On November 9th, I entered into a written agreement with Clayton T. owner and operator of First Call Plumbing and Drain Services to finish renovating 2 bathrooms in my condo. The scope of work included: Guest bathroom: - Installation new 36" vanity (installed vanity, did not caulk/seal vanity) - Installation new sink faucet (complete) Ensuite bathroom: - Demolition of the existing tiled floor (complete) - Install new tiled tub surround, including a niche cubby - board/ waterproof tub surround - Replace the bathtub drain/plug to match the showerhead fixtures in brushed nickel - Install new shower faucet set - Installation of new tiled floor - Installation of new 36" vanity - Installation of new toilet - drywall repair work as needed - prime/paint - baseboards The total job was agreed for $8,575, I had paid him a total of $7,000. We had an agreed upon payment schedule, however, he asked for additional money to be paid up front which we agreed to in good faith. I noted above, what he has completed, and the rest remains outstanding. He told me his sub contractors i.e. tilers bailed on him and he could not find a suitable tiler to finish the tiling work. At this point he refused to give us any money back and insisted on us giving him another 3-4k$ to get the job done ****** *********. He also implied there were extra charges due to 'unforeseen circumstances' which is false, none of the work conducted was outside of the original scope of work. We reiterated that he needs to refund us $4,425 ($1575 outstanding, work outstanding is 6000). Cost breakdown of $6000 is $3,000 for waterproofing and tiling, $2,000 plumbing, $1,000 for misc including prime paint and baseboards. I tried emailing him twice outlining what he's doing is in violation of the Consumer Protection Act and he cannot just keep our money or ask us for additional money and he needs to refund us and he ignored my last email and will not respond anymore. thank you *****
