I contacted Total Package Auto in November 2020 to purchase a vehicle through a buy here pay here advertised dealership. Not even 25 days the vehicle just completely shuts down in the middle of the roadway. I had the vehicle towed to my home and then back to the dealer who had his mechanic look at the vehicle. The so called "owner" Ray B**************** than contacted me to let me know that the engine motor needed to be replaced and he had to shop around to find a replacement engine. They had the vehicle for a total of 90 days. I got the vehicle back in April of 2021 and I drove the vehicle for three days and the check engine light comes back on. It's needs to be addressed so me being the purchaser of the vehicle takes it to my mechanic and it needs a catalyic convertor and a few other sensors. Ray ordered the parts(which no documentation has ever been produced after several request to furnish documentation) and I paid a mechanic to complete the repairs. I drove the vehicle 21 days and the check engine light comes back on, now it needs a slew of things done like misfiring cylinders, transmission leak, major engine oil leak etc. I'm a disabled veteran and I thought I was purchasing a decent vehicle that was rigged. The vehicle ended up breaking down and towed back to the dealer in order for his mechanic to look at it and make repairs that he would then add the cost of it onto the tail end of my loan... today he calls me and says that he's calling to get the account caught up to date and roused the whole thing of the car being repossessed when there was no notice ever sent, no discussion about past due balances...asked for a ledger several times and was told one would be produce However one was not produce. The truck was supposed to be getting fixed by his mechanic but he just had it sitting there stating the battery had died and it was just out of gas as the reason it broke down , he has for 30 days and now you tell me it's been repossessed with no notice or warning or any

*************************** purchased a 2011 GMC Acadia, "AS-IS", in Nov 2020 and according to his retail installment contract, agreed to make monthly payments on the vehicle directly to Lien Holder, Total Package Auto.  Although this purchase was AS-IS, **************** contacted TPA after experiencing issues with the vehicle and TPA agreed to help facilitate repairs through Mechanics that we had a working relationship with to potentially help save him money.  **************** failed to mention that the entire time the vehicle was in possession of the referred mechanic, **************** made no monthly payments on his vehicle and was also in possession of a loaner vehicle from TPA at no cost to him.  **************** was not without transportation the entire time his vehicle was being repaired.   *************** also forgot to mention that while he was driving the loaner vehicle he accumulated over $200 in DC parking and moving violation tickets which had to be paid by TPA as well.  *************** also violated the no smoking agreement that he signed before accepting the loaner vehicle which resulted in additional cleaning fees of the loaner vehicle.

Once the vehicle was given back to ****************, he contacted us about an engine light that needed to be addressed.  We agreed that instead of him bringing the vehicle back to the same mechanic, that he would take it to a mechanic closer to him that he felt comfortable with.  **************** also failed to mention that after discussion and agreement, *** ****** was credited $600 (two monthly payments) for repairs he claims to have paid for.  Once the vehicle was back in ******************** possession he failed to make consistent payments.  He failed to mention that he had several bounced e-checks and sporadic payments inconsistent to his legally binding retail installment contract.  After several attempts which included phone calls, emails, and text messages, I was finally able to contact **************** by calling him in January from an alternate number and at this time he explained to me that he lost his job and couldn't keep up with his payment obligations or repairs that HE was responsible for.

Although he was in breach of contract, and severely delinquent by more than $2500 including missed payments, bounced e-checks, and late fees consistent with his retail installment contract, as a disabled veteran, small owned business, I agreed to help another disabled veteran get back on his feet by offering to help get his vehicle back on the road with no initial out of pocket expenses from him.  TPA took on a towing expense of approx $200 to have his vehicle towed to our mechanic for evaluation.  Once the vehicle was back in our possession, my young sister who is also our title clerk walked to the gas station and filled up a gas can and put it in the vehicle and it started right up.  It was also discovered that *************** had the vehicle sitting for so long that the battery had completely drained.  TPA took on the expense of replacing the battery as well which cost $185.

