    On November 22, 2024, at approximately 6:15 PM, Sudbury Parking Solutions immobilized my vehicle in the parking lot at REMOVED(REMOVED). When I parked, it was dark, foggy, and the lot was full. There was no visible signage indicating that parking was restricted or that any immobilization or fee policy applied.I left my car for only a few minutes and returned around 6:20 PM to find a boot already placed on my vehicle. I received no warning, and the fee was not disclosed to me prior to immobilization. Two people on-site told me I had to pay $160 immediately to have the boot removed. They refused to accept credit card which pressured me to pay using debit/Apple Pay while I was outside in cold conditions. I felt I had no choice but to pay under duress in order to retrieve my vehicle.The fee amount was only presented to me after the boot was already on my car, and there was no opportunity to dispute or question the charge. I believe this practice is unfair, predatory, and not properly disclosed to consumers.I am requesting:1) A review of this incident, and 2) A refund or partial refund of the $160 charge.I have also filed a complaint with the City of Greater Sudbury (311) regarding the lack of visible signage and enforcement practices at this location.Thank you.REMOVED

    Sudbury Parking Solutions is contracted to enforce parking privileges on private property. The complainant is mistaken on where she parked. The purple box is where the complainant parked and it is not marked on the map with a green P. The REMOVEDis where public parking is located. There are signs on the property that clearly state that it is Private Property and Hotel Parking. A refund will not be granted as the property clearly states it is Private Property and not Public Parking.

    I am rejecting this response because the business did not address the core issues of my complaint.

    The problem is not whether the lot was private. The issue is that the signage was not visible, not illuminated, and not reasonably discoverable at the time I parked. This incident occurred at night, during the Christmas parade when multiple roads were blocked, visibility was low, and the lot was full of cars and pedestrians. I parked only because normal access routes were closed by the City.

    The business has not provided any evidence that the signage was visible under these conditions. A daytime REMOVEDMaps screenshot does not reflect nighttime visibility, weather conditions, or the blocked-road event environment.

    Additionally:
    1) No warning or opportunity to leave was given before my vehicle was immobilized.
    2) The boot was applied within approximately 10 minutes.
    3) The fee was not disclosed until after immobilization.
    4) I was pressured to pay immediately in freezing weather.
    5) Credit card payment was refused, and I was forced to pay via debit/Apple Pay.

    None of these concerns were addressed by the business. For these reasons, I do not accept their response.

    This will be our last communication regarding this complain. Your complaint that the signage was not visible is not justified. As you can see by the picture provided, the signs are huge and clear. They are illuminated, so your claim they are not illuminated is false. As a licensed driver in REMOVEDit is your responsibility to be aware of your surrounding while driving and parking of your vehicle. The warnings you are asking for are the signage on the property. Again, see attached picture. As soon as you leave the property and do not pay and display the proper parking tag you are subject to a boot. The fee for boot removal is on the sign. The sign is clear that you must pay the fee before removal. You agreed to this when you parked your vehicle on the property. Again, it is your responsibility to completely read the signage on the property. We do not accept cc payments as we've had to many charge backs and takes us weeks to months to reverse the charge back. By law, we do not have to accept credit cards. In conclusion, you did not pay and display a parking pass, the signage on the property is clear therefore we will not be refunding the $160 removal fee.

    On Saturday November 22, 2025 at approximatelt 4:50 *M I parked at the corner lot of REMOVEDand Larch as shown on the photo I attached where the * is for Parking. The map is the map of the Santa Claus *arade and a bunch of spaces where you can park at. I was parked in the Larch/REMOVED. My family was trying to enjoy the Santa Claus *arade for the first time. We followed the city issue map rules for parking. We come back to our car between 6:30 *M and 7:00 *M to a boot on our car. An old man walks behind our car with a debit machine and tells us we cant park here, I told him the map says we can, he told us take it up with the city its $160 right now to take the boot off or the boot stays on and my car doesnt move. I had my 4 year old autistic daughter with me. I took money out of my rent to pay the $160 so I could get my daughter home. I didnt break any rules. The guy didnt listen to anything I had to say. And I want my money back. The city told us we could park there.

