      On December 5, 2024 I signed a contract with DW Fence for a fencing project on my buisness property located at ********************************. Total contract price was $59,500. A $42,500 down payment made. Contractgor asked if materials could be stored on our property once ordered and was told that was OK. Stayed in touch with contractor on the phone and through numerous text messages. Was oringially told that the contractor could start in about 2 weeks and that they would finish about 2 weeks after that start date, or by January 1. Nothing has happened since the contractor picked up my check. In one converstation I was told that the bank account where the funds were deposited were frozen and he could not get at them immediately to order materials. His repsonses are more elusive every time I talk to him. At this point, my busines is suffereing significant losses, we are a horse boarding facility and without fencing we cannot board horses. We are loosing money every day of delay.

      I began soliciting quotes for a six-foot privacy fence from potential contractors in Fall-2023. Established relationship and commitment to proceed with DW Fence. Signed contract and confirmed via email on 4/14/2024. The signed contract, along with a personal check was sent by overnight or priority mail, and the check was endorsed and deposited into DW Fence's account on 4/27/2024. Plain and simple: he stole my money and "ghosted me". Absolutely no follow-up or response to NUMEROUS contacts via voice mail and text since, except for a single text message that prompted only by my one-star ****** review and, not surprisingly, never followed up on by him. DW Fence is in breach of their contractual and moral obligations and has dealt in bad faith. I will be pursuing fraud charges separately. Evidence is in the attached PDF: Contract, emails, check that was cashed. Please note that the address of the business on the contract is slightly different than the default address in your database. I selected the address on the contract (***********) and your database returns a default address of ****************************************** Phone number I have for him is his cell phone **************. I have zero faith in anything he has to say because he hasn't dealt in good faith since he cashed my check. The only acceptable outcome is a full and immediate refund.

      ****** came to my home on May 2nd 2023 with an estimate (#**** from 130' of 6' vinyl fencing). Few days of getting other estimates and waiting for him to call me back, he came by my home on May 8,2023 to sign agreement of said form, I gave him ******* down payment (my check #****). $3000 more on completion. A time frame was discussed to complete work (end *** or beginning of *********** of ******** issued me a permit on May 17th. I called ****** 3 times and no response. I finally spoke to him on Friday May 19, 2023 which he told him he would be at my home tuesday May 23 to stake it out for city approval, no show. On June 2nd, I started texting him instead of calling. He came over June 5th to stake. Before he came, told him that I had found my lot pipes, but one. I have a legal printed land survey for which I gave him. He said no worries, he would find. On June 5th, he accused me of changing my mind, told his employee to stake a post in front of my outside outlet, told me to get a survey,(which was in his hand), told me to find my own lot pipe and string and stake out because he didn't have time to fool around. So I did after he left. I got approval on June 7th from City on the staked out fence lines. When texting him the approval, he was surprised, I asked him when he was going to install, he wrote back saying he was booked into August and had to squeeze me in. When i mentioned his first promise (end ***/start June) his response was "did I say that?" Work was started on July 7th. It took him only 4 hours. The gates are hard to open and close and are scratching the gate. The aluminum siding is bent from his power hammer., I have sent him pictures with his denial of ***********, then said he would pay. Never gave me a time frame to adjust these gates. I called to have estimate of damage to siding for which I was told it was a corner piece that could not be fixed without taking siding down. Cost new siding is ******.

      Hello

      this customer is correct on a few things. As you know factors happen when trying to complete work. Weather, equipment. I never give a customer an exact date when a signed contract happens. I give them an estimated date. I told this customer the timeline and she agreed. She had to get approval from the city of ******** first before I could even give her a date. I stated the timeline and I said if I could get her in sooner I would try. I could not even give the customer a date for install until I knew city of ******** approved everything. 

      the city of ******** are some what harsh and she had no property lines marked and they e quite all 4 to be marked before install. It takes 3-4 weeks minimum to have a survey done to locate stakes for property. She had one stake. She called me and told me I would have to find the others and rent a metal detector. I stated to her in my contract it says customer is responsible for locating property lines. I came out and put my string up where fence would be based on her plot survey. She insisted it was for me to find her property lines and kept me there for an hour when I had another estimate scheduled. I tried explaining over and over and tried my best to find them. I could not find my of them and I was not going to dig up her years trying to find them. Yes I got some what impatient but this customer had rode me since day 1. I am a 1-2 man operation a do install during day. She would call me 3-4 times a day and leave me bad messages. I would respond at night. 

      so yes when I say Im surprised its because ******** never lets the property lines just slide. Yes I said Id squeeze her in which I did in July since I was actually booked into September and I put her in with another job that day.

       

      I have no problem adjusting the gates for her. I usually do adjusting when Im in area for another job! She wanted her fence as close to ground as possible for her dogs and that sometimes will cause gate to rub some. I showed and told her that at install.

       

      to be honest one of my guys has said the siding was already bent. I know for a fact I did not hit that siding, my post is 4-5 of the house and my pounder is not that wide. It is a small rhino pounder and Im pretty sure if I was hitting her house I would have noticed and told the customer. I thought I would do the right thing and say Id pay for corner cause this customer has been nothing but a problem and a thorn to me. I have witnesses of my guys at the job with me on how she had acted or treated us. I have no problem adjusting and fixing the gates because I stand behind my work. But from the get go she has been an issue and wanted her fence in the next day after she signed. I dont know if siding can be cornet or not but I offered to pay yes but I know I did not hit that siding. I just wanted her off my back.
