On 05-24-23 I signed a contract with **** ******** to replace a cracked patio. When **** saw the patio he commented on the many cracks present. The contract states "Like before" and "1 step". **** told me the patio would keep the step below the patio door that steps down to the patio. I had several estimates & some concrete companies agreed to keep the step, & others said they would eliminate the step to raise the patio for better drainage. If patio was raised, I was told that the exit door be raised & there would be a step down to get into the garage. I rejected those estimates that did this because we wanted to keep the step and same levels of the patio & raising the door would make it difficult for the owner to exit the garage to the patio unassisted. When **** said his company would build the patio "like before" and "1 step" I signed the contract. He never suggested we needed to eliminate the step or raise the concrete for drainage or change the patio layout in any way for any reason. **** said either he or his son would be present on every day of work. He said his company is A+ BBB rated & I said that is why we chose his company, along with keeping the patio as original. On 06- 1, I contracted with ******** to replace the garage floor & driveway, & lift a sidewalk square. The old concrete was torn out on 09-11, & workers came 09-15. Neither **** or ****** ******** were present. When I went outside, **** ******* asked me if there were drainage problems on the patio. I said no. He asked if there were cracks and I said yes. Nothing else was ever said. No one came to talk about anything. Without ever talking to me, they poured the patio high against the house, no step, they raised the exit door threshold and covered about 1/2 of lannon stone wall at side of patio. They changed entire patio without my knowledge or permission. Not what I wanted or agreed to. There was a long dent in new concrete and they "repaired" it by pouring dark grey concrete over it. Awful!

The patio was set up 3 days before it was poured. There was not one mention or call regarding height or shape during that time. when this job was completed, customer was happy and paid in full. Several days later, she started calling with complaints. We sent our men to her home at least 4 times to touch up little things she was complaining about. At first, she said there was no discussion about her job. In time she now reveals she did in fact have a discussion with our lead foreman, **** *******n. He is very experienced and professional in his job. For whoever is involved in this complaint, please go look at the job. It’s a quality job and we are not going to do anything more for her. She just talks money, money, money! We have an A+ rating with the BBB because we do quality work and we work well with home owners.

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

The patio design was changed without my knowledge or permission. I trusted that I would get the design agreed to when the contract was signed, which included the step below the patio door and step down to the patio, no covering of lannon stones at the sides of the patio, no raising of the threshold at the exit door. The patio was to be built "like before" as specified in the contract. I also expected a thorough clean up that didn't happen. **** and an employee even had nerve to tell me the new garage door opening was a standard opening, which I found out later that it wasn't. I paid because I had agreed when the contract was signed to pay when they completed the job. **** ******** showed up on the day of the last pour and said it was the day for me to pay. The concrete wasn't even hard enough for me to look at properly. It took time for me to find out the truth of what was done. The exit door required reconstruction including a new header and painting of the wall from the tear out, the lannon stone retaining wall was covered by half by concrete, the patio has a  divot caused during the pour and the repair is unacceptable, and concrete was splashed on the vinyl siding. **** said if I had a reputable concrete co.come out to confirm my concerns he would respect the opinion. I had a A+ rated company out and he agreed with me and even said how the repair should have been done, how clean up should have been done and that the threshold didn't need to be raised so high. I didn't hide from the second company who put in the concrete and **** said the guy from second co. complimented the driveway to ********. This complaint is about the patio not the driveway. **** knows he contracted to put in the patio to match the original design. He said he or his dad would be present during the work. They weren't. He knows no one asked me about the change in design and he knows I was available. He knows keeping the step under the  patio door was crucial for me to choose his company for the job. Perhaps I should have held back payment, but I followed what I agreed to at the time the contract was signed. **** knows someone should have talked to me before they unilaterally changed the design so radically. Yes, I do request money  to rebuild the lannon stone wall, money to properly repair the divot, money to clean the siding, money to build a ramp so the homeowner can exit the garage without assistance. The only person who came out after the job was done was to repair the divot, which is still an eyesore. Everyone else who came out I paid more money to for tuckpointing the bottom of the garage wall, fill in a crack at front porch and place concrete at chips at the front door (paid $1100 extra for this, **** quoted me the price and the guy was a relative of ****'s and a friend of the relative). Some of this work has already chipped, and I did show ****. He just walked away without even acknowledging the poor work. I also hired a guy to replace the soil and place grass seed(also extra fee, no problem, **** not involved).  No one else came out, except the divot repair guy. So my complaint stands.
      Regards,

