      The company did not finish the job at my house, after I paid them in full. The company has since gone out of business (allegedly). However the former owner now has a new business with the same phone number. He claims he was never paid. He is lying.

      On July *** I entered into a contract with Pease Landclearing and Tree Removal to replace my deck and retaining wall in the back yard. The cost of the job was written for $6025.03. On that day I wrote him a check for the deposit in the amount of $2875.00, which he cashed the following week. After that, I had to call several times inquiring as to when they were going to start the job. I started getting the runaround with them saying they had emergencies for other jobs. I finally told them I would cancel the job if they couldn't do it. They, Nannette the office manager, tried to tell me there would be a 15% cancelation fee. I told her they didn't have anything in the contract saying that and they can't charge me that fee. After that, she finally said they would come out the following week to take down the retaining wall, but would have to finish the job the next week since they had meetings with the City of ******** on Thursday and Friday. They did come out on July ***** They worked for about 4 hours until they broke the chain on the chainsaw. On Monday, ****** **** I texted asking when they were coming back. The owners wife said she would get back with me after she got ahold of her husband. She never did. I texted them later that day asking if she found out anything, but didn't get a response. A week later on August **** I got the following text: "Have not forgotten you still working on the schedule". That's the last I heard from them. At this point, all I want is a refund of my money. They can deduct for the approximate 4 hrs. of work they did, which the pricing is listed on the contract. No 15%, because there is nothing in the contract about a cancelation fee. All they did was remove about 3/5th of the retaining wall and haul it away and cut down the bushes in front of the deck. That's all they did.
