    FDA Consent Decree

    **update** (December 2023) Evig, LLC and Premium Production, LLC have been allowed to resume production operations. 

    The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

    On November 16, 2023, U.S. Food and Drug Administration (FDA) announced that a dietary supplement distributor, manufacturer, and two executives have been ordered by a federal court to stop producing and selling their products until they come into compliance with federal regulations and requirements under the Federal Food, Drug, and Cosmetic Act. 

    The U.S. District Court for the District of Utah, Central Division has entered two consent decrees of permanent injunction against Evig LLC, which does business as Balance of Nature, and the company's CEO, Douglas Lex Howard, as well as manufacturer Premium Production LLC, and its Manager, Ryan Petersen. 

    Balance of Nature products are marketed as dietary supplements, with labeling that rendered them unapproved new drugs and misbranded drugs. The FDA has not approved Balance of Nature products for any use, despite the company's claims that its products could be used to diagnose, cure, mitigate, treat, or prevent diseases such as cancer, heart disease, cirrhosis, diabetes, asthma, and COVID-19. In addition, they violated current good manufacturing practice (CGMP) requirements, which rendered its products adulterated dietary supplements. 

    Premium Production LLC manufactured Balance of Nature products in violation of multiple CGMP requirements, such as failing to establish ingredient and finished product specifications for identity, purity, strength, and composition, which rendered them adulterated dietary supplements.

    In 2019, the FDA issued warning letters to Evig LLC and Premium Production LLC after facility inspections identified CGMP violations at both companies' facilities. Following the 2019 warning letters, FDA inspections showed that the companies failed to address the deviations and come into compliance with the FDA's requirements. 

    The consent decrees prohibit Evig LLC and Premium Production LLC from distributing or manufacturing products until they are in compliance with CGMP and labeling regulations. Under the consent decrees, both companies must hire CGMP experts, submit documents demonstrating compliance, and receive FDA's approval to resume operations. In addition, Evig LLC must hire a labeling expert to ensure their products are no longer considered new and/or misbranded drugs. 

    Alert:
    As of November 22, 2023, Evig LLC, who does business as Balance of Nature, is undergoing a class action suit over the company's advertising claims. The lawsuit alleges that Balance of Nature has made false and deceptive statements regarding the benefit of their supplements.

    On July 26, 2023, Evig, which does business as Balance of Nature, has agreed to pay $1.1 million to settle a consumer protection lawsuit filed by the Santa Clara County District Attorney's Office. The lawsuit claimed that Balance of Nature made false advertising claims for its dietary supplements, including that the supplements could reduce the risk of cancer. 

    Balance of Nature was ordered to pay $850,000 in civil penalties and investigative costs, and $250,000 in customer restitution. Any California resident who purchased a Balance of Nature product in the past six (6) years will receive a notice on how to claim a refund from the restitution fund. Evig, Balance of Nature is prohibited from engaging in the false advertising described in the complaint. 

    Prosecutors alleged that Balance of Nature made unlawful claims about its products that were not supported by competent and reliable scientific evidence. Some of the claims the company made included that one serving of one product contained the nutritional equivalent of five servings of fruit. Another claim stated that one serving each of two of their products would provide as much nutrition as 10 servings of salad. 

    The complaint also alleged that Balance of Nature claimed that its products could prevent, treat, or cure serious diseases including diabetes, fibromyalgia, arthritis, heart disease, and cancer. The company went so far as to recommend that customers take 12 capsules each of its Fruit and Veggies supplements if they had been "diagnosed with life threatening illness." Balance of Nature also used customer testimonials to make false claims.

      Im the *** for my aunt who has dementia. I have made multiple requests over the last two years for her to be removed from any and all mailing lists, however; she continues to receive advertisements in the mail. This is harassment and needs to stop immediately.

      When placing my first order I asked the representative to please not ship any more product or charge the credit card unless j call to order again ,, the representative assured me this would not happen ,, well It did happen and my credit card was charged and I no longer want the product
