      I am in a dispute with BCI properties for their lack of professionalism and transparency also they are withholding my security deposit and demanding an additional 600 dollars. This company has done no maintenance for two years managing this property and wants me to pay for normal wear and tear. Not only that they are assessing an additional 650 dollars. I am planning to send the Debt notification to them below now. Here is my lease and all the information you can see its laid out clearly they are greedy and trying to steal money from me and instead they should be paying me. I am a veteran, excellent tenant, 760 credit score, no issues. It is normal wear in tear in this home and these criminals are trying to steal from my face in addition to asking for even more.

      Hello ******,


      Thank you for your email detailing out your concern about the move out. The condo was left dirty and needed to be cleaned by a 3rd party cleaner upon move out. This does not fall under the wear and tear compensation for not cleaning the condo upon vacating the property. That is your responsibility and charges for hiring someone to clean the condo does come out of the security deposit on hand.


      There were several blinds that were broken that needed replaced. That is considered damage, more than likely from a pet looking out the window. This does not fall under the wear and tear consideration, but for damages to be debited from the security deposit to be replaced for the next tenant. The same goes for light bulbs that were burnt out and needed replaced. The owner has to pay for the bulbs to be replaced that are burned out. This too comes from the deposit. 


      On the lease, we clearly identify our guideline in determining the security deposit refund, which you did agree to and sign. 


      5.1 CLEANING CHECK LIST
      This list will be used as a guide to determining the security deposit refund amount.
      General:
      1. All trash & debris must be removed.
      2. Wash all windows & ***** inside. Clean out window tracks.
      3. Wash inside and outside of front and back doors.
      4. Clean out fireplace if applicable, sweep debris carefully.
      5. Clean all corners for dust and cobwebs.
      6. Dust/wash all baseboards, trim and base molding.
      7. Wash all dirt, grease, mold and/or marks off the walls.
      8. Wash all vinyl and tile floors.
      9. All carpeting vacuumed and shampoo'd (provide carpet cleaning receipt).
      10. Clean all light fixtures & ceiling fan blades.
      11. Replace all burned out light bulbs.
      12. Clean all switch plates.
      13. Dust and clean all blinds as needed to look new.
      14. Clean all casings around doors and window tracks.
      15. Clean ceiling air return grills.
      16. Replace furnace filter.
      17. Replace smoke detector batteries as needed.
      18. Sweep porch and deck areas.
      19. Mow and edge grass, weed flower beds, remove all yard debris.



      As for the rent proration requested returned, our leases are expressed to begin in the beginning of each month and end at the end of each month. You did give proper 20 days or more notice to vacate the property. Even though you vacated early in the month, you are still responsible for rent through the end of that month. YOu are demanding rent credit back from the *****st, however you properly vacated on 21 Jan. ****** see your email reflecting that. You also in the email acknowledge that the rent for ******* will be paid in full and that you were vacating early. Additionally, you acknowledge having cleaning taken out of the deposit. 


      Even though the lease did expire, we both acknowledged by implied contract that you were still paying rent each month and continued to rent the condo, up to the acknowledgement and act of giving proper notice to vacate. Per RCW *****, Landlords cannot terminate a tenancy unless it falls under 16 Just Cause reasons, therefore your tenancy converted into a month to month implied contract tenancy. 


      As for maintaining the property during your tenancy with respect to repairs, you did only put in one maintenance request for the garbage disposal, which we did replace this. There were no other complaints or concerns brought by you if there was anything wrong in your condo. If there was, we would have addressed it as well. 


      There is nothing that BCI did erroneously or intentionally neglectfully, to demand such a negative review of our company. I am regretful that you feel that way. I am willing to reduce your total balance however to zero owed  to either party. So instead of you owing $675, we will $0 out of the debt. Our charges are reasonable and credited with wear and tear for the painting from the full balance charged by the contractor. Cleaning and damages were reasonably deducted from your security deposit as allowed in RCW *****.310 and per the direction of the lease in which you agreed to and signed and the commencement of the Lease. 


      I have attached invoices that were deducted against your deposit. You were not charged for the light fixture hanging as noted in the move in, you were charged for light bulbs replacements that burnt out. Also, I just received the carpet cleaning invoice which was not reflected in the initial move out disposition. 


      ****** let me know if you agree to zero out the debt on the move out disposition and I will send you the revised disposition. You have been a great tenant and would like to settle this matter respectfully and reasonably.

      The two screenshots tell the entire story of the dishonest snakes in the grass that are BCI properties. The image on the right is from here MY FIRST COMPLAINT... on the better business bureau page. I agreed to stop seeking compensation from this business for their deceptive withholding of my security deposit. I told them I was never paying their outrageous fees. The business agreed to drop their preposterous claim and we would zero the claim let bygones be bygones. Now 8 months later they send me a collections statement. Its fraud and dishonest. Something needs to be done about this company. Its like ARE YOU KIDDING ME ITS IN BLACK AND WHITE ON THE BBB page for the world to see an arbitrated agreement. What can be done to force this company to repair my credit and do I have legal recourse?

      Hello,

      BCI did not see the agreement to settle move out charges that were justified against ******'s Security Deposit on hand, as he only responded to agree to settle the matter through BBB and ignored responding to my email through our company that he agreed to settle. Our collection department for balances owing at move out did send him to collections. When we received notification from ****** that it shows on his credit that he owes BCI money, we immediately reached out to our collection company and had them remove this. We sent ****** comfirmation email from the collection agency that it has been removed and can take up to 30 days. BCi did apologize to ****** that we missed the agreement only mentioned on BBB and not through company email which he has been emailing our company email multiple times since the start of this matter/ dispute. BCI did not do anything harmful intentionally and have respectfully responded each time we received an email from him directly. I understand being upset and having a conversation, but to be Agressively Abrasive and Bullying against BCI does need to remain Amicable. We did send it to collections after agreeing to settle and we immediately responded when we were notified of our mistake. None of this is intentional and action has been managed.

      A request was made to the rental company to repair a broken washing machine that came with the rental and to repair a leak in the roof. The rental company contacted us stating they would not be repairing the washing machine as it was left here by another tenant and was not their responsibility, and they provided a link for us to purchase another washing machine. This was never disclosed to us in our rental agreement and we have no way of removing and replacing said washing machine, due to it being wedged between a wall and the dryer. That was the last contact we had with the rental company and they never addressed the leak in the roof, which leaks into our living room when it rains.

      We understand your concern about the outstanding repairs requested.  We have followed up with the owner of the property about the roof leak when it rains and the slow drain in the bathroom. The owner usually sends their own techs to make repairs of the property and to check the status of any repairs needed. We will have an answer by weeks end as to when someone will be coming to the house to repair the sink drain and look at the roof.


      As for the washing machine, it was present at the time of move in, although per your lease, it is the tenants responsibility to repair/ replace the washing machine if it no longer works. You have been a tenant for over 2 years, with standard usage on the equipment. We can send a tech out there to diagnose and repair the washer, but it would be at your expense. Your Assistant Property Manager, *******, responded to you about contacting ***************** for a replacement one, as that is usually cheaper. Per your lease, that you agreed to is that it is up to the Owner/ landlord to chose to repair/ replace or remove a certain appliance in the home, at which time you would need to purchase one for yourself if needed. This is written in your lease and signed by all responsible parties residing in the home.


      The roof leak is a concern to BCI as well, and thank you for bringing this to our attention again. We will be sure to have the owner schedule someone to look at this, especially before the raining season begins again. I hope this satisfies your concern for the repairs requested. You are always welcome to contact our office directly or the Office Manager at ************ if this is not resolved or scheduled in the next week.
