    My partner previously filed a complaint with ***** L regarding ******** - I also need to file a complaint against CDM and the property management company. **************** was dropped according to Loan Depot and severe rotting in unit I bought that was no disclosed to me. ****** has been committing fraud and I urge you to investigate her. The *** by law needs to buy back the condo according to professionals. They are evading and we just lost two *** president over this. Current president (**********) is also doing unprofessional things and taking advantage of a retirement community

    To whom it may concern, 

    The Association Manager is working in conjunction with the Board of Directors to get the issue resolved.

    The representative for the owner in question, has made this situation extremely difficult, and this individual has threatened two contractors that were sent to the unit to assess the damage.

    An engineer is involved, and the Board of Directors are hopeful that this can be resolved quickly.

    I am rejecting this response because:

    ******* (CDM),

    I'd like to know when we will have a second engineer out here to access and give their opinion of the issues and what has transpired? When will you be letting the current owners know of the situation as some have units up for sale that could be affected by this? When will you be notifying real estate agents as well since they are showing units in the buildings affected? No one should be buying into this if the buildings have potential structural issues or construction defects without it being disclosed by everyone. Buildings 12 and 14 have the same gutters at 4 locations on each building, this means it has the potential to affect 48 people negatively and any new buyers. 

    I was told there is a denial letter for the claim with American Family that garnered the attention and brought about the engineer, this came from Sutters and Gransforth. Can I get a copy of the denial letter please for this claim *************?

    I'd also like to know when we will have a company to do the remediation or give an estimate for unit 3097?

    Please let me know the status of this information?

    An engineering firm from ********* was provided the report that the engineer that American Family hired provided.
    I am still waiting on him to provide his thoughts and direct the Board as to what needs to be done, as two of the contractors who received the report disagree with the American Family Insurances engineers' findings.

    There are no findings off structural issues, and there is nothing that I can find in the 2003 construction defect report that reflects that the gutter splash guards are a construction flaw, other than what this engineer opines.

    I am preparing to discuss everything with the Board in detail, as one of the directors just returned. A meeting date will be set, and the agenda will include building 14 findings, and solutions.

    I have a call into two different remediation companies and hope to hear back from at least one by today or tomorrow. Will you be willing to allow them into the unit to
    provide an estimate to the Board?

    I don't recall getting a denial letter from American Family, only received the report from the engineer, but I will follow up today with that. Once obtained, I will forward to the representative.

    I am rejecting this response because:

    They have not had an engineer come out besides the one the insurance company sent out. We are now being told the results will be discussed in a meeting on July 12th and they will discuss the replacement of gutters. I have requested the documents and reports of the others giving opinions on the matter and have yet to receive any documents that I have requested for any of these issues which the company in question CDM as well as tge Association South Bay is obligated by law as well as our CCR ro provide us in a timely manner. We are left with major construction issues not being addressed as well as the maintenance of the complex. I have requested mold test results as I was exposed in several areas of the property and have yet to receive these documents so my health care team can better evaluate the issues of the exposure. I have requested to know how and why toxic chemicals were being used in our steamroom and then left to become vapor for the next person to breath. Had the mold been address then no chemicals would of needed to been used and left for others to breath. We must have answers, responsibility, accountability, and if there is liability that be handled by their insurance or they step up and be responsible for the state of this facility and what it has caused or potentially caused.

    The association is continuing its effort to get this resolved in a timely manner, even though this owner and her representative have refused entry.

    The association through its Board of Directors have a signed contract to mitigate the interior, but they have refused entry.

    I would like it reopened, I have been in the hospital and had other health issues. Please see attached second engineer report from our engineer. She also will not provide records and documents in the 14 days required by our CCR.
