My fiance and I were looking for catering for our wedding on October 1st and found **** (the owner), we had a couple of calls about the menu and pricing and on April 19th during our call he said that all that was left to book him for the day was the 40% deposit which he said "if anything happens and you need to cancel, no worries we'll figure it out, unless it's the week before or something" so we did, no contract was signed. Less than a month later on May 16th I informed **** that we would need to cancel and inquired about a refund on the deposit as the event was still almost 5 months away. On May 19th I spoke with **** on the phone and he claimed refunding the deposit was difficult as he had already fully paid his staff for the day and that he has already had to turn down 2 other events for that day because we booked him. I asked if the payment he made to his staff could be applied to a different day/event or since he had already gotten 2 other inquiries for October 1st if he could just use them for a different event when it gets booked, which he said would be difficult and that he would call me after the long weekend with a quote for how much of the deposit he could refund. I then received absolutely no form of contact from **** for over a month until my mom was able to get a hold of him over the phone and ask him to call me. On July 11th (nearly 2 months after **** said he would contact me) we spoke on the phone where he told me he would only be able to refund $1000.00 of my $3132.36 to cover paying his staff and his own "personal compensation". I told him this amount was unacceptable, if he had told us at the time of asking for our deposit that over 2/3 of it would be unrefundable we never would have booked that quickly. After some discussion **** said he would call me the next day with a modified number, which he did not, I again did not receive any contact for 3 days when he told me he would email me, he has not responded to any of my communications since.
