    Summershade Design & Consulting breached their contract by failing to perform promised services, deliberate misrepresentation of communications, and refusal to refund my deposit.On 02-14-24, I entered into a contract with Summershade Design & Consulting for a backyard porch and walkway. I paid an initial deposit of $2,041.88 with the understanding that work would begin at the end of July.The following serious issues have since occurred:**** work was performed on my project in July as scheduled.2. No communication from the company since the signing of the contract.2.On 10-24-24, I requested a full refund.3.The company provided a fabricated list of supposed communication attempts which I can prove to be false.4.Multiple promises to refund my deposit have been made but no refund has been issued.5.The company has engaged in deceptive practices by creating false documentation of attempted communications.This situation has been particularly concerning as the company not only failed to perform the contracted work but has also attempted to deceive me by creating false records of communication attempts. I can provide evidence disproving their claims of attempted contact.I have made reasonable attempts to resolve this situation directly with the company but have been met with dishonesty, continued promises of refund that remain unfulfilled, and will be filing a lawsuit for Breach of Contract.

    This contractor has been under contract for over a year to deliver & install my parent's pool. This company has done nothing but dig a hole in their yard, which they have left open & exposed for 3 months, then hand out delay, after delay, after delay, while still taking draws from their bank account. The owner of Summershade has been sending harassing texts threatening my parents with litigation due to the fact that my parents are trying to hire other contractors to get this work completed. Summershade has also contacted the distributer of the actual pool and has had the distributor interfere with my parent's ability to hire another contractor. I'm not surprised to come here to the BBB and see the other complaints as this company is completely unethical, unprofessional & crooked.

    I will be more than glad to send you a timeline of everything that was done for this project.  There have been no threatening text messages or phones calls of any kind and will be more than glad to forward the text to you. Only call from your parents yelling at me in the phone and calling me names.  We proceeded with the project when the house was closed on and financing was worked out. And just so there is no confusion, the hole was dug on April 24, 2024 and the pool arrived on June 14, *********************************************************************** the side yard.  There was approximately 21 days of rain from the time of dig to delivery.  They could of had their pool installed by now with water in it and awaiting inspections if we installed on June 14, 2024.  I have asked repeatedly why they are upset and want to cancel contract with no response.  We insisted on installing the pool on the 14th and plumbing and backfill, again your parents insisted that we leave it in the side yard.  We are awaiting final payment from work already performed and will cancel contract once that payment is received.

    I am rejecting this response because I have been privy to, & have read, all of the ill pointed messages directed to my parents. Unfounded delays, financial blunders & unprofessionalism have been unnecessarily imposed onto my parents since dealing with Summershade.  This is why the BBB exists; to expose frauds like *****.

    Your parents still owe a balance on their contract how is that fraud when they have received more than they paid for.  Again I sent a time line to your parents and I can send you the text messges. I will not be responding to you again you are not the customer and obviously dont know the whole situation.

    *Contract signed on 9/14/22. At contract signing a late Nov 2022 date was discussed for the shell delivery, since another neighbor was also installing a pool with this company. *9/30/22 - contacted owner about the delivery and received an email on 10/2/22 saying the pool order had been submitted to *******, however the delivery wouldnt be until late January 2023.*October 2022 - No delivery date was provided.*1/10/23 - email owner asking again for a delivery date. I was told they should know within a few days. No delivery date provided.*2/17/23 I reached out to the owner again about the delivery date and advised them that the ***** loan was expiring soon. 2/22/23, They finally gave me a dig date for 3/4/23, but still no delivery date for the shell. *3/4 & 3/5/23, The pool hole was dug.*4/1/23 - trench dug *4/18/2023 - No progress *5/19/2023 - I was advised by the owner additional pool items would be dropped off next week. Still waiting on the shell delivery date.*5/30/23 - No additional pool items were dropped off this week. *6/7/23 SS&D has advised once again, on 6/4, they cannot send the necessary items to ******* to schedule the pool delivery shell.*6/20/23 SS&D has confirmed a shell delivery date for 8/16-8/18 with a small chance of it coming earlier.*6/27/23 ******* called us to inform us the delivery date was not accurate.*6/28/23 - we have cancelled our contract due to breach of contract, as she can no longer supply ******* pools.*6/30/23 I requested a full refund, because the minimal work that was done will need to be redone per two pool builders that have reviewed the disaster zone. Both pool builders are hesitant to do the project, since it has already been started and consider it a liability risk. There is so much erosion from the hole sitting there for 4 months and it will continue to erode while we sit in line to have our project done. So yes, we need all of our money back to fix this mess. Ill keep you posted on our refund progress.

    Comments:  Still waiting on getting my full refund. A police report has been filed for fraudulent activity, as the company took our money knowing they would not be able to fulfill the contract.

    Signed a contract 7/22.. and wired 1/3 of the pool cost, $26,800. For 11 months all we heard about were delays and setbacks from the manufacturer. Come to find out our pool was never ordered because the pool contractor lost her ordering ability for not paying bills with the manufacturer. We asked for our money back, and she said the manufacture had our deposit which they do not.

    We moved and ***** stated we could move our contract to the new house and the pool would be installed 5/23 more delays and excuses continued

    I became suspicious and did some research. I was able to get in writing from ************************************* manufacture had our deposit which was untrueand our pool Was never ordered.

    To date we have not received a refund.
