      The customer brought his vehicle to our shop on October 31, 2022. The vehicle was not running upon arrival.  We diagnosed the vehicle and the customer authorized the recommended repairs.  The vehicle was picked up on November 7, 2022.  The customer brought the vehicle back to our shop a month later in early December.  Over **** miles had elapsed since the we had last seen the vehicle.  Upon arrival, the engine was running badly, and the coolant level was very low.  We diagnosed the vehicle and determined that the engine had again been operated with insufficient coolant, which in turn caused an overheat condition and engine damage.  We recommended that it would be wiser to not invest more in this vehicle due to it's age (**** model), mileage (over ****** miles) and the poor overall condition of the vehicle.

      The repairs done by our company in October were completed without issue as evidenced by the fact the the customer drove the vehicle over **** miles during the next month.  It is very unfortunate that the customer operated the vehicle in a manner that resulted in the damage identified at the December visit.  We are very sympathetic to the fact that the customer ended up with this damage after he made an $1131 investment in his vehicle.  However, there was no defect in the workmanship or materials provided by our company that caused the ensuing issue.  Furthermore it is an unreasonable and unrealistic expectation that we could have forecast this event.

      I am rejecting this response because:

      The merchants statement is not accurate. My understanding of the facts are as follows:

      1. The cars radiator was leaking.

      2. I drove the car to the merchant for repair.

      3. The merchant accepted the car for evaluation and repair.

      4. After having possession of the vehicle for one week, the lead mechanic indicated they had satisfactorily repaired the vehicle. During the week, I had multiple discussions with the lead mechanic about the issues and recommended repairs. Based on his evaluation of the issues and recommendations for work to resolve the cars problems, I approved the repairs.

      5. I received the vehicle once the lead mechanic indicated all issues were resolved and paid the amount due in full.

      6. Although it appeared the issue was resolved when I accepted the repaired vehicle, within 3 days I noticed the radiator fluid was still leaking.

      7. 4 days after taking possession of the repaired car, I brought the car back to the merchant to address the leaking of what I was told was a repaired radiator. I asked a female, I believe one of the owners, at the front desk if I should leave the vehicle with them to check their work and the leaking radiator for any issues that needed further repair. She indicated they were to busy to accept the vehicle for corrective action.

      8. After the owner rejected taking the vehicle for corrective action, I drove it to work and home. It then appeared the leak had stopped and I assumed the issue had resolved itself.

      9. I drove the car for two more weeks before the radiator began to spray on the new distributor that had replaced by the merchant. Once I recognized this issue, I assumed that the same exact problem that was originally repaired by the merchant was still present in the vehicle.

      10. The improperly repaired car was still operable, but not reliable. I was able to drive the car back to the merchant.

      11. The merchant again refused address the improper repair.

      12. The merchant indicated the vehicle was now inoperable and worth nothing but scrap.

      13. The merchant told to me to remove the vehicle with a towing service from their property, as soon as possible.

      14. Under the impression that car was inoperable, I called a wrecker service to remove the vehicle the following day.

      15. When I met the towing service at the merchants location I realized the vehicle was still operable, but due to the poor repair work by the merchant needed additional coolant added to the radiator.

      16. I refilled the vehicles radiator with coolant and drove what the merchant inoperable deemed an inoperable car back to my house.

      17. After retaining possession of the vehicle from the merchant a second time, I noticed the radiator overflow reservoir was full. I think this indicated the radiators problem was a circulation issue, most likely due to improper reinstallation of the radiator by the merchant.

      18. I know believe the reason the lead mechanic confirmed the radiator was functioning properly after working on the vehicle for a week, was the overflow was full of coolant, and the engine temperature gauge was giving a false reading due to improper installation and repair by the mechanic.

      19. I confirm the car is old and has high mileage, but the current damage was caused by improper repair by the lead mechanic and the owners unwillingness to accept the vehicle when I presented it for follow up repair.

      20. I asked the owner to work with me, but he was unwilling.
