Dear better business bureau.
This customer bought and built a wood barn kit from **
it burned when the ************************* was mostly destroyed by wildfire.
She ordered a new barn kit of similar wood design..we **** the plans and built the kit. She paid half to start.
Her permitting procesd was delayed when the permit office required that the barn be completely clad in fireproof materoals. She requested that we redesign the plans and kit to meet their requirements. Now she has upgraded *********** items we sent with higher end products from a different company. We are willing to adjust this in a way that is fair to us and to her. We are imn yhat process at yhis time.

This set of construction drawings was to be a complete set of drawings that would be ready for Engineer approval. The original transaction was April 20th of 2023. To date, the set of construction drawings has not been delivered. The design consultant / contractor is no longer responding to phone calls, text or emails.Business response

* RESPONSE TAKEN OVER THE ***** BY BBB STAFF *
**************** paid $500 to have us prepare his design for a 20 by 50 single level building - a cabin. He sent a sketch of what he wanted. I pointed out to him that his sketch wasn't big enough. I said he would need to expand it. I changed it to 22 feet and added 2 feet to the length. When I pointed out how it was going to work in there, **************** wanted to include a loft in there and it was vaulted. I said that was fine, but it wouldn't be very big. I then redrew the drawings and let him know he would need a ladder, but the customer wanted a stairway. I redrew the drawings again. At this point after all the extra work I had done, the customer wanted to go back to the original drawing. I said no as I had already spent so many hours on this. The customer wanted a refund. My cancellation fee is always 50%. I have responded to the customer and if he wants to continue working, he will need to pay for the extra services. It was very unfair of him to ask us to continue working when he asked us to expand/change it 3 or 4 more times and wasn't willing to pay for the changes.

Here is proof that a number of the statements by the Seller are false.
You will see that I paid the seller $850 via cashiers check (see attachment).
Some of the changes that were made on the project were at the suggestion of the Seller. Yes, at one point I did want some substantial changes made. After approximately a week or two of discussions with the seller, I decided to NOT make the changes and reverted back to the original design.
I do NOT remember the Seller informing me of any price increase to the design during the development of the design.
Only when I informed him of my intent to "fire" him for lack of progress and continued delays and excuses did he bring up a new "price".
The Seller NEVER mentioned any Cancellation fee or percentage.
There is no mention, either in the main section of the website, or in the "Customized *********** design section (Yellow circle about 1/3 of a page down on main screen) of ANY cancellation fee or percentage. In fact, NOWHERE on the website, www.barnfactory.com, is there ANY mention of ANY cancellation fees....check for yourselves.
The Seller is putting up a smoke screen. The long and short of the matter is that the Seller has been paid substantially more than he claims; he has NO cancellation procedure or fees anywhere to be found. To date I do NOT have what I paid for.
I had been trying to negotiate a compromise with the Seller for a period of time. But after no response from the Seller, I stopped trying to negotiate. That window of opportunity is now closed.
No disrespect to BBB...But BBB has no teeth. I do not see a way that BBB can help remedy this problem.
It may be necessary to go to court to get my funds back. I'm willing to go that route unless the Seller returns the funds, ALL $850.

It is obvious thT wynanss more than doubled his original design requests. But was unwilling to pay for the extra work.
I might add that he has no clue regarding building code compliance required in any plan. To follow code and fit all that he asked for required the repeated changes we made.
This final effort wss far from the original 20 x 40 cabin he asked for..

The complaint is not resolved.
The seller is exaggerating what he said he did. I have only sketches that look to be drawn on scrap paper and appear to be less than 3"x 4" in size.
Did anybody at BBB look at his website? where any policies listed ? ...I think not.
Did anybody from BBB notice the difference in the cashiers check amount (copy of cashiers check) sent to the seller versus what the seller claims he received.
I will have to incur thousands of dollars in additional construction due to the wasted time and the increase in material/labor cost!!!
I'm looking to legal options against the seller.

The customer does not seem to understand that he could not add greatly to the scope of the original work without adding some additional payment for extensive additional work.Customer response

I understand that the seller would want more money for additional drawings....
That is assuming that he had actually provided or started ANY drawings in the first place.
At this point I have nothing more than small sketches on scrap paper. I have NOTHING that is worth the $850 sent to the seller via cashiers check. I have NO DRAWINGS....that is the problem.
And no understanding from the seller that he can't expect to be paid $850 for 2 or 3 rough sketches!
