      This is the second complaint I have had to file against Legacy Landscaping just to get them to complete their work they were contracted to do. The most recent issue is they used a paint/stain on the poured firepit seats that immediately started to bubble up and peel off (within days of them staining it.) July 1st when it was completed, I reached out to tell them it was bubbling really bad and starting to peel. On Friday, July 2nd, ***** (one of *** ******) of the company, sent me an email saying they would come look at it on "Wednesday" (which was July 7th.) Nobody ever showed or called. On July 16th, I emailed ***** again saying nobody has come out or contacted me. ***** responded on July 19th saying the other ***** *****, had wanted to wait a few weeks to make sure no more bubbling had happened and that ***** would be there by the end of the week (July 23rd.) Fast forward to September 4th. I still have not heard anything from ***** or ***** about fixing the bubbling paint so I sent another email asking for an update. I still heard nothing back so I emailed again on September 22nd requesting an update and telling them I planned on filing a complaint. On 09/24 ***** came out to scrape and repaint the firepit. On 09/26 I emailed ***** and ***** asking them to come out and look at what ***** did to the firepit. Not only was the bubbling paint now worse, he had spilled and dripped paint all over the columns, pavers and brickwork of the firepit. I sent pictures and proof of what had happened to ***** and *****. ***** responded on 09/27 saying the have to make sure sunlight isn't shining directly on the seat when they repaint and that all of the paint drips will be cleaned up. That was 7 weeks ago and I have not heard a word from them since. October was great weather so that isn't an excuse. I have documentation, emails and photos so this is not a "he said, she said." I would like to have this fixed and be done with this company for good.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      Legacy Landscaping did come to my home to re-stain the seat and clean up the spilled paint. While the paint was cleaned up, less than a week after they were here the stain has peeled off the seat again, so we are back at square one. The stain will not stay or stick to the material they poured for the seat.

      Legacy Landscaping did come to my home to re-stain the seat and clean up the spilled paint. While the paint was cleaned up, less than a week after they were here the stain has peeled off the seat again, so we are back at square one. The stain will not stay or stick to the material they poured for the seat.

      Hired the company summer of 2020 to install edging, plantings and install sod in side of our house. Sod was installed and the installers ran out of sod. So they moved the sod around leaving gaps in between the sod rolls. I asked them about it they told me it will grow together and you won't see the gaps. In spring on 2021 u noticed the gaps were visible still. So I called and left messages on several occasions, with no response. Finally I talked to a woman in the office and she stated they would send people to look at it. No one ever came to look and no phone calls. I finally left a message explaining that I was giving opportunity for them to resolve this before I hire someone else to repair it and take them to court. The owner then called me and said they had some one come out which Is not true as my house is monitored by cameras. But they said I did not water it and it shrunk. I then sent him a text with picture of the sod and gaps on day after install. No response to that

      ***** ****** did in fact contract us for work around his house and included in this was the installation of some sod.  At the time of install the owner was informed he is responsible for watering.  

      Customer was satisfied with the work that was performed and his bill was paid in full.  This spring he contacted our office and told us he had "gaps" in the sod.  A representative of Legacy Landscaping visited *****'s house and it was obvious the shrinking in the sod was a result of not watering sufficiently.  Browned Edges and exposed gaps are a tell tale sign.  ***** and I exchanged phone conversations and text messages on his situation.  I have told him he can simply put topsoil and seed in the gaps and it should come in provided he waters it, especially in this very dry time.  He wanted nothing to do with that and is threating to sue.  

      I do not believe Legacy Landscaping should be held responsible for a job we finished and were paid in full for in July of 2020.  Customer was pleased with our work at that point.  Now, due to insufficient watering and due to extremely dry temps this season, is asking us to repair.

      We signed a contract to have a patio and firepit put in on August 14th, 2020. We were told the project would take 6-8 weeks and we put 30% down with the contract and another 30% down the next month. All of last year they would only show up one day a week, maybe two, even when the weather was perfect. Now here we are 9 months later and I still get the same excuses "we will be there next week, we will be there tomorrow, we will be there at 11am, we're running late we will be there shortly, and then no one ever shows. This is the most unprofessional and frustrating experience I have ever had with a company and I just want my project finished.

