I Hired YEG Processing as a server to serve a civil claim on May 29th (for a woman I am sueing for $5000). They told me this was done the same day and even relayed how she responded. Fast forward to end of June I was at the courthouse to file paperwork regarding a restraining order on the same woman and I figured I'd double check on the civil case. They had no record of it being filed. I called the process server and they said they served her but the filing was a mix up and they'd correct it, so I had them serve her for the restraining order. The next day they told me they had served her and that she recognized the process server and threw the papers at them. When I received the copy of the affidavit they had dates crossed out and changed to May 29th which seemed odd. Early July her lawyer had submitted an affidavit to have the entire case dismissed due to never being served in May and during our restraining order court appearance they accused me of perjury for lying about serving her. This brings me to this week where I asked them to provide proof / a statement that she was the one who was committing perjury after several follow ups I get a long winded email about how they did Infact screw up and she was never served and they changed the dates because they thought it was a mistake. THIS IS PERJURY. They said they mailed me a refund cheque but I demanded they cover the full amount of damages I was sueing her for / any related legal fees since my case will be dismissed and she could come after me for legal costs. Now I've been advised to settle/ drop the lawsuit and she has threatened to come after me for her legal costs if I Don't due to the false filing ect.
