I hired Artium under a contract that clearly stated they were responsible for securing the necessary permits. Their ******* assured me permits had been obtained. This was false. No permits were secured. As a result, I was forced to pay the Municipality of Mississippi ***** out of pocket to fix the issue, and I have not been ************* addition to the permit violation, the quality of workmanship was questionable throughout the project. I have spent significant time dealing with inspections, paperwork, and follow-ups, all of which were avoidable had Artium fulfilled their obligations. When I requested a refund, Artium offered $5,000 but required me to sign a full and final release waiving all future rights to pursue claims related to this matter. This is unreasonable, as the refund is already owed to me under the contract and consumer protection laws. The requirement to sign away future rights in exchange for money already due is coercive and unacceptable.

    Hello *** ********,

I'm sorry to hear you had a poor experience with the company in the ********* timeframe and the damages you requested in 2024 have not been paid. I acquired this company in May 2025 and was not privy to all the details surrounding this unfortunate situation.  After a brief discussion with the previous owner, he is very keen to resolve this situation with you as soon as possible.

As a small business owner I pride myself in doing the right thing for my team and my customers (past or present).  To discuss your situation further, I'd welcome you to call me at the office.

    Best regards,
    Kaylie (new owner)

    Good morning,

This complaint involves the former owner of this company dating back to 2021.  I acquired the company in May 2025.  As they are currently working through the details amongst themselves (and through lawyers) - how do you suggest I give enough information to satisfy the BBB, and our ratings while ensuring the individual filing the complaint feels we are putting our best foot forward.

    Any advice is appreciated.

    Thanks,

    ****** (new owner)

I am rejecting this response because:

While I understand that ownership of Artium has recently changed hands, my complaint concerns obligations of the company itself, which remain regardless of ownership.

To be clear, I am seeking a refund of $5,000, which was previously acknowledged but never paid as a reimbursement of out-of-pocket permit-related costs I paid directly to the Municipality of **********************, which resulted from Artiums failure to secure the required permits.

I am not willing to resolve this complaint through an offline phone call. For transparency, Id prefer all communications remain in writing and on record through the BBB process.

I will consider this matter resolved once I receive written confirmation of the payment amount and a firm timeline for when the refund and reimbursement will be issued.

    Sincerely,

    ***** ********

What where the conditions of the sale? The purchase agreement specifically referenced this job/customer/address as a known liability and the former owner of the company held the liability to resolve this matter.  I have inherited the bad press, but fortunately I have not inherited the liability.  I've had a discussion with the individual who filed the complaint yesterday and let him know I'm working with the former owner of the company to ensure he is paid what he is rightfully owed.  The former owner of the company intends to pay this.  At the moment I'm the intermediary and I hope this will be resolved by the end of the week.

I am rejecting this response because:

I understand that you have an arrangement with the previous owner, but to be clear, my contract and payments were made to Artium, not to an individual. From a customers standpoint, my agreement, invoices, and obligations all sit with the company itself.

More so, while I appreciate that youre coordinating with the former owner, internal arrangements between you and him dont change Artiums responsibility to the customer. The company continues to operate under the same name, branding, and reputation, and therefore the liability remains with Artium.

I'm encouraged we are working toward a resolution, and Ill consider this matter closed once Ive received the refund and reimbursement owed. Until then, my complaint remains active.

    Sincerely,

In addition to the $6K previously given from ARTium and Just Basements on this matter, we are offering $6,500 and will provide it by cheque (pickup or delivery, if preferred.)

    Who is **** ****?

    Customer Answer

    Date: 19/10/2025

    Complaint: 23930793

I am rejecting this response because:

The $6,000 referenced was not paid in connection with this matter. Those funds were tied to unrelated warranty issues and incomplete work that Artium had previously failed to address. They were not compensation for the permit and licensing violations that led to this complaint.

Regarding the current offer of $6,500, its important to note that $5,000 of that amount represents direct out-of-pocket costs I incurred because Artium failed to obtain the required permits. These were payments I was forced to make to the Municipality of Mississippi ***** to bring the work into compliance. The remaining $1,500 does not reasonably reflect the cost to correct other deficiencies, nor the time and effort spent addressing this situation.

Despite this, Ive been more than fair and patient in seeking resolution. My position remains that I should be fully reimbursed for the $5,000 already spent to rectify Artiums permitting failures, reasonably compensated for the deficiencies I outlined in my email to the current owner, and for the time Ive spent addressing this issue, or have those deficiencies properly addressed at Artiums expense.

If the company wishes to make a legitimate offer that addresses the above in full, Im willing to review it. Until then, I do not consider this complaint resolved.

    Sincerely,

    Good Morning,

The complaint filed with the BBB documents that the disputed amount is $5,000 due to a municipal fine.  The desired settlement specified through the BBB was a refund.

To give you some time to coordinate, the offer to pick up a cheque at ARTium Design Build office located at ************************* stands until November 7th (two-weeks).  In consideration for the payment, a signed release will be required.

As the new owner, I'm focused on building the company into something better than it was before - moving forward with integrity and professionalism. While I need to be able to move on, I still want to treat past customers with the same fairness and respect I show new ones, and thats why my offer of $6,500 is more than the refund originally asked for.

Please let me know when you'd like to collect the cheque.

    Best regards,
    Kaylie
