I needed a contractor to build a porch, patio, retainer wall, and install my windows. This company agreed to do the work telling me if I hurried and signed a contract and paid the initial down payment, they would be able to start within the first of the coming week. The initial contract was signed and my check was accepted/cashed on 11/18/2022. Since then, the contractor has told me on multiple occasions that he cannot work today as his staff didn't show up, he has also told me on multiple occasions that he is having equipment problems such as with his dump truck or business truck and will not need able to work. On sunny, dry days, this is the excuse I receive. He arrived on 11/12 and stated he thinks his worker who has been on my property has been stealing and insists we add a deadbolt to my door with poor craftsmanship. He then insists I pay him another $2000 as he states, "to keep the wheels rolling". I felt like I didn't have a choice and was afraid he would stop all work. Up to this point he has cut out my windows which I had framed already, he set them in the openings not sealing them as he went and allowing water to wet my framing multiple times. His worker has tried to put flashing on the windows at least 5 times which can be verified by my neighbor and left them half finished. The owner keeps saying he will be there fist thing on the next dry day but doesn't arrive or notify me he isn't coming. He last stated he has $400 invested into each of my windows which I provided and had framed before he arrived, he states its because of his labor costs and he had to pay workers $20/hr which they messed up and didn't complete the job, im not sure how this is my fault. He has shown me all of his permits and papers which I have pictures of but is now ignoring my calls, he currently has $5900 of my money and nothing has been completed over 2 months later. He has tried to modify the original contract stating I owe him money, I have not modified the contract.