      Mr. ******'s project is currently being worked on and we hope to be completed in the next couple of weeks.  

      Mr. ****** did contract us in August, however, the block he selected was on backorder, a fact he is aware of.  Unilock is a very credible name in our industry and is the company Mr. ****** selected his block from. Unilock initially thought the block would be available in a week or two, however, it ended up being over a month.  We did start on Mr. ******'s project before that, however were put on hold when the block was not in.  This is NOT Mr. ******'s fault or Legacy's fault, or even Unilock's as their factories were shut down and had limited production due to COVID.  When the block did arrive, we were back on site however a new problem arose.  The block were up to 1/2 inch off in size.  We had a choice of grinding the product to fit, a process that doubled our time at least, or send the block back and wait another month for correct block.  We ground the block ( a process that cost Legacy Landscaping money and is not passed on to the customer).  We did not want to delay the project further.  Once the block was in place there was still a question about the caps......Mr. ****** had a decision on selecting a cap or having us "Pour" the tops for him.  This decision delayed us a week or so.  By the time he selected a "Poured" cap we were in mid November and the temperatures did not allow us to do that.  Winter came. So 1/2 Nov, Dec, Jan, Feb, March and until Mid April is snow season for us and we are unable to perform Landscaping duties.  A fact Mr. ****** was informed of.  We told him we would work as long as we could on his project until Winter.  Our Snow contracts do not expire until April 15th.  We have a few weeks of switching our Trucks over from Snow season ( remove plows, salters, etc, get Skid Loaders back from sites, maintenance) before we can "Go" for Landscaping.  

       

      Mr. ****** can dismiss these as excuses, however they are reality.  We have also had a challenging time this spring as Covid has affected many of our employees and their families.  Legacy Landscaping has done their absolute best at keeping its employees and their customers safe from a Covid side and that has resulted in a "sluggish" spring for production.  

       

      We are continuing to do our best to complete Mr. ******'s project in the best time frame possible.  We are in fact on-site today.  Weather looks like it may be a challenge this week, but we will do our best to stay on site.

      We are sorry Mr. ****** is upset with the timing of his project.  As you can see from the details I provided above, we have run into many unforeseen circumstances that have delayed his project.  We ask that he remain patient and we will do a better job of communicating our timing to him.

      On Wed May 5th Legacy Landscaping LLC came to do some yard work for our condo association. In the fall I went over what areas were to be taken care of by them with ***** ********, one of the owners of the company. This was in response to a problem I had with them the previous fall where they took a hedge trimmer to my Serviceberry that was just put in the previous spring. This most recent visit to our condo development they took a weed walker to all of my native flowers in front that I have been trying to grow over the past two years and cut them down. I reached out by phone to ***** on Wednesday May 5th when I came home and sent him a follow up email on Thursday with photos to see if we could find a resolution to this problem. I sent another email on Saturday because I still hadn't heard anything and a text message on Monday. My serviceberry is dying because it was trimmed inappropriately, and my flowers might not bloom at all. I want my tree replaced and compensation for the natives.

      The statement that ***** ***** is *** ********* of ****** *** *********** *********** is false. I am *** ********* of ****** ****** *********** *********** and I was the one that submitted the claim regarding the care of the plants on my property. The serviceberry was over aggressively trimmed with a hedge trimmer two seasons ago. Serviceberries should be trimmed with cleaning pruning shears only removing what is necessary. Native plants should be taken down in late fall or early spring removing only dead material. My plants were trimmed in the fall by me and all the dead material was removed at that time. My plants were in good health and growing green before Legacy cut them down to the ground in May 5th.

      We understand we have not met directly with the owner of these plants. 

      Attached you will find 2 sets of pictures.  The first are of the Native Plants.....as you can see they are doing extremely well. 

      The second is of the serviceberry.  I have close up pics that will show the berries that are covered on the plant along with a wider shot showing the plants are thriving.  

      I am unsure as to what will make the customer satisfied.  We also acknowledge the customer does not want us to touch his "Native Plants", "Serviceberry" and his entire area.  We are more than happy to leave this area alone and our employees have been instructed to do so.
