What Happened:I rented a skid steer from 88FARM LTD (88BOD) from July 30Aug 4, 2025.The first machine was delivered in good running condition with 80 hours, according to their representative, ******, but had a missing engine bolt at delivery (confirmed by ******).I used it for 1.5 days before it stopped running completely on July 30.I reported it immediately; company agreed to replace it.On Aug 3, ****** delivered the second machine. Before removal, ****** tried to start Machine 1 it ran for a few seconds then stopped. Machine 2 had to push Machine 1 onto the truck, proving it was non-operational. Machine 2 itself failed after ~2 hours (battery not charging, cooling fan stopped). I only managed ~5 hours total before overheating.Despite an email promising I would be charged for only 2 days due to downtime, they accused me of 4870 hours of use on Machine 1, using three different and contradictory hour meter readings. My property is only ***** sq. ft., making such usage impossible. They are withholding $300 from my $502 deposit without valid cause.Resolution Sought:Full refund of my $502 deposit.Removal of false claims of excessive use or damage.Attachments:Complaint PDF with detailed timeline and ************** thread (July 28Aug 6, 2025).Photos (hour meter readings, missing bolt, unfinished project).

    Thank you for your response.
I respectfully disagree with your statements. The equipment was delivered with pre-existing
defects, and I have already provided evidence of this in my complaint. The companys own records
contain contradictory hour meter claims, which further undermine their position.
This matter is now formally filed with the BC ************************* (***) for a binding decision. I
will not engage in further debate here, as the Tribunal is the proper forum to resolve this dispute.
I maintain my claim for a full refund of $502, plus reimbursement of the *** filing fee and interest.

    Sincerely,

    ****** ***** ******

88bod has already provided its conclusion in the previous response, and no additional information will be submitted. As a next step, 88bod will either return a deposit of $200 to the consumer or comply with the applicable law regarding the refundable amount as determined by the BBB or any court.

I am rejecting this response because:

88FARM LTDs position has shifted multiple times. They initially claimed I used the machine for 4870 hours. Now they acknowledge my actual use was only 8.2 hours, but allege mechanical damage.
On delivery, I immediately reported a missing bolt, which ****** confirmed. On July 30, Machine 1 stopped running and sat idle until pickup. On August 3, ****** himself could not start it and used Machine 2 to push it onto the truck. The replacement (Machine 2) also failed after a few hours, showing poor maintenance rather than misuse.
Their damage allegations are not credible given these facts, and their deposit handling has been inconsistent (first they will refund me $200 then $300 withheld, now the entire $502 withheld).
I am asking the Tribunal for return of the full $502 deposit, reimbursement of my filing fee, and interest.

    Sincerely,

    ****** ***** ******
