    On dec 2022, I inquire about land use planning service Tulloch. On January 2023, I had a meeting with ***** ***** that his team can provide the viability analysis for the property In ******, *******. He provided just a drawing which not acceptable to me, no report of how viable the property for a subdivision. I have a prior subdivision draft plan but, has expired so I ask their service to help me start with the application for a subdivision. I was asking for a report but, they did not deliver as well as design of the subdivision based on my requirements. So, on Dec 30 2023, I cancelled the agreement and request for the return of the money to my company.

    TULLOCH entered into a contractual agreement with the complainant to provide well-defined and scoped land use planning services for lands this individual owns in *******. The complaint references deliverables and scopes of service that are not at all contained in our scope of mutually agreed contractual work. 

    After we expended significant effort with this Client, we have fulfilled the terms of our signed contract.

    The response of Tulloch was rejected because it says that the work has been completed. My response is definitely not completed.

    1. Planning due diligence - this was not done at all. Due diligence report is essential to land development plans, since it helps the stakeholder(s) to identify any issues earlier and make plans in advance. This task requires lots of work and the most important information to be used in planning. The reports include assessment of land use that will determine which applications are permitted on the property according to local laws. Also, if there are restrictions because knowing them on plnning and land use allow developers to ensire that the plans are aligned to the applicable zoning laws. The knowledge that will be gained from this due diligence will help decision making about layout, density and compliance with regulations.

    2. ************** was not based on due diligence. The first version of the design concept failed because lack of information regarding the dimensions of the lots, cost, requirements of the road, etc.

    3. Second version of the design was borrowed from the original design that lapsed. To make as if Tulloch design is by adding a unit to each building along church and schools streets. I won't consider this design concept because there was no pre-consultation meeting with the city of greater sudbury planning department for guidance.

    All in all, nothing was completed. My review is that Tulloch team has no skills to do this land use planning work but, they offer it to clients.

    In response to the complaintant, TULLOCH responds as follows:

    - Planning Due Diligence was certainly completed regarding the history of the property, past approvals/permissions, required zoning standards, planning policy, etc. It is routine for us to complete such due diligence and not prepare/provide a formal report of due diligence results. No written due diligence 'report' is required/offered in the scope of approved work (see Complaintant's own attached scope of work document), which again is typical of all our projects.

    - We did provide a summary of applications (and zoning relief's needed) to permit the various forms of development envisioned by the Client, both verbally and via email. Significant effort was expended in educating the Client as to the challenges and opportunities related to various development options for the lands.

    - Multiple concept designs we're prepared based on Client direction and intensive discussions. Confirmation of the intent of the concepts was obtained by the Client prior-to preparing such.

    - The "second concept" was based on the original design as per the client's (complaintants) written direction, direction of which was different than the first concept.

    - We asked the Client multiple times if we could proceed to preconsultation on the basis of such second design, but we did not receive Client instruction to do so.

    - TULLOCH has facilitated/completed hundreds of Planning applications and Due Diligence work programs of similar/same nature as this Clients. The work program did not diverge from normal, however the Client's unwillingness to listen to professional opinion and constant changing of direction made it exceedingly difficult to progress the file.

    1. A 'due diligence' report was not included in the scope of work as approved through the contract that the complaintant attached. We have completed hundreds of applications/due diligence processes, and unless it is specifically requested and agreed upon in scope/contract documents, a 'report' is not prepared. This is the norm in our practice.

    2. It is not a lie that we provided summary of applications/relief's needed to permit the various forms of development. While we will not post/attach private communications with a Client through BBB, it is absolutely not a lie.

    3. Again, a 'due diligence report' was neither agreed upon nor is it the norm of our work programs.

    4. For the complaintant to say "why do you have to ask me" to submit a preconsultation application is concerning. There are fees associated with preconsultation, and we do not submit such applications without express Client authorization. This is an ethical requirement of our profession and good professional practice.

    5. The first design was pursuant to Client direction & our professional recommendations. The second was also pursuant to Client direction.

    I had Tulloch do our survey. It tooks months for them to show up. At the end they didn't put stakes down. Said they couldn't. We are in a dispute with our neighbor who last Friday showed up saying she was friends with the owner of Tulloch. 3 days later they show up to do a survey for her. I told her we had a survey completed. And she said where are the stakes. She didn't believe us as there was no stakes. Now this has gotten litigious over the ideals of whether or not we have a survey because they didn't put any stakes down. I had issues with Tulloch when we did the survey with them over how many months it took to get them here. But his friend gets a survey within days. For not putting stakes up. Seems like it was planned or poor work ethic. Or a concerted effort to attack us. Why not put stakes up especially when your friend rushed out here to have you do? Then when they showed up. **** blocked our driveway entrance, then argued they were allowed. So if we had an emergency they said, we will move if that happens. So basically block our driveway to do a survey they rushed out for a friend because they didn't put stakes down. Then I told them we in litigious action over the property line and since she hassling me, I'm going to hassle her by demanding you only access her property line from her side of the property. And they know our property line as they did the survey already. The guy quotes legislation stating he legally can. I say show me. He says he can. Later. Why access a property you already know its borders for? Then when I tell him I'm putting a complaint in I said I could record it and he said I didn't give permission. I can legally record anyone that is the primary conversant according to the criminal code of Canada act. I only asked them one thing. Not to step on my property or block my driveway. Not to INTERNALIZE my dispute with our neighor. She gets to make my life a hassle, legally, so I get to do the exact same thing.
