I hired POM Contracting to install a driveway on a steep gradient. They assured me of their expertise, claimed to own a 20-ton excavator, and promised to complete the project in three days for just over $20,000. Their performance fell far short of these assurances.

Despite their promised timeline, the project stretched over several months. Their equipment was left abandoned on-site for weeks even months, preventing me from hiring others.

The driveway was crooked, uneven, and improperly installed. Many corrections and obvious direction reiterated. Was even started in the wrong place despite meeting on site and marking it together, 4 times.

They claimed only $300 of surface material required after their work. the driveway was completely unusable without thousands of dollars in material to change the angle, add surge, and then crushed stone, and then thousands in top surface. POM mislead me. No equipment or vehicles were able to use this drive.

promised 20-ton excavator never appeared. Instead, small, inadequate machinery used.

Communication was hostile, with derogatory language and insults directed at me. They even claimed they were doing me a “favor” as I needed to hire someone, yet failed to deliver on their promises.

I paid over $20,000 to POM Contracting, then spent an additional $20,000+ to correct their mistakes. This caused significant project delays and stress.

I have repeatedly requested a partial refund of $10,000 to offset the additional expenses caused by their incompetence, but they refuse to take responsibility.

I have substantial documentation, including The contract, Email and text communications, Photos and videos of their work, Notes detailing their behaviour, Witness statements and expert opinions.

I request the BBB’s help to:
    1. Prompt POM Contracting to provide the $10,000 refund.
    2. Hold them accountable for unprofessional conduct and misrepresentation.

I hope to resolve this without ***** *******

    Business Response

Thank you for bringing your concerns to our attention. We value feedback from our clients, and we are committed to resolving any issues fairly and professionally. We understand that you are frustrated with aspects of the project, and we want to clarify the situation from our perspective.

Timeline and Equipment: We acknowledge that the timeline extended beyond what was initially anticipated. However, the challenging terrain of your property, including the steep gradient, contributed to the delays. As discussed during the planning phase, rockbreaking was an additional cost that was necessary to achieve a stable foundation for the driveway. You made the decision to halt the rockbreaking, which impacted the overall result.
Regarding the equipment, the machinery used on your site was appropriate for the scope of work and the conditions. In fact, we brought two rock breakers on site to reduce your costs and extending the timeline further.

Quality of Work: We strive to provide high-quality services and, to that end, we regret that the finished product did not meet your expectations. We discussed with you that additional surface materials would be required to properly complete the driveway, which you agreed would be better left to the end of your project. As a result we reduced your finally invoice to reflect this. In the end, the driveway was built to the agreed specifications including final culvert inspection and approval by the city.

Communication and Conduct: We sincerely apologize if our communication appeared hostile or unprofessional at any point. We always aim to maintain a respectful and professional relationship with our clients. If there were moments of misunderstanding or frustration, we regret that and will take it into account for future interactions.

Refund Request: The project was completed as per the terms of the contract, and we are confident that the work performed aligns with our agreements. After careful consideration, we do not believe a refund is warranted.

We are surprised that a complaint has been filed since our last communication resulted in the deletion of your initial complaint and a parting of amicable ways.

We truly wish you the best with your project.

    Sincerely,
    L******* *****

I am rejecting this response because:

Thousands upon thousands were spent to make their disaster, hack-job, too steep sloped, jagged, crooked disaster of what was supposed to be a passable driveway even remotely fit for a vehicle.

Quite logically, I am not okay with that. So, I will take steps now to address that.

What you left me with, vs what was promised, vs what was paid for, vs what you claimed to have left me with are are vastly different, awful, junk, inappropriate, unacceptable.

I tried demanding a partial refund, now BBB. Unfortunately, neither worked. It’s interesting that your response fails to mentions my attempts for financial help to fix your aweful job.