    Sudbury Parking Solutions is contracted to enforce parking privileges on Private Property.  The signs on the property are clear that it is private property and for hotel parking. The complainant is mistaken on where she parked. The green P on her map is the underground parking lot at REMOVEDmarked by blue circle. Where the complainant parked is Private Property marked by the purple box on the map. The complainant mistakenly parked on private property however the signs are clear on the property therefore no refund will be given.

    I am rejecting this response because: 

     

    Myself and approximately ten other civilians parked in the parking lot shown on the map because the map clearly indicates that this location has free parking. There is no signage whatsoever in the lot, and even if we had wanted to pay, there is no machine, meter, or kiosk available to do so. Other lots had signage saying parking $$$, or no public parking and was blocked off. But not this lot. This lot was wide open, free to park wherever.

     

    The lot referenced by the respondent is an underground garage used by police and city employees. It is not public parking, and if it somehow is, there is absolutely nothing posted to indicate that. All of us parked in the Larch/REMOVEDexactly as shown on the event map. This was not an error on our part.

     

    Additionally, this company employs individuals with concerning criminal histories, and these employees are then sent to confront families including minor children late at night. This is completely unacceptable.

     

    Furthermore, the company is fully aware that the public was downtown to attend the REMOVEDIs the company so desperate for revenue that it needs to prey on families at a Christmas event approaching them in the dark, on a winter night, touching property that isnt theirs, damaging the studs on my brand-new studded tires, and demanding $160 on the spot? My family, including our 4-year-old child, was effectively held hostage while being pressured to pay immediately or we abandon our vehicle. This is absurd. 

     

    The employee stated to me that night that the reason they booted us because if people from the hotel wanted to park there they couldnt. But this is contradictory to what the company did, because the company put a boot on the tire, immobilizing the vehicle. If space was truly an issue, they should have towed the car to make room for other cars. But thats the problem, there was no other cars. 

     

    This conduct is predatory, unsafe, unprofessional, and entirely unjustifiable. The company should be lucky Im not sueing them for damage to my vehicle for their incompetence.

     

    I want my money back immediately.

    This will be our last communication regarding your complaint. Again, review the parking picture provided. You were not parked in the spot you think you were. The green P spots are city owned lots. Yes the green P you are referring to is the underground parking at REMOVED. We do not and cannot boot in city owned lots. If you think you were booted in a city lot then forward your complaint to REMOVEDservices or the Police. They will confirm the lot you parked in is a Private Lot. There are signs on the lot that you parked in that say this is a Private Lot. See attached pictures. It is your responsibility as a licensed driver in REMOVEDto be aware of your surroundings while driving and parking your vehicle. The signs are clear that you must pay at REMOVEDlobby. You may disagree with the practice of booting and the cost for removal however we have been booting since 2008 and the city and police have looked into the practice of booting and it is a legal remedy available to Private Lot owners. You did not pay and display a valid parking pass on your dashboard. You were not a guest at the hotel therefore you were subject to a boot. We will not be refunding you the $160 fee for removal.

    On Oct 9th 2024 my vehicle was wrongfully booted and i was ticketed $160 to have it removed on private property in the Shoppers Drug Mart parking lot. I was not only a patron of Shoppers (reciept to prove it, i was also attending a dentist appointment (first appointment of the day). My dentist has paid parking spots in this lot. I apparently parked in the spot beside the one i was supposed to park in. Sudbury Parking Solutions watched this happen and let it happen while there was vacancy in the designated spots for my dentist literally right beside me (first appointment of the day and i was early!) i have pictures i can provide as well. Its a huge parking lot with spots designated for REMOVEDas well as Sudbury REMOVED(and two undesignated spots conveniently located right between the two, one of which i parked in). As far as i am concerned this is a setup. They get alot of people that think they are following thier rules. The guy even watched me and didnt say a word. I appealed to the only option on the ticket, thier email address REMOVEDon Oct 9th 2024, as well as a followup a week later and have not even been acknowledged. I have since sent a new email, no big surprise.. no response! I have called asking for the owner several times and been to the store asking for the owner who is apparently not there. I have left several messages with cashier and manager, "Dallas" at the store to have him call me back but no call backs. It obvious they use ghosting techniques to discourage appeals from thier shady buisness practice. I can provide copy of my Shoppers reciept, my fine and dentist reciept if required.
