I am seeking a resolution! My expectation is for them to reinstall the concrete correctly this time. They should excavate the improperly poured concrete, compact the soil beneath, and then proceed with a proper concrete pour the procedure they should have followed initially, but did not!We engaged their services back in 2022 for a concrete project to reconstruct our walkout basement pillars and address our backyard drainage issues. This company chose to employ subcontractors, resulting in substandard work. While they did manage to reconstruct the pillars, the concrete pour was executed inadequately, as evidenced by the attached pictures.Initially, they promised to complete the project in approximately 2-3 months, but it dragged on for a full 7 months in 2022. However, the workmanship was far from satisfactory. To make matters worse, we were charged a substantial sum for this project, only to discover that they had enlisted unqualified laborers with no affiliation to construction work.The inexperienced individuals hired by the company failed to properly compact the ground before the concrete was poured. Consequently, in 2023, we are left with a *** inch gap beneath the concrete slab due to soil settling. When we sought a resolution, they suggested we "improve drainage and apply a waterproof membrane to the deck surface above." This is perplexing, as our primary reason for hiring them was to address the drainage issue, and their proposed solution fails to address the subpar concrete work.This situation is truly disconcerting! I am insisting that they visit the site to inspect their work. My primary request is for them to reperform the concrete pour correctly this time, ensuring proper soil compaction before proceeding with the pour. It is imperative that this matter is rectified, and I hope that this situation is brought to the attention of others so they are aware of the substandard work that was approved and for which we were charged a significant amount.Business Response

On ****** *** ****, I signed a contract to have window custom made, delivered and installed. However, after I complained about how a subsequent remediation job was handled, they are not willing to continue with the contract for window installation and have asked me to pick up the window at their shop. I paid **** as a deposit for the window and the estimate lists the "Window Supply and delivery to site" as *******. If this company wants to walk away from the project, at least they can fulfill the part of the contract for delivery of window. I already paid for the delivery part.Business Response

Better Business Bureau:I do not agree with the statement that I never pay my bills, especially since their unresponsive to my calls about the original issue and late work caused a ***** remediation job that was finished at the end of October and I paid fully in the middle of December.
However, I will accept their offer to deliver the window. When can I have the window delivered?

In July'21 I hired Buildings Works to remove mold and renovate an upstairs bathroom. Workers did not shut off the water; hit a water line while lifting the floors; caused flooding from upstairs bathroom, to most of the mainfloor + half basement. It took a number of months to get everything completed; work done sporadically; workers busy with other scheduled jobs; very difficult to get workers in near the end. The last work was to replace the flooring in the basement bathroom; very quick, sloppy work; too much glue put underneath; after drying time, glue still oozing out between the boards, up to ***" thick; worker also walked on glue, then carpet/stairs. Discussed with contractor who sent someone to clean it; didn't work well. I repeatedly asked about water and glue buildup/possibility of future mold; concrete under the flooring was not checked; told it would dry and not a concern; told I could easily clean excess glue myself; tried a few times but stopped due to an unrelated injury; wet glue continued to ooze for about 6-8 weeks. The floor and carpet are still a mess. Early Dec'22, 3 of 4 pot lights in this bathroom blew at same time; also questioned mold at base of 1 wall, and floor much colder than before the flood. I contacted the company Nov'22. Mid-December, worker came, took photos/readings; said floor/lower walls were too cold, should be checked and fixed, as well as glue and lighting; he would let the owner know. Many calls/emails later, owner came Feb ***23. Denied cold/mold issues; would call in 1-2 days with cleanup schedule; 4 days later, no call. Since then, 13 texts, 4 voicemails left over 65 days. Only 3 replies, always saying he had to book the cleaners and would call me in 1 or 2 days. Last reply was on Saturday; said he'd call me Monday; once again, not replying to messages. Absolutely frustrated and don't know how to proceed. Any help or suggestions you can provide would be appreciated. Many thanks!Business Response

