On December 5, 2022, the District of Columbia Attorney General Karl A. Racine filed suit against SmileDirectClub, alleging that the business violated DC law by requiring consumers to sign nondisclosure agreements to receive refunds that were promised.
On June 22, 2023, the District of Columbia Attorney General’s office announced a settlement that requires SDC to allow consumers who previously signed NDAs to speak out and to change their refund policy nationally as well as pay $500K to the District of Columbia. SmileDirectClub expressly denies the allegations in the Complaint and expressly denies that they have violated the Lifetime Smile Guarantee or have violated any law or engaged in any deceptive or unfair practices.
