    Massachusetts Attorney General vs. Credit Acceptance Corporation

    BBB reports on known significant government actions involving business' marketplace conduct. The following describes a government action that has been resolved by settlement. 

     

    On 09/01/21, the Massachusetts Attorney General and Credit Acceptance Corporation entered into an Assurance of Discontinuance in Suffolk County Superior Court, Boston. The Assurance is the result of a settlement by both parties in a lawsuit that was announced by the Attorney General on August 31, 2020 (Action No. 20-1954-BLS2). The suit alleged CAC made subprime auto loans to Massachusetts consumers even though it knew the customers would be unable to pay, in violation of Massachusetts state law. The Massachusetts AG further alleged that the company charged illegal fees, overcharged customers for deficiencies, and engaged in illegal debt collection practices. 

     

    Under the terms of the Assurance, the business agreed to pay $27.2 million to an independent trust for purposes of making payments to provide relief for eligible Massachusetts customers. Additional terms of the Assurance require the business to:

    • Limit the frequency of unrequested communication with consumers
    • Send pre- and post-sale repossession notices to customers with Massachusetts loans. Notices must comply with Williams v Am. Honda Financial (case 479 Mass. 656)
    • Provide specific documents/disclosures pertaining to the purchase of a Vehicle Service Contract for Massachusetts loans originated after 12/06/21

    Government Action: BBB reports on known government actions involving business’ marketplace conduct::
    CFPB & State of New York vs. Credit Acceptance Corp

    The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government’s allegations, which have not yet been proven.

     

    On 01/04/23, the Consumer Financial Protection Bureau (CFPB) and New York Attorney General filed a complaint in the U.S. District Court for the Southern District of New York. Charges filed allege Credit Acceptance Corporation (CAC) is in violation of State and Federal laws prohibiting unfair, deceptive, or abusive practices, and violations of state usury limits.

     

    Specifically, the complaint alleges:

    • Credit Acceptance Corporation makes predatory loans to millions of financially vulnerable consumers. CAC’s loans carry exorbitant interest rates, are loaded with expensive add-on products, and saddle borrowers with debts that even CAC believes the borrowers often cannot afford to repay in full.
    • CAC sets interest rates for affiliated dealers, typically about 22%, but those high rates often don’t reflect how much consumers are really paying for a loan because CAC’s business model pushes dealers to manipulate the prices of vehicles, hiding an additional cost of credit in the principal amount financed by the loan.
    • CAC created a complex algorithm to predict how much it will collect from consumers over the life of the loan- not just from monthly payments, but also from potential collection efforts, repossessions, auctions, and deficiency judgments if the consumer defaults. CAC’s lending model is indifferent to a consumers’ ability to repay a loan in full.
    • CAC uses projected collections to decide how much to pay its dealers. Dealers are incentivized to add products to consumer loans, like vehicle service contracts, and to sell cars at inflated prices to increase the dealer’s payout. CAC turns a blind eye when dealers hide the add-on products in loan paperwork or fail to disclose to borrowers that add-on products are included in their loan agreements. 90% of CAC loans included a CAC approved add-on product, often adding thousands of dollars to the already inflated principal amounts.
    • The true cost of credit is higher than what is disclosed on the CAC loan agreements, so many loans actually exceed state usury caps. In New York, more than 84% of loans exceeded the 25% penal usury cap.

      credit acceptance has been reporting my payments as late for almost the past year. The original due date on my contract is for the 1st of the moth. But, The way I am paid, I have had to set up payment arrangements with the company for the 29th of each month. Which I have made on or before the 29th each month, as agreed upon by both parties. I have just recently discovered the reports. I found out because it has had such a negative impact on my credit score. I am not 100% sure, but I think that the payment(s) must be at least 30 days late before being reported. If that is the case then nearly all my payments should not have been reported.

      This has been a decent company to work with overall. My complaint is they do not have a way to accept documentation or requests digitally or via an established secure message portal. It's either fax or via snail mail. The only auto loan I know that is still working in the dark ages for information rely. Hopefully they will create a secure message center in the future that allows a smooth stream of communication between the customer and them. No one has personal fax machines anymore. We all use cell phones or VOIP. No hard **** lines are ever installed unless it's a business. Snail mail is unpredictable. I still have been able to registered my vehicle because the title department claims they have not received my mailed in request for a title change. They are collecting money and interest on a vehicle that can't be used.
