I hired One Call Property Maintenance to complete the renovation of my downstairs bathroom and kitchen. The owner/operator, **** *****, requested 40% down to start the job of which I paid him. He would not provide a contract or detailed information to account for the $11,240 paid up front. Several unprofessional incidents occurred on the first day that caused damaged to the subject bathroom. In the meantime I had to purchase materials in addition to paying the 40% down that was to cover labor and materials. After 3 days on the job, Mr. ***** requested more money at which I refused to pay because he had not identified where the $11,2k had gone. To my knowledge he had purchased a bathtub, plumbing pipes, Sheetrock and backer board and labor the first week. He then demanded the remaining 60% to complete the job. Of which I refused again bc I had purchased most of the materials thus far and didn’t want to lose more money towards a job that wasn’t meeting my expectations and very unprofessional. Mr. ***** took his crew off the job leaving my kitchen and bathroom dysfunctional. I have lost money and experienced emotional and physical duress as a result of unprofessional actions, not providing receipts, and very little labor completed. I seek to be reimbursed for damages, and 80% return on the 40% down payment. Your help in this matter would be greatly appreciated.

    Message from business:

We went out and met with the client who then hired us and gave us an initial payment up front as is customary ,  to rip out the existing fiberglass shower unit in her bathroom because she couldn't get in-and-out of the tub and install a 4 piece shower unit with neutral tile in the floor and move the toilet into what was currently a closet. We were also going to refinish the cabinets in the kitchen and have new countertops put in as well as installing a tankless hot water heater.  What's we began the job and after making multiple trips to various locations to try and source the shower stall she had originally agreed to she then informed us she wanted to go back in with a tub in tile surround. She then proceeded to order custom tile which we then had to wait on to arrive and wanted to complain about why we weren't getting more done while we were waiting on these things to arrive. The entire time she tried to tell us we should be getting more done while not understanding that there is a order of process that has to take place And we couldn't get anything done without the material she had custom ordered there. She also didn't understand why we had to create so much dust in her home by  Sanding in the house while the cabinets were actually installed in the house so there was no other option. She also informed us she would be going out of town on a certain date and we had to have the work done by then so once that date came and we were not done which was only 3 days later we had planned to move on to other jobs and she then informed us that she lied about going out of town to try and hurry us up to get it done quicker. I have all of this and text between the client and myself to confirm as well.  She also changed the scope of work once more by adding some  Ship lap in the laundry room and no longer switching out to the tankless water heater. Since she had told us she was gonna be out of town out of town we arranged to be doing other jobs with the crew that we had working there and had already committed to be there so once she told us she was not going out of town she got upset that we couldn't be there to continue work. She also told me she didn't have any more money and couldn't afford to pay the weekly draw that she had agreed to for the work that was completed at which point I told her we wouldn't continue any further work until we knew she could afford to pay for it. She then sent me a text that she was going to contact an attorney at which point I told her we could no longer communicate and that everything would have to go through the attorneys. This client has repeatedly changed not only the scope of work but what she wanted done and then wanted us to change on the fly while we were already committed to be in there and she held us up on time and labor repeatedly because of changing the choices of material to things that were not readily available. We try to do everything in our power to accommodate this client but are not interested in following through with any further work as she has already cost us much unnecessary time and headache.

    Message from Consumer:
I am rejecting this response because:

One Man Property Maintenance caused undue damage to my bathrooms due to the unprofessional actions of one of his workers. This delayed any work because the floors had to dry and be treated. The guys knew of there was a leak and the waste coming from the damaged toilet upstairs and chose to ignore it. That is what caused the delay not me ordering custom tile.  Mr. ***** was determined to pick out the materials for my bathroom. I informed him that I would pick out the tile and he would lay it. The tile came in before they repaired the floors.

I made a decision not to go forward with the tankless hot water heater and installing the microwave in the cabinets because it was taking days just to get the demolition completed. I thought this would speed things up, but to no avail.

I made excuses as far as paying these guys more money because I wasn’t seeing the $11,247.50 thus far. Mr. ***** didn’t say anything about a weekly draw at our first meeting. I requested an estimate on paper and he said he didn’t do that. He finally sent one after he was paid in a text message. I had no intentions of paying this guys more money until I seen progress, which I wasn’t at this point.  They were very unprofessional and hardly put in 4 hours a day, which was very frustrating. I’ve had to hire another Construction company finish this renovation, of which they had to repair the tile in the shower because they literal started falling off the wall. The plumbing had to be repaired as well. The owner of the Company said there was no way these renovations would’ve cost 24k to complete.  Not only did I lose $11,247.50 but I had to pay another crew and purchase the material again to complete the job that I had already been paid to One Man Property.

I have also found out from the local hardware store in Arab, One Man Property has other complaints against them and they have removed their business cards

If Mr. ***** doesn’t pay the amount requested, my lawyer will be forced to file a lean against his property.

If you have any questions, please let me know.

    Sincerely,

    Jennifer Davenport