We did enter into a contract with ******************** on June *th, 2021 for some renovations of an upstairs bathroom, and while performing the demolition a water line was hit and the resulting flooding caused some damage to the kitchen area and a basement bathroom area. We did clean and dry everything up, and restored everything to its original condition or better. All of the work was completed by August **th, including painting the stairway and basement hallway walls, which ******************** asked us to do as compensation for the inconvenience of the flooding. We did the extra work at no charge and ******************** was satisfied with the work and paid us.
Now, 2 years later, ******************** advises that there is moisture and mold and an electrical problem in the basement bathroom. I went to the property to observe and test the wall for moisture content with a Hydrometer. I found that the moisture content of the walls in the bathroom and adjacent Recroom was in the *% to * % range, which is very normal for *******. I also observed that there was some mildew beginning to develop in the corners of the shower under the silicon caulking. I explained to Ms. ******** that the silicone caulking in showers needs to be replaced every year and that this was a maintenance item and not a warranty item. ***************** explained that 2 of the pot lights above the vanity were no longer working . When I replaced the burnt out light bulbs and the lights worked perfectly.
We do not see any reason for any additional remedial work.

#1 - The owner has not replied to my request to clean the floors and carpet. In Dec'22, after weeks of back/forth, a worker came, took photos and agreed there were issues that needed repair (cold walls/floors, lighting, glue on floors/carpet). He said he would relay this directly to the owner. 2 months of contact attempts later, the owner came in Feb'23. The lighting and mould were clarified. His readings for temp/humidity were different from the Dec assessment(?), so this was not dealt with. He agreed the floors and carpet would be cleaned, and he would contact me in 1-2 days. Over 2 months later, nothing has been done. I have attached photos from July/August 2021 and a collage of photos taken minutes ago, to show how that this was never taken care of properly. I have many more but can only add 5 files. The owner would also have the photos taken by his employee. #2-The owner has diminished the original flood damage. The flood went from the upstairs bathroom/1 bedroom wall, down to every closet, pot-light, fan, floors, internal walls, 1/2 bathroom/laundry; then to the basement bathroom, rec room (outer and inner walls, bulkhead, lighting, fans) and furnace room. On July **th 2022, I called Building Works to fix a leaky basement due to a rain storm. The contract included finding the cause of the leak, removing and installing drywall/insulation, cleaning or removing the carpet underlay. The initial contract was for $******* on July ***h. After the drywall and insulation was removed, a containment unit was setup in the basement. A couple of water intrusion tests were conducted with no definitive answer. While I was away at the end of July, another rainstorm occurred on July **th. When I returned, the carpet was very wet and when I called to have them investigate again, there was a lack of attention to the issue. The carpet stayed wet under the tarp of the containment unit and there was no action taken. In August, I purchased a downspout extension and it stop the rain from seeping in on subsequent rainstorms. It was determined that the rain water was seeping in around the window frame. However, there was no attention paid to the wet carpet under the containment unit and fungi started growing on the carpet. What should have been a small job initially turned into a larger remediation job. A big remediation job removed the underlay on Sept *. Now, I have a carpet with badly installed underlay because I did it myself, paint stains on the carpet and a carpet not tucked under the base boards. When I asked them to come and fix the bifold door that was taken off during their remediation, no one came , so I fixed it myself. I was told that the new window could be installed during brief periods of good weather during winter, but two months have passed without any contact about installing the new window. The initial invoice was paid in full, but I feel like I am not getting the service as contractually agreed on. I would like have a partial refund just for overall dissatisfaction, a proper underlay installation for the carpet, proper repair and clean up of stains on the carpet, and a date for the new window installed.Business Response

On July **th we provided ************ with a quote (attached) to remediate mold in his basement and determine what was causing the mold to grow ( water ingress ) and then to put it all back together again. The quote stated that the carpet would be cleaned and dried, but there was a possibility that the carpet and underlay *** need to be removed and replaced at an extra cost. On July **th ************ gave us the OK to proceed with the work. Once we removed the moldy drywall we saw that the water ingress problem was coming from the window. We also saw that the carpet tack strip was rotten and that some of the carpet underlay was wet and moldy had to be removed, however the carpet itself was OK. We provided another quote to replace the window, and ************ gave us the go ahead on August **th. It was explained to ************ that it would take about 2 months to get the window manufactured. The initial work was completed on August **nd and invoiced. The terms of the contract says that final payment is due upon completion of work.
On September **th, ************ had still not paid the invoice on the initial work and I went to see him to ask why he was not paying. He said that he thought he should be eligible for a discount because the carpet underlay was not replaced and the carpet was not installed. I showed him how that was described in the quote and that it would be an extra cost. He said he would be dealing with the carpet installation on his own, and did not need our assistance. However, he was still not willing to pay our bill.
On December **th, three months later, we did finally receive an cheque for payment of the outstanding amount. We did explain to ************ that we did now have the ordered window but due the payment for the initial work being paid 4 months after the work was completed, we would not be installing the window until that amount was paid in advance. We are willing to install the new window when we receive full payment.

