I am reporting a trademark impersonation and fraud scheme operating under the name “Trademarks Counseling” and “Brandmark Advisors Inc.” The individuals involved contacted me unsolicited about my trademark application for EARLYREADERAI, claiming it had been abandoned and offering to “revive” it. They represented themselves as either a government organization or a law firm with “in-house attorneys,” and attempted to collect $800 in fabricated fees through an emailed invoice. The entity uses the website https://trademarkscounseling.com and the phone number (332) 258-8775, along with the email address [email protected] The person corresponding identified himself as Brian Wilson, alternately described as the “lead attorney,” “junior attorney,” and “head of the department,” but refused to provide a bar number or confirm state licensing. When pressed, he instead sent unrelated USPTO serial numbers to claim legitimacy. The invoice and email included official-sounding filings (“Petition to Revive,” “Office Action Submission,” “Petition to the Director of USPTO”) but bundled them together for a total of $800, far above the official $250 USPTO revival fee. They falsely claimed to operate as a “government organization with in-house attorneys” and stated that “the only cost you need to be concerned with is the federal revival fee,” clearly impersonating the USPTO.
