    Dear Sir/Madame,

    In 2022 I paid to have the hill in my back yard cleared of all rocks and leveled in preparation
    for spreading a good layer of top soil I would then grass seed the following spring. (Ref. Inv#48
    -move some rock and shape up back yard)

    This work was completed in full and I was satisfied my yard was now ready for top soil spreading
    in the spring!

    In December of 2022 I paid a deposit of $400 to book a second job spreading 20 loads of top soil early in the spring (May 2nd) of 2023. (Ref. Inv#55 -regrade back yard for new lawn with top
    soil)

    Approximately May 12th of 2023 MAV brought an escavator to my property, but no top soil was
    delivered for spreading. The operator scratched around a bit on my hill, but spent most of their
    time on the phone or doing machine maintenance! The operator then parked the tractor at the top of my drive where it sat dripping hydrawlic fluid to close to my well until I requested it be
    moved further away! Mav then requested I make a second payment of $1,500 towards the completion of the job which I then did believing my top soil would soon be delivered and the rest of the work completed. The escavator then disappeared being moved to another job site.
    I have spent the rest of the summer requesting my job be completed so my grass seed will have time to establish itself before cold weather sets in and I have recieved only excuse after excuse. At one point during this wait one load of soil was delivered for inspection as I requested, but still no spreading took place and now this load still sits where it was dumped with a nice lawn growing on top of it that I wish was growing over my entire yard!!!

    On tuesday July 25th I had had enough and informed MAV I had decided to cancel the job and sense absolutly no work (spreading 20 loads of soil) had been completed to date, it was my opinion that none of the work outlined in the current job (Inv# 55 -spreading top soil) was completed. I should therefore be entitled to a full refund of all amounts paid toward the job plus interest. In addition, I informed MAV that any work they may claim was completed could only be considered as more surface prep work which I had already paid to have completed the previous summer in 2022 and so, should not have been required!

    In the end I gave MAV until August 4th to show up and finish the job and on August 5th, having
    not shown up, I informed them my cancelation of the job was now final, there would be no further
    discussion and that I expected a refund of $1,900 by wednesday August 9th or I would submit a
    complaint to the Better Business Bureau!

    Invoice 48 clearly shows that all work preparing my yard for topsoil was completed the previous summer and paid for in full.

    Invoice 55 shows that I paid an initial deposite of $400 in December of 22 and an additional amount of $1,500 in april of 23 believing the job of delivering and spreading 20 loads of topsoil was underway.  I was wrong, as no soil was delivered or spread.  The operator farted around doing tractor maintenance and dealing with text messages and phone calls, did some scratching around that was not required and certainly already paid for the previous summer.   Than the tractor as taken away and never returned all summer!