I am rejecting this response because:The problem got worse causing more damage than what I initially called about. Initially, I called about water seeping into the basement as shown in the quote from July **th and action was taken such as setting up the containment unit with tarp, removing the drywall and insulation. The source of the problem was not found and I had to wait. However, during that time, I had to call off their workers, who wanted to put in insulation and drywall in July even before the source of the problem was found. The problem got worse after a rainstorm at the end of July and at the time I was away from my house for a week. I came back and noticed that more rain water had gone into carpet. However, when I informed Building Works, I was told that I stilll have the tarp to protect the basement. Actually, the tarp was causing the water to be trapped underneath the carpet this time. Another visit in August determined that rain water was coming through the window, but nothing was done about the wet carpet in August until September *th when they came to do a job and it was discovered that mold and fungus was developing and they needed to do a bigger remediation job. They got rid of the mold and dried the carpet and they finished painting at the end of October only. I did not get a visit on Sept ** about not paying the invoice. The job with drywall painting only completed at the end of October. I complained to the owner in November and wanted a discount because I think I was not getting the service that I paid for. I was also waiting to see if my house insurance would help me with the cost, but their final reply in December was that they would not cover the cost. I paid in full in December.
After I paid in full at the middle of December for the initial remediation job, I was told that the window would be installed at opportunity when there was chinook, but there was no response afterwards.

We do not agree with **************** statements, however in the interest of clearing this up, we will commit to supplying and installing new underlay, and installing the existing carpet, even though it is not in our contract to do so. We will do that when the window gets installed. I am rejecting this response because:I appreciate the offer that Building Works is willing to fix the existing carpet and the underlay at their expense. However, I do not agree with paying for the full amount for the supply and installation of the new window when I was promised that the window would be installed at the opportunity when weather permitted. Furthermore, estimate #**** states that "final payment will be taken when job is completed". I honoured the previous remediation contract estimate #**** even when I thought I was not getting the service that I paid for. I would appreciate if Building Works would honour what was stated in estimate #**** to accept final payment after window installation is completed as well.

I am rejecting this response because:I disagree with the statement of waiting 4 months. Building Works did not wait 4 months. The final painting was completed near the end of October. In November, I made a complaint to the owner about not taking any actions in August for the water in the basement and the miscoordination that occurred leading to delays. When I found that my insurance would not pay for the remediation job, I paid in fulll in the middle of December.

In April 2021, ***** from Building Works came out and assessed repairing a 6 crack in our basement floor. He assured us that Building Works could remediate the problem and gave us what we thought was a reasonable quote of $2118.90. We signed a contract that came with a 5 year warranty.They started the job by sending out an inexperienced employee, who dug out at least 18 of our basement floor and left it worse than it was before. Called ***** and he sent out two different employees to rectify the problem. Job was completed as we thought it should be.Unfortunately, a few months later the problem reappeared in the same spot. Called ***** again and he had the job redone again. A few months later, the problem once again reappeared. At this point, it was obvious that Building Works could not fix the problem. Since a contact was signed and a warranty included, I contacted ***** and requested a full refund. The job was a complete fail and I could see no reason, why I should be out $2118.90 and be left with the same problem I started with before calling Building Works.***** came out and took some pictures to pass on to ***** (President). ***** had told me that ***** had been willing to give a full refund, before sending out workers to redo the job the third time. As of last week, ***** was going to be stopping by with a cheque. Friday, August 26 came and went with no word from *****. It has now been over 2 months since I started my refund request and I keep being told its coming. They have no problem taking your money, but definitely seem to have a problem honoring their end of the contract and their warranty. Next step Small Claims CourtBusiness Response
