are not a cash offer buyer but instead a wholesale company that supposedly has a large network of investors. They dont have they either, they set up two showings for my house in 3 months but they were from people who saw the house on the *** not from the so called "network of investors". After the agreed upon close date came they tried to come back and renegotiate the agreement between us. When I refused to come down on our agreed upon price I was told they cant sell it for what they listed it for and so I asked for them to remove the listing from the *** and to send me written confirmation that our agreement was done. They never sent the confirmation but did remove the listing. Fast forward to a month later and I am talking to a realtor who informs me that Legacy put a memorandum out on my house prohibiting me from selling it with or to anyone but them. Lies and deceit from the onset of our talks is what it all turned out to be.

We partner with a network of investors to facilitate transactions and offer innovative solutions such as novation agreements, which allow for broader marketing, including the ***. This was explained during our discussions, and you were informed of our strategy to maximize the sale price.
    2.Showings and Marketing Efforts:
    We actively marketed your property, conducted multiple showings, and utilized various channels, including ***, to generate buyer interest. These efforts align with our commitment to selling properties efficiently and at the agreed price.
    3.Price Adjustment Discussion:
    When unforeseen market conditions and undisclosed repairs arose, we discussed potential adjustments in good faith to ensure the sale could proceed. This was an effort to reach a mutually beneficial resolution, not to renegotiate unfairly.
    4.Termination of Agreement and Memorandum:
    After discussions concluded, we promptly removed the *** listing as requested. Regarding the memorandum, this is a standard practice in the industry to protect our equitable interest in the property under the agreement. We regret any misunderstanding and would have been happy to explain this further at the time.

    1.  from the beginning it has been one lie after another.  **** sold this as a cash offer for $640K and the ***** told me that was not the case and that their cash offer would be considerably lower.  ***** told me that your company had a major network of investors which also turned out to be a lie.  

     

    2. you cant say you actively marketed and conducted multiple showings when there were only 2 showings scheduled and only 1 that happened due the fact I had a sick kiddo. If this is your definition of actively marketing then there is no wonder why you have to lie to clients to get them to sign on with you.  

    3. there were no unforeseen market conditions, there was you listing my house for almost 60K more than what you agreed to pay me so that you got your money,  when you failed you made it to where I was the one that would have to take the hit instead of you due to your failures.

    4. according to my conversations with several realtors and my attorneys, the memorandum is not standard practice in the industry but instead a method to bully the client to get what you want.  you had no skin in this game except maybe what you owed the joke of a real estate agent that after 3 months asked me not to throw her sign away when i asked for my home to be removed from the **** although she never put one in front of my house in the first place.  you dont regret anything except for the fact that you have been called out.  you knew exactly what a memorandum would do and you didnt care one bit about what it would do to me, only what it could do for you.

    1. Cash Offer and Investor Network: I can't bring myself to believe this, the sales agreement states 640K cash to me.  Are you willing to honor that?

    2. Marketing and Showings:  Is this why ***** tells me that I am the one that failed here?

    3. Pricing and Market Adjustments: All that I got from the conversation was that you had to make sure that you got yours no matter what my family got out of it.

    4. Memorandum Filing: If this was the case then I wouldn't have be told multiple times to "remove the bad review you gave and we will not cause any issues when the closing of the property takes place"

    ******** ***** signed a **ntract, via ***** *******, to buy my home as a cash buy to close on 10/1/2024.. After signing the **ntract, ***** said the ** would quickly bring several investors in to see the home to possibly partner with them or buy the home. They were also to do a walk through inspection. None of these things ever happened. A few weeks went by and I never heard from ***** so I reached out to him. He asked if he **uld put the property on the *** system and I said yes as long as it didnt disrupt my work from home. I asked him where the investor walk throughs went and about the walk through inspection and he said there were no investors at that time. He then asked to send someone over to take photos of the home for the *** system and someone came when we were out of town but I rearranged a time for that person to **me. Photos were taken and the home was listed. . I asked ***** again about their walk through inspection and was then told the photo taker was actually doing the inspection. She never asked about or to see the ***** hot water heater or do any roof inspection. I was later told the picture taker/inspection person was Bretts assistant. The date for our closing passed and I was then told they had the right to add 30 days to their **ntract. I told ***** I really needed to sell my home and asked him to please take it off the *** system. We texted and spoke on the phone and reached a **mpromise - he stated clearly hed cancel the **ntract and not extend it if two buyers that may be interested **uld **me see the property. Neither bought the property. I received a cancelation of **ntract from ***** to my email address and never heard from him again. I since called ***** invester buyer **mpanies and sold to one of them. I thought of ***** today and thought hed actually be happy Id sold so I reached out and told him. He then informs me his ** was placing an affidavit type lien on my property and that I **uld settle for $5000 to pay their expenses.

    This seller agreed to selling us her home which we had under contract. Seller decided to ghost us and breach contract which led to us filing a lien on the house to secure our interest. She was mad that she had to be held accountable for her actions and has since tried to go around our contract to sell to other potential buyers. Buyer beware.
