    We hired a contractor to replace a retaining wall and he asked for 50% of the agreed amount of ********* which was *********. On July 25. He was supposed to start Monday July 31 at 7:00am. He didnt show. Then his next start date was supposed to august 14 again no show. In September we told him it kinda late to start this year as we didnt want him to stop half way because of winter. He was pushing to do one wall. We think its because he spent our money. We asked him to return our deposit and well reschedule in the spring. He told us the most h*** give us is ******. And now he will not return our calls txts or emails.

    As discussed, I am retained as lawyer for Century Developments. We maintain the position that there is no merit to the customers complaints. I have had ongoing communications with ******* about this matter. The fact remains that at all material times, my client was ready, willing and able to commence the job on time. Due to delays caused by the customer, including but not limited to failure to obtain the proper permits, the work was not able to be done, as scheduled.  My client lost significant revenue and incurred numerous expenses (i.e  wages for workers hired and materials and rental of equipment).  Additionally, to accommodate *******, my client turned down other work. The contract was valued at over $80,0000.  My client has made significant effort to resolve this matter.

          Myself and *************************** (co owner) of the property and project site located at *************************************************. Disagree with the response from ********************* (lawyer) for **************** owner of Century Development. Her response is a stretch of the truth  that she had ongoing  communication with myself.  
             ******* and I had one conversation with her on Wednesday October 4 9:30 am. After that one conversation she was to be in contact with us the following Tuesday October 10. She went AWOL. Wouldnt respond to Emails or phone calls.
             The following Tuesday **** called her office and got her personal cell number from a co-worker and txted her. (See txt document. And asked her if she was still retained by **** and came back with a simple answer. 

                Another stretch to her response is that we were  the reason for delays in fact the delays are *********. And we can easily prove that. (Can she ?)
               She also claims **** has expenses on rentals. Nothing was ever on site and we have 8 rental units that can confirm that. (Can she produce invoices of such rentals)  She also claimed **** had employee expenses in fact no one has ever been on site. 
               The proper permit she referring to is because the city wouldnt pass his proud concrete retaining wall that he wanted to do without an engineered plan. So we hired an engineer and he still wouldnt pass his wall. 
                Other delays were **** saying he had to finish other jobs. We have multiple txt messages to our tenants, multiple times telling them that  he was about to start and no show. Again.  
             He was postponing us to finish his other jobs. Her claim that He lost  revenue is not accurate 
       In short hes a scammer and He took almost ******. Dollars and he did nothing. 
    The worst part is that hes using the money he stole from us to pay her do drag this  farce for three years because thats what it take for a civil suit. Its a joke.

    Good Afternoon, 

    I communicated with the customer several times back in October.  The customer is not *********** a full refund of the deposit and I explained our position to her but it was clear that there was no interest in resolving this matter. The communication stopped once they took the route of filing a complaint as it posed further barriers to settlement. My client is open to reengaging in good faith settlement discussions should the customer which to do so.
