      I am filing a complaint against ABC Fitness Solutions and ******* ******* ***** ***** ****** for refusing to honor my right to cancel a gym membership in compliance with California Civil Code §1812.85.

      I signed a 12-month gym membership contract on February 15, 2025 with ******* ******* *****. Due to a change in financial circumstances, I submitted a written request to cancel the membership in early June 2025, and I offered to pay the maximum legally permitted early cancellation fee of $100, per California law.

      Despite this, I was repeatedly told by customer service representatives at ABC Fitness Solutions (who process cancellations for ******* *******) that I can only cancel if I (1) move more than 20 miles from the gym, (2) provide a doctor’s note for a medical condition, or (3) pay a $250 “buyout” fee — which is not permitted under state law.

      I spoke only via email and was not given the name of a specific representative. However, responses were sent from the ABC Fitness Customer Care team at **************************** 
      California Civil Code §1812.85 clearly states that health studio contracts must allow cancellation for any reason, and that early termination fees may not exceed $100, or $50 if more than half the contract has passed. Any terms to the contrary are void and unenforceable. ABC Fitness and ******* ******* ***** are ignoring this law and enforcing more restrictive and unlawful cancellation policies.

      I had an account with *** ******* which I canceled. I then received notice from ABC Fitness that they had opened a new account on the day that I canceled my *** ******* account, and they tried to charge my credit card for ~$100 without my permission. I have asked for proof that I signed up for this new account and ABC fitness will not send a copy of any signed agreement, as it does not exist. ABC Fitness is performing unauthorized transactions on my credit card. I believe this is fraud, as when I flagged it to them, they refused to cancel the transactions.

      In December 2024, I visited ***** ******* ******** ***** twice to cancel my membership in person. On both occasions, I was told the cancellation was being processed, but I was never given written confirmation. In early 2025, I moved to a different city and no longer have access to the facility.

      After relocating, I contacted ABC Fitness Solutions multiple times by email. I requested cancellation, a copy of my agreement, records of any gym usage after my visits, and written confirmation of account closure. Despite my clear attempts, they refused to cancel my account remotely and continued billing me without consent.

      To date, they have tried to charge me approximately $82.39. I believe this is an abusive billing practice, especially when a customer has followed the process and is no longer using the service. I also filed complaints with the **** and the ******* ******** *******.

      I am now requesting that ABC Fitness Solutions stop all billing and collection activity, permanently cancel the account, and provide written confirmation that no balance is owed.

      I went to cancel my membership with ABC Fitness on May 20th and I was then charged 6 separate times on two different accounts (3 times on each card). One of those 6 charges is valid and was used for my membership dues required by their contract to finish out my final month of membership. The other 5 charges were never part of any agreement or dues owed. I will be attaching my bank statement, and credit card statement of the two accounts which will show the amount of 26.99 being taken and posted from my accounts. After seeing these charges I reached out to the company for help with these issues and they refused to help with anything related to money. They continued to address that my account was cancelled effective June 20th, which is accurate. However, they continued to avoid the subject of these fraudulent charges. I am seeking that those 5 charges be reversed with no further action beyond that. I can also provide email transcripts if necessary of there responses and will gladly provide membership agreements, or anything else to help aid this unnecessary process along.

      Sadly, this gym is very poorly managed, a bunch of thieves, or both. There have been some hiccups here and there but the PT I worked with was great, so I ignored them. But, now that I’m moving and need to cancel, the gym is showing its true colors once again.

      I emailed ABC to cancel and was told to go in person. I get there (****** ********* **********) and what do you know, ******* gives me a card saying to email ABC. Now, they are trying to keep my account open claiming there’s a pending charge of $199. A rep admitted it was a system error that happens sometimes as the $199 showed up as paid right underneath the error message, as it does on my credit card statement. Frankly, it’s a charge that I wouldn’t even have noticed.

      I was sick and dragged myself to the gym to get this taken care of, only to get all this double-speak and “well, can you come back?” No, I can’t keep coming back at your leisure to do something as simple as cancel. I have done everything I need to cancel, and this is cancelled. I do not authorize any charges past May (and the 30 day notice requirement, which extends it to June).

      I have informed my credit card company that any future charges are unauthorized and deleted the card from my account. If you have any other charges you want, you can come ask politely.

      Without this issue, I would’ve left with a pleasant experience overall and recommended this gym, probably even re-joining at some point. Now, you’ve lost a customer for life and have another set of bad reviews (online and in-person) going around. I don’t see how this behavior protects your investment; businesses don’t last long acting like this.

      I signed up for ****** **** ** but never used the gym — not even once. I requested cancellation, but was told I’d be charged $156.72 due to a 30-day notice policy I was never clearly informed of. They did attempt to reach me via voicemails and calls, and I appreciate that effort. However, when I finally got through to customer support, I was told there was nothing they could do, no flexibility, no consideration for the fact that I never used the facility.
      I understand policies exist, but charging the full amount for a service I never used. Especially after trying to cancel. Feels unreasonable. I’m requesting that this charge be waived or fairly reduced.

      Nature of Complaint: Unauthorized Charges and Misrepresentation of Services
      On or around April 2025, I registered two memberships with *** ******* under the following agreements:

      At the time of registration, I informed EOS staff that we would not be in town or using the facility until May 5, 2025. We did not access or use the gym prior to that date.

