    ADC posted a Certificate of Substantial Completion on June 21, 2022 stating that the construction was 90% complete. The Contract requires our clients to pay $180,000 to ADC when the project has progressed to 90%. Unfortunately, the Bank appraisal comes required to release funds only certifies completion at 79%.Given that attic insulation and pool house roofing, which should have been completed prior to the previous draw, have yet to be completed, this is no surprise. In addition there remains, stucco, siding, masonry, that should have been completed under the previous draw and with respect to the current draw, the cabinets are not yet installed.We understand that when our clients informed you of the bank appraisal and that you had not achieved the required 90% completion under the contract you purported to lock them out of their home, demanded their key, called off all the trades and left the jobsite and changed the locks, effectively repudiating the contract. Further, given that you have not yet performed substantial portions of the work to achieve the 75% progress draw and that you have already been paid 75% of the contract price, and given that you have only achieved 79% completion, when one takes into account the above noted infractions, you have been paid in full for all work performed under the contract.
