In 2020, we contracted Mr. ***** to build us a residential house. During the process, we agreed on a contract (*********************) to deliver to us a 3-bedroom residential house with a garage. But along the way, we discovered that Mr. ***** had fraudulently edited the building plan, removed the entrance door to the basement and attached a window instead. In addition, he refused to honor our contract to build the garage. The below is part of our conversations on many things we identified and required him to fix: "Good morning *****, Going by all our conversations before and after we moved into our home in September 2021. I have been sending you messages/calls regarding the incomplete works on our property, but the majority of it has not been completed up till now. As a reminder, here is a list that I have talked to you about before: 1. we discovered what you built for us was not the plan we gave you. several times I have called before we moved in to come to the house but most time you asked me to wait for a week or days before visiting the property. the only thing My husband and I agreed to change was the master bedroom toilet and closet. In the case of the exterior door for the basement, we spoke about the plan we gave you and you were ok with it. but the door wasn't there when you build it (which you never seek my opinion or talked to us about) His response: you gave us the Dream model to build, as per law we can not do the same layout which I had mentioned you and asked you to check what our drafter is drawing. You had the final text saying that you are okay with the house plan drawn by the drafter. We acknowledge that you made some changes on master bedroom and ensuite, but was not asked to make separate entrance at the time of drawing. The house permit was based on no separate entrance. If ever needed to build the legal basement suite you would need to make that separate entrance, we framed it in a way so it will be easy to do it in future. We were not building the legal basement suite. 2. Garage (as stated in the contract). His response: No, the garage or pad never comes with the house, its not in the permit. We had the discussion about this, witnessed by **** that we will do it once you make the payment. Its $8 per sqft. 3. The main entrance door was not replaced after completion of the house. His response: The main entrance door is not supposed to be replaced. We never use construction door. 4. Landscaping: We are not responsible for landscaping but will be passing you the credit from City of Saskatoon as per our conversation. 5. Openings/gaps between the cabinets and the wall, which allows water to get into the wall and damage it (the kitchen, the master bedroom washroom)- His response: will send countertop guys to fix it- warranty 6. The kid's room windows- whenever there is wind, it blows into the room and makes it cold for the kids to sleep in- His response: That is normal, there is an open field at the front. 7. Cracks/openings on the top surround in the kid's washroom wall- water enters and there is a dent on the wall- His response: We will glue that back in- warranty 8. There are crack sounds on the floor upstairs (which you said will be fixed today 2022-03-25-we are expecting you)- His response: Already Fixed 9. there should be a railing to the basement which has not been done His response: it will be done. 10. there is a gap between the wall and the stairs that go upstairs His response: It will be fixed - warranty 11. the kid's wardrobe fell off because it wasn't cocked properly(it's over 3 weeks now) which is dangerous for the kids- His response: The wardrobe door was damaged by someone by pulling it hard. Its broken not covered under warranty. 12. Cracks on the door corners-There is no crack, just a gap, that will be fixed by the exterior door company- warranty All these have been discussed, some was before we moved in which he assured us that it will be done and the others we were identified weeks after we moved in, and he have been promising to come fix them but nothing yet."
