Refund and Exchange Policy
Scope of Warranty. Blockplane Carpentry shall warrant that all work will be performed in accordance with the terms of the contract and in accordance with the applicable building codes. Blockplane Carpentry shall warrant that it will perform all necessary labor to repair or replace all work that does not conform to the terms of the contract at no cost to The Customer, and will expeditiously act in good faith to secure replacement product under warranty of others.
Period of Warranty. Blockplane Carpentry shall warrant work one year from the date of signing off on the contract.
Separate Time Limitations Period. Any claim or cause of action, regardless of whether the claim is based on breach of warranty, breach of contract, indemnification, misrepresentation or tort must be filed in a court of competent jurisdiction no later than four (4) months following the expiration of the contractor’s warranty. Notice must be in writing and delivered by certified letter.
Commencement of Warranty. Warranty period begins upon The Customer signing off on the punch list.
Claims. The Customer shall notify Blockplane Carpentry of a warranty claim within the 12-month warranty period. Blockplane Carpentry shall respond to such warranty claim within 4 calendar months of notice.
Warranty is Nontransferable. The warranty is nontransferable, by right to compel neither performance nor the transfer of right to sue for damages.
No Extension of Warranty Period. Any warranty work performed by Blockplane Carpentry does not extend the warranty period any further.
Voiding Warranty if Others Correct Work. If a person or company other than Blockplane Carpentry performs or re-performs any work within the scope of this contract, Blockplane Carpentry shall be relieved of its obligations under this warranty and The Customer shall be deemed to have waived the benefits of the warranty.
Manufactured Products. Products supplied by suppliers, manufacturers and subcontractors to the project are warranted only to the extent that the suppliers or manufacturers of those products provide a warranty.
Correction of Work
Punch List. Prior to making final payment to Blockplane Carpentry, The Customer may inspect the work to determine that the work has been completed according to the contract. The Customer may prepare a written list of work that The Customer believes should be completed or corrected according the contract. This written list is called a punch list.
Single Punch List. There shall be only one punch list of work, identifying work to be completed or corrected. The list shall be signed by The Customer.
Completion of Punch List Work by Contractor. Blockplane Carpentry shall expeditiously complete all work stated on the punch list for which Blockplane Carpentry are responsible under the terms of the contract.
First Opportunity to Correct Work. The Customer cannot contract with any alternative contractor for the completion of work, nor claim a credit or back charge for the cost of completing any item stated on the written punch list, nor occupy or use the Blockplane Carpentry’s work until and unless Blockplane Carpentry shall have first been given reasonable notice and opportunity to correct the work stated on the punch list.
Customer’s Penalty for Failure to Provide Opportunity. If The Customer does contract with an alternate contractor to perform the punch work or otherwise complete the project without first affording the opportunity to Blockplane Carpentry to do so, or if The Customer commences to use or occupy the space or work in which Blockplane Carpentry performed work, The Customer agrees to accept all work “as is”, waives any claim against Blockplane Carpentry and agrees to pay the full contract price without deduction for uncompleted or defective work.
Payment and Retainage.  Upon Blockplane Carpentry’s completion or correction of the work identified on the single written punch list, any retainage or amount withheld from the final payment shall be paid within the next three days to Blockplane Carpentry. All further work shall be performed as warranty work.
Disputes and Remedies

Dispute Resolution. If a dispute cannot be resolve between parties, then either party may file suit in an appropriate court of jurisdiction. If suit is file in a Superior Court, the dispute will be decided according to the mandatory arbitration rules of the county in which the suit is file, regardless of the amount in dispute, and each party expressly waive the dollar limits currently in effect according to the mandatory arbitration rules of the county in which suit is filed.
Lien Enforcement. The arbitrator shall have authority to determine the amount, validity and enforceability of a lien.
No Appeal. The parties each waive their right to file any appeal for a trial de novo in Superior Court and agree to accept the arbitrator’s award as final and binding.
Attorney Fees/Costs. If a dispute occurs and either party incurs legal expenses, the prevailingparty shall be awarded its reasonable cost and attorney fees.
