Hi there: My name is ***** *****, and I bought a condo in the building I'm in the summer before last I've never missed a condo fee payment and I bought the condo "as is" where it required a lot of work. I bought it legally through a lawyer and real estate person, and still have all the paperwork.
Since I've been here, I was informed of some past "shady" financial practices regarding the reserve fund. The paperwork I was given when I was purchasing the condo, made it appear that everything was good, but since I've been here, I haven't received anything from the condo board as the minutes, or anything??? I was going to get involved myself, but I'm not well and seeing physicians.
The building has run to the ground to where it has bed bugs, rodents, and other nasty surprises, but the reason why I'm writing you this is because now I just received a letting in the mail, that I'm behind $2693.38, even though I've paid every month and have records!!! This is the first time I've heard this since I've been here, and the letter states I have until December 2 to pay in full, or it is sent to the Corporation Solicitor??? Like I said, this is the first I've heard of it, or anything about it???

I did some checking on this Management company, and the ****** ******** ****** gives them a 1 out of 5.
Now I have to go see a neurologist next month, and don't have anything near that amount. When all this shady business was told to me, I chose what I said very carefully as to not get sued for liable, but they don't even realize that by me buying the place, I did them a favor because it sat empty for 2 years, and there was about $,4000 worth of repairs I paid for myself.
I'm in real need of help, as I just received this letter November 25th.

Hi *********,
I think there is a bit of confusion on Mr. ****’s part about
the role we play as well as his situation.
First, Victorian Management Ltd is our name and we are a
condominium management company. Our role is to assist and take direction from
our clients about their condominium corporation.
Due to privacy restrictions I can not speak directly to you about
Mr. ****s situation but I can speak in general.
When a person purchases a condominium unit they are
purchasing it from the current owner, not the corporation itself, the board of
directors or the management company hired to help the board of directors. If
someone decides to purchase a condo “as is” that is their choice and their
lawyer should be informing them of those risks. It is the responsibility of the
purchaser to review the property and the documents which would include the
financial statements that are prepared by the third party accountant for the condominium
corporation and the reserve fund study/report which are prepared by a qualified
their party provided. It is often common for perspective purchasers to arrange
for an inspection much like what is done for a free standing home. Neither the
condominium corporation or the management company are responsible for
assumptions made by a purchaser who does not take steps to ensure what they are
purchasing and what they think they are purchasing are the same…particularly in
an “as is” sale. Related to this, Mr. ****s is mistaken that he did Victorian a
favor by purchasing a unit as we are not the seller. While I’m happy to hear
that he did some upgrades or repairs within his unit, that work was done to an
item that he owned and he reaps the benefit of his labor as the owner. This
does not help the management company or the condominium corporation in anyway.
Owners can request copies for board minutes as provided for
under the Condominium Property Act of Alberta. Unless they are requested by an
owner or the board of directors for the condominium corporation has instructed us
to provide them to owners it is not our place to do so.
In regards to arrears which appears to the reason for his
complaint. I’d like to clarify how arrears are handled and why they would reach
the level of a demand. Again, since Mr. ****s has the right of privacy I have
to speak in general terms. Condominium contributions are due and payable to the
condominium corporation - not the management company. The management company
collects these funds on the condominium corporation’s behalf but they are
placed into the condominium corporation’s account which in our case is owned by,
in the name of and fully in the benefit of the condominium corporation. When an
owner fails to pay on time a reminder is sent to the owner. If the arrears
continue despite the reminders eventually a letter is sent warning the owner
that a caveat will be placed on their title if they do not pay the arrears. If
the arrears continue to not be paid the caveat is filed, the owner is then
notified both by the management company and by Land Titles. If the delinquency
continues the board of directors for the condominium corporation then directs
us to forward the file to a lawyer for collections and possible further legal
action. The owner at this point receives another letter warning them that this
will happen and gives them a final chance to make arrangements to bring their
account into good standing. Based on Mr. ****s complaint it would appear that
he has ignored several notifications including one from Land Titles. To be
clear any arrears are owed to the condominium corporation and it is the
condominium corporation’s board of directors that decides what steps should be
taken to collect on those arrears.Customer Answer

I am rejecting this response because: I never got "any" notices from the land titles office either??? I also never got any notice of any increase in the condo fee too! There's something really wrong here???Some of the stuff she says I don't understand is incorrect, as I know that I purchased the unit from an owner. When I said that I did her a favor, she's taking my statement out of context. At the time I made the purchase, there was a few units that had been empty for some time, and when I bought the place, the maintenance man at the time was all pleased that it was one less unit to worry about. He even told me so!
At the beginning, I was all excited about being part of the strata council, but after the very first meeting I knew something wasn't right? I've discussed it to a few close people I know that know a lot about condo purchasing, and they all said that it smelled rotten.
Now I get an email stating that the caveat has been on the title for some time now. News to me??? As I said, I never got any letter, a note slipped under my door or taped to it, an email to my email account, a phone call or voicemail, nothing. I don't have a crystal ball, and now I'm being charged interest for something I knew nothing about!!!

I’m sorry to hear that you are having trouble receiving
notices including from Land Titles. Since those notices are sent from the
Government of Alberta’s Land Titles office it sounds like you have a mail
delivery issue. You may want to contact ****** **** about that. You clearly are
receiving some notices or would you not be aware of your arrears. I encourage you
to clear your arrears and bring your account into good standing before this

I am rejecting this response because I have first tried to conduct myself in a manner, where I'm not putting myself liable of defamation of someone's character. Now I aplogize for this later response, but I've been dealing with a medical appointment and tests, that I've waited for a year now.Now, like I've said, I did say that "it is, what it is", so I managed at such a short notice, to barely scrape up $2,000.00, and bring it to her office last Friday. I would've been perfectly fine with taking care of it if someone had of even taken the time to leave me with even a voicemail, but no. I do understand that I have zero voting rights, so in the past few days, I sent an polite email to a few of the board members asking for at least copies of the minutes of the meetings, where the condo fee increase and the special levy were voted on? At this time I haven't had a response from any of them.
Now as it sits, I have no idea where my $2,000.00 is even going, and I have no idea if I'm the only one paying this condo fee increase? I talked to someone in the field, and they said that "maybe", someone's secretly selling the building, and they're trying to get your condo at 10 cents on the dollar? Who knows???
The thing that really burns me right now, is because I knew nothing about any of the things stated above, I could've gone out the day before with that money and bought a car, or paid for a holiday or something! I also think it's really unfair that I'm also being charged 6 months interest and a caveat fee, for something I knew nothing about. The condo corp. has the notion that I should've followed up on this sooner, but how do you follow up on something you knew nothing about?
Anyways, my health isn't great which I realize isn't anyone's problem, but all I want to see is the minutes to these meetings? I did talk to a police officer befor giving the money, to make sure I wasn't covering up some past dirt deeds, where it'll come back on me as "guilty by association" or something. I didn't mention any names, I just kept it generic. He told me that I was smart for asking, and to get receipts which I did from their office secretary when I paid.
