On January 31, 2025, the Utah Division of Consumer Protection and Colarusso Ventures, LLC dba Elan Solar and Kevin Colarusso entered into a Settlement Agreement. The Division alleged 1,109 violations of the Residential Solar Energy Disclosure Act(RSEDA) for failing to provide the required disclosures to Utah consumers. On June 6, 2024, an administrative proceeding was held for the RSEDA violations alleged in the Citation and NOAA. It was determined that Respondents violated the RSEDA and breached the July 2022 settlement agreement. The presiding officer imposed a $1,761,250 administrative fine on Respondents. Agency review of this order has been stayed while settlement negotiations have been ongoing between parties.


The Division ordered Colarusso Ventures, LLC dba Elan Solar and Kevin Colarusso to pay an administrative fine of $240,000; to refrain from owning, operating, or acting as a member or manager of any solar energy company in the state of Utah; and to cease and desist from violating any statutes enforced by the Division as contained in Utah Code § 13-2-1, including the CSPA and RSEDA.

On August 30th, 2023 Utah Division of Professional and Occupational Licensing (DOPL) revoked the contractor license for Colarusso Ventures, LLC dba Elan Solar due to unprofessional conduct and engaging in unlawful conduct. Unprofessional conduct as defined in Utah Code § 58-55-502(4)(a), by engaging in contract violations that pose a threat or potential threat to the public health, safety and welfare including “willful, deliberate, or grossly negligent departure from or disregard for plans or specifications, or abandonment or failure to complete a project without the consent of the owner or the owner’s duly authorized representative or the consent of any other person entitled to have the particular project completed in accordance with the plans, specifications, and contract terms".


Respondent has engaged in unlawful conduct as defined in Utah Code § 58-55-501(13), by failing to pay subcontractors as follows: [I]f licensed as a contractor or representing oneself to be a contractor, receiving any funds in payment for a specific project from an owner or any other person, which funds are to pay for work performed or materials and services furnished for that specific project, and after receiving the funds to exercise unauthorized control over the funds by failing to pay the full amounts due and payable to persons who performed work or furnished materials or services within a reasonable period of time.

In response to this action, the business provided the following statement: "We no longer do installations and are in total compliance with DOPL during our appeal process with them. Instead, we are just selling and working with other solar contractors (EPC companies "Engineering, Procurement and Construction) to perform the installation. Selling, which we are exclusive doing right now, doesn't require a license with DOPL."

The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.


On March 1, 2024, the Utah Division of Consumer Protection issued an Emergency Order to Cease and Desist against Colarusso Ventures, LLC dba Elan Solar and Kevin Colarusso. The Order stated:


1. Respondents shall immediately CEASE AND DESIST from any further violations
of the CSPA and RSEDA, including but not limited to the following:


a. Misrepresenting licensure status with the State of Utah;


b. Representing that Elan Solar is a general contractor that can lawfully offer solar
system installation services or subcontract with third parties to provide these
services, when it is not licensed to do so;

c. Misrepresenting accreditation with the Better Business Bureau;


d. Failing to provide goods and services in the time represented;


e. Failing to provide RSEDA disclosure statements before entering into contracts
with consumers;’


f. Failing to honor warranty terms;


g. Misleading consumers with fake Google reviews;


h. Misrepresenting the prevalence ofits solar systems in Utah and the Salt Lake
area;


i. Misrepresenting the cost ofits solar systems and future energy savings;


j. Misrepresenting that reimbursements will be provided, ifthey will not; and


k. Providing contracts in a different language than sales presentations.