      ******* *******

The homeowner is not being honest or truthful. She was satisfied and happy with the whole job upon completion.  I stand by my decision!

I have every text message I sent to **** & ****** ******** that shows I was not satisfied with their work. I will forward them all to BBB if necessary. **** knows they were to pour the patio "one step" and "like before". He  said he or his dad would be here during the work. Neither was present. If **** would have been here he could have been sure the crew would pour the patio according to the design he told me would be done and we contracted for. I trusted ****, got terrible results and now he says I was "satisfied." Never. I had a new overhead garage door installed after the concrete work and showed the garage door co. owner the poor job ******** concrete did and he agreed with me that the job was substandard. He also showed me how my garage door sensor was filled with concrete and he had to clean out the mess ******** workers left behind.  He would remember this discussion because I burst out crying. When I told **** what the garage door company owner said, **** said the garage door guy doesn't know what he is talking about. I said the garage door guy works on concrete all day long. I showed the building inspector the "repair" on the patio and he said " why is it that color?" (it's dark gray) All I could say is " that's how ******** repaired it". When the second concrete company came out, he said he would re-do the botched "repair". I originally called ******** for an estimate after a friend in Mequon saw an ad for the company. After the work was done, the friend came over and he asked how I liked it. I showed him the patio and how it was done exactly how I had rejected from other companies. He is another witness as to poor job ******** delivered.  If **** wants to continue saying I am being untruthful, I will ask these people to give witness, plus others, that I never was satisfied with the patio. I can also include photos of the unacceptable repair, the photos of the concrete that buried the lannon stone retaining wall, the concrete splatter across the vinyl siding, the new  door threshold that was raised and now the homeowner needs assistance to get out the back door of his own garage. **** knows I contacted him to resolve these problems. After being frustrated with trying to talk with ****, I texted his dad, ******, the owner on October 5 and told him that I wanted to talk to him, the owner. ****** texted back " My dad is calling you. Both of you need to figure this out ". **** is the owner's dad.  I  continued to try to communicate with **** and when I asked him to come over he texted on November 6 " no we r done for the year".  I have all of the texts, photos and names of friends and businessmen and the inspector that are witness to my dissatisfaction with ********'s work. I never was asked by ******** concrete if they could change the patio design I agreed to in their contract that **** ******** and I signed.  I was not satisfied with their work, ever.

      Regards,

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

[Please type your response here.]  I have added the text message sent to ****** ********, the owner, dated October 05, 2023. The work was started on September 09, 2023. You can clearly see that I reached out to **** earlier with no acceptable resolution to the problems so I contacted the owner, ******. I was never satisfied with their work and **** knows it and so did ******. I have photos of the unacceptable repair made on brand new patio, as well as the doorway we now are forced to live with, the mess of splattered concrete on the vinyl siding, the half buried lannon stone retaining wall. The patio is a big unattractive slab that I didn't contract for, was never told about, would never have approved. This all could have been prevented if **** would have been present when work was started as he promised, or if any of his employees talked to me before they put in a patio that was not what the contract called for. Since I cannot go back in time and get the patio I contracted for, all I am asking is to try to correct what damage ******** has caused. Money to rebuild the lannon stone retaining wall, money to build a ramp for garage door so the homeowner can exit garage unassisted, money to properly repair the patio dent where the "brush" landed too hard, and money to clean the splattered concrete off the vinyl siding.

      Regards, ******* *******