      On May 5, we attended an introductory session with a staff member, ****, and discovered that the membership features — especially the personal training benefits — were not as originally explained. We were under the impression that some of these features were ongoing, when in fact they were one-time only. Given that we are not interested in personal training, that the gym was overly busy during our available hours, and that our work schedules would limit our use, we immediately decided to cancel both memberships.

      On May 6, I personally visited the *** ******* branch to request cancellation. I was informed the manager was out of office for two days, but staff provided me with the manager’s email address. I sent a detailed email that same day (May 6) formally requesting cancellation of both agreements.

      Despite our prompt in-person and written cancellation request, *** charged my credit card approximately $175 on May 8, 2025. This charge was applied after I had already requested cancellation and without any usage of the facility prior to May 7.

      Resolution Requested:
      A full refund of the unauthorized charge (~$175) made on May 8, 2025.
      Immediate cancellation of both memberships (Agreement #********** and #**********).
      Written confirmation that no further charges will be made to my account.

      sign-up date (April 24, 2025). After this initial period, a 30-day verbal or written
      notice is required to cancel his membership, and he is responsible for any
      payments that fall within that timeframe. We received his written notice on May
      06, 2025, and his account was placed in a pending cancellation status with nothing
      further due. His account will be cancelled on June 07, 2025, and he will have
      access to the club until that time. At this time,
      we have not been authorized to refund any membership dues, but we have
      forwarded this request to the club as a courtesy for their review and
      consideration. If he has sufficient proof that his written or verbal
      cancellation request was previously received by ABC, please have him submit it
      so that we may backdate his cancellation.

      We are submitting this rebuttal in response to EOS’s reply to our initial complaint. We appreciate the opportunity to clarify our position and provide supporting documentation.

      1. Welcome Letters and Due Dates
      We have attached the welcome letters from EOS, which clearly state the due date for both memberships as May 8, 2025.


      2. Registration and Facility Access Timeline
      On April 24, 2025, we visited EOS solely to gather information.
      *** ****** informed us that the promotion was available only that day and encouraged us to register, assuring us that our membership and facility access would start on May 5, 2025.
      We were told that instructions and access badges would be provided on our first day, May 5, 2025.


      3. No Access Prior to Start Date
      We did not have access badges before May 5, 2025, and therefore could not visit or evaluate the facility, equipment, or usage levels.
      Our first visit to the facility was on May 5, 2025, 19:00 Hrs, when our access badges were created by EOS staff.


      4. Prompt Cancellation and Proof

      After our initial visit, we determined the facility would not meet our needs.
      On May 6, 2025, 08:30 Hrs, i returned to request cancellation. Since *** ****** was unavailable, we were instructed by the reception staff to send an email, which we did the same day.
      We have attached proof of the cancellation email sent on May 6, 2025, as well as the confirmation email received from EOS acknowledging our request.


      5. Lack of Cancellation Policy Disclosure
      During registration, we were not shown the cancellation policy—only the joining process was explained.

      Summary of Concerns:


      We were unable to evaluate the facility before our official start date due to lack of access.
      We requested cancellation immediately after our first visit.
      The cancellation policy was not disclosed to us at registration.
      We have attached documentation supporting our timely cancellation and EOS’s acknowledgment.
      We respectfully ask that BBB review our attached evidence and reconsider our case in light of this information.

      I’ve been paying for the gym membership for 2-3 years now. I haven’t changed my credit card information at all. My payments get deducted from my credit card every month biweekly. But recently these past two months since March, April and now May I’ve been getting emails saying I missed a payment. When I called the local gym, the staff members said to ignore the email. When I look at my bank statements it shows another $39.98 fee being deducted on top of my gym plan. I tried calling the billing department and they refused to answer my call. I sent an email and they answer stating they will refund my money. But my bank account shows deduction instead of a refund. I called my bank and informed them they are fraud because the gym wants to charge me for changing my card information which is not true. I ended up cancelling my gym membership but I’m still getting these missed payments emails.

      Company makes it near impossible to cancel memberships. I informed the fitness club affiliate I was canceling my membership, and they verbally acknowledged by notification to cancel but failed to inform me that I needed to call ABC Fitness Solutions. My credit card was continued to be billed for 7 months, until I finally blocked further charges through my credit card company at which point ABC Fitness Solutions began calling me. When I called them back, I was stymied by an automated account verification protocol for a very long time, until after multiple attempts at getting past the automated gateway system I finally made it to a live agent. The agent then proceeded to stall me and ask me a lot of questions about other possible services I might be receiving, and then ultimately told me I needed to send in a WRITTEN request to cancel which would initiate a 30 day waiting period before my gym membership would be canceled. When I asked point blank whether the agent was willing to cancel my membership over the phone she said no, at which point I hung up on her.

      Pursuant to the membership agreement *** ******** signed with ******, a 30-day verbal or written notice
      is required to cancel his membership, and he is responsible for any payments
      that fall within that timeframe. We received his verbal notice on May 05, 2025,
      and his account was placed in a pending cancellation status with $65.66
      remaining due. This amount represents his dues from April through May. Once
      this amount is paid, his account will be cancelled on June 28, 2025, and he
      will have access to the club until that time. If he has sufficient proof that
      his written or verbal cancellation request was previously received by ABC,
      please have him submit it so that we may backdate his cancellation.