I contacted *************** and informed him that his car was ready and simply asked what we can do about his delinquency.  At this time, *************** began to yell and use offensive language and statements and told me to keep the car and that he would get his revenge in court.  Based on the sales agreement signed by **************** at time of purchase, **************** agreed to release the vehicle back to TPA in the event that he failed to make payments during the life of his loan.  After being hung up on.  I offered **************** the option of recovering the vehicle by paying only the delinquent balance of $6700 and I would also let him out of the remainder of his contract of approx 6700.  He has not returned my calls.

       Complaint: ********

I am rejecting this response because this is not the truth at all. The vehicle was purchased in January of 21,this was the second d vehicle from TPA,the first vehicle was returned for mechanical issues and u Der advisement from a well honored a d seasoned automotive mechanic I returned the **** and purchased the ******. Not even a week after signing papers, the vehicle broke down on me in the middle of the highway. I had to use my car insurance to ******* vehicle towed. The then hadthe vehicle towed to his mechanic. They claimed to have had to replace the motor however there was not one piece of evidence or documentation from the repair shop stating what had a tally been done to the vehicle after many efforts failed to obtain the documents I then took the vehicle to my personal mechanic who did $600 worth of repairs. A month later the vehicle broke down again. I invested another $500 into the vehicle just to turn around a few weeks later to learn that the vehicle had a major engine oil leak and a major transmission fluid leak. I contacted Ray at TPA and informed him that I could not maintain both a monthly payment and these large amou t of repairs as well as full coverage insurance. I was putting out over a thousand dollars a month for a vehicle that's 12years old. Ridiculous...Also Ray contacted me in November of 2021 about the missed payments. At that time I I formed him via text messages that I would be paying $1,000 that same week. We discussed the history of the loan and I again informed Ray that the vehicle was not running as it had recently broke down again on the highway. Ray offered to have his mechanic look at the vehicle and that whatever the charges were for the repairs he would just add it to the tell end of my loan. His text also stated that he has done this previously for another client of his. After getting the vehicle towed to TPA shop, I would contact Ray weekly asking for status updates about the repairs of the vehicle. At one point t I was repeatedly being told the mechanic hadn't looked at the vehicle yet. A month later I asked for an update and was told that the mechanic was checking the fuel pump out and it appeared that the fuel pump would need to be replaced. The next day after receiving that text Ray called with a cynical tone and went on straight into the past due payments of a total of 2750, and that the vehicle was repossessed for that amount. This was the first time ever mentioning the arrears. I diligently informed Ray that I did not appreciate the manipulative false guises he used to get the vehicle back in his possession by lying saying that he would pay for the repairs but really he wanted possession of the vehicle. We agreed that I would make a payment of 2700 and he would sign the title over to me. However there were no repairs made to the vehicle so I was skeptical on retrieving the vehicle back. He then went on to tell me that the vehicle was being sold at an online auction on Tuesday 3/8/2022. I believe what Ray did was fraudulent and shady business. He had me thinking g that he was helping me out by rebuilding my credit with his in house finance agreement but tried to sell the loan to a third party entity that rejected the loan because I stated to them that the vehicle was not in my possession atthe time and it was having the motor or engine replaced. Also he never contacted me about any bounced checks or fees as I can prove that all my payments ts came directly out of my ****** accounts. They was never any bounced checks as they don't accept payments via checks... this continues to be even more fraudulent now that I think about it. If he was trying to help a disabled veteran he would have accepted the 1,000 I offered and differed the remaining g payme ts to the end of the loan but again he isn't even licensed to finance vehicles just sell them. Another red flag that stands out now. As far as the claim of a loaner car one was provided and no agreements was ever signed for me to use the vehicle. As far as the tags and dc parking tickets, I'm not responsible for tickets that a dealer tag received. That was passed around from several different vehicles during the time I had the loaner car. And yes I am a smoker and that was never mentioned that I couldn't smoke in the vehicle AT ALL. AGAIN I HA E EVERY TEXT MESSAGE AMD EMAIL FROM THE CONCEPTION OF OUR EGAGEMENT TO DO BUSINESS. TPA IS A FRADULENT, MANIPULATIVE CONNIVING BUSINESS THAT NEEDS TO BE SHUT DOWN AT LEAST A HEAVY SANCTION SHOULD BE PLACED UPON THEIR BUSINESS LICENSE. Regards,
