      I'm one of the sellers of ****************************, Lorton, VA *****. The settlement company issued 1099-S Forms correctly according to sellers' shares of the property. But the disbursement of the sales proceeds (checks) are not correctly calculated based on the shares (percentages.) I never agreed or authorized to reduce my sales proceeds to give my money to anyone else for this sale/transaction. Real estate transactions/settlement must be based on writing contracts/agreements and other legal records/documents. I found this error in my sales proceeds check ($500 shortage) when I'm preparing my 2022 Tax Return. I emailed the settlement for correction on December 31 of 2022. But they never answered me.

      We are in receipt of your letter dated March 9, 2023 relating to **. ***************** Complaint ID ********, a copy of which is attached.  Also attached is a copy of the authorization form that ************** signed before a Notary Public directing our Company to make her seller proceeds payable to her, and the amount of proceeds she deemed and the other sellers authorized and deemed correct.

      ************** and the other owners of the property located at ************************, Lorton, VA 22079, were represented by The Law Office of **** **********, PLLC and ***** ****** with ******* Title Group.  The Law Office of **** **********, PLLC and ***** ****** and the ******* Title Group together with the sellers corresponded regularly with our Company representatives as our Company served as settlement agent for the transaction.  We disbursed all funds according to the seller proceeds authorization forms filled out by *** *****, signed by *** *****, and notarized.  In fact, there were five sellers of the property of which *** ***** was one, and all five directed us in writing by completing and filling out the exact sums and monies to be disbursed to each seller.  All sellers, including *** *****, each duly signed and notarized their respective seller disbursement forms in complete agreement with each other.  *** *****’s claim that she did not agree to the disbursement of the proceeds is unsupported by any statement to any one at any time prior to disbursement of all seller proceeds.  *** ***** and the other 4 sellers authorized the disbursement directly, their representatives supported and also authorized their financial disbursement and now *** ***** claims she disagrees with the amount.

      *** ***** further claims that she has not heard from any one in our Company related to her complaint.  This statement is false.  Attached you will please find the email streams to which she replied on February 6, 2023.  *** ***** refused all telephone calls made to her, did not return voice mail or text messages, and refused to communicate with her representatives other than to demand monies without any substantiation or agreement of the other sellers, claiming she did not authorize the disbursement. 

      Finally, we will require from *** ***** and the other sellers a notarized payoff and disbursement statement as this property is being sold and *** ***** and the other sellers hold the current financing on the property.
